AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, PROVIDING CITY FIRE INVESTIGATORS WITH LAW
ENFORCEMENT COMMISSIONS FOR THE PURPOSE OF CONDUCTING
ARSON INVESTIGATIONS PURSUANT TO RCW 48.48.060; PROVIDING
FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council desires to provide City fire investigators with commissioned police powers
for the purpose of conducting arson investigations as authorized by RCW 48.48.060, provided, however, that
said commissioned fire investigators are not authorized to carry firearms;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Commission of fire investigators. The City Council hereby grants law enforcement
commissions to Tukwila fire investigators for the purpose of conducting investigations into the origin, cause,
circumstances and extent of loss of all fires pursuant to RCW 48.48.060, provided, however, that said
commissioned fire investigators are not authorized to carry firearms.
Section 2. Access to criminal records. Tukwila fire investigators shall have access to criminal history
record information as defined in the Washington State Criminal Records Privacy Act, RCW Chapter 10.97.
Dissemination of such records to fire investigators with law enforcement commissions is consistent with RCW
10.97.040, which permits the same.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this
ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any
reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or
constitutionality of the remaining portions of this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official
newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and
publication as provided by law.

On b 1/5.�d the City Council of the City of Tukwila passed
Ordinance No. '11/3 granting law enforcement commissions to Tukwila fire
investigators, provided, however, that said commissioned fire investigators are not
authorized to carry firearms; providing for access to criminal history record information
as defined in the Washington State Criminal Records Privacy Act, RCW Chapter 10.97;
providing for severability; and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who
submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
