AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, AMENDING ORDINANCE NOS.
1490,1604 AND 1747, AS CODIFIED AT CHAPTER 5.56 OF THE
TUKWILA MUNICIPAL CODE (ADULT ENTERTAINMENT),
TO REDEFINE "ADULT ENTERTAINMENT PROVIDING
FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the City Council desires to amend the definition of adult entertainment to
mirror that of the City of Bellevue, which has withstood legal challenges;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. TMC 5.56.020.A Amended. Ordinance Nos. 1490, 1604 and 1747, as codified at
Tukwila Municipal Code 5.56.020.A, are hereby amended to read as follows:
A. "Adult entertainment" means:
1. Any exhibition, performance or dance of any type conducted in a premises where
such exhibition, performance, or dance involves a person who is unclothed or in such costume,
attire, or clothing as to expose any portion of the female breast below the top of the areola or any
portion of the pubic region, anus, buttocks, vulva or genitals, or wearing any device or covering
exposed to view which simulates the appearance of any portion of the female breast below the
top of the areola or any portion of the pubic region, anus, buttocks, vulva or genitals, or human
male genitals in a discernibly turgid state, even if completely and opaquely covered; or
2. Any exhibition, performance or dance of any type conducted in a premises where
such exhibition, performance or dance is distinguished or characterized by a predominant
emphasis on the depiction, description, simulation or relation to the following specified sexual
activities:
(a) Human genitals in a state of sexual stimulation or arousal;
(b) Acts of human masturbation, sexual intercourse or sodomy;
(c) Fondling or other erotic touching of human genitals, pubic region, buttocks or
female breast; or
3. Any exhibition, performance or dance which is intended to sexually stimulate
any member of the public and which is conducted on a regular basis or as a substantial part of
the premises activity. This includes, but is not limited to, any such exhibition, performance or
dance performed for, arranged with or engaged in with fewer than all members of the public
on the premises at that time, with separate consideration paid, either directly or indirectly, for
such performance, exhibition or dance and which is commonly referred to as table dancing,
couch dancing, taxi dancing, lap dancing, private dancing or straddle dancing.

Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect five (5) days
after passage and publication as provided by law.

Ordinance No /9/ amending the definition of "adult entertainment providing
for severability; and establishing an effective date.
