AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, ACCEPTING THE TRANSFER OF
WATER METERS SITUATED AT THREE CUSTOMER
ACCOUNTS ALONG S. 139TH STREET EAST OF 53RD
AVENUE SOUTH FROM KING COUNTY WATER DISTRICT
NO. 125; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, RCW 35.13A.050 authorizes cities and towns to accept the transfer of, and
assume the responsibility for, facilities owned by water districts whose boundaries overlap
those of the City; and
WHEREAS, King County Water District No. 125 is the owner of three 3/4 -inch water
meters along S. 139th Street; and
WHEREAS, the City of Tukwila has built a parallel water system along S. 139th Street to
serve these accounts in the future; and due to the construction of the Macadam Road Bridge
affecting the distribution system, Water District No. 125 now requests the City to accept the
transfer of the ownership of, and assume responsibility for the maintenance of, the
aforementioned water meters, and has furnished to the City a bill of sale conveying said water
meters; and
WHEREAS, the City's Public Works Department has recommended to the City Council
that the water meters be accepted by the City, and the City Council has determined to follow
the recommendation of the Public Works Department;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Acceptance of Transfer of Ownership and Responsibility for Maintenance.
The City Council of the City of Tukwila hereby approves and accepts the transfer and
conveyance to the City of three water meters owned by King County Water District No. 125
and located at the following addresses:

13905 55th Ave. S. I One 3/4 -inch meter and service.
5323 So. 139th St. I One 3/4 -inch meter and service.
The City of Tukwila does hereby accept ownership of and full responsibility for
maintenance of said water meters, under the same terms and conditions as the City maintains
other meters located within the City, and that the said meters be accepted as part of the
physical inventory of the City of Tukwila water utility.
Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.

Section 3. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect five (5) days
after passage and publication as provided by law.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a
Regular Meeting thereof this 7 day of 0�-- 2000.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, ACCEPTING THE
TRANSFER OF WATER METERS SITUATED AT THREE
CUSTOMER ACCOUNTS ALONG S. 139TH STREET
EAST OF 53RD AVENUE SOUTH FROM KING COUNTY
WATER DISTRICT NO. 125; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE.
On July 17, 2000, the City Council of the City of Tukwila passed Ordinance No.
1920, accepting ownership of and full responsibility for maintenance of three water meters, under
the same terms and conditions as the City maintains other meters located within the City;
providing for severability; and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
