AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, AMENDING ORDINANCE
NO. 1363, AS CODIFIED AT TMC 8.50.020A.2., TO INCLUDE
AN EXEMPTION FOR NON OBSCENE EXPRESSION TO
THE DEFINITION OF LEWD CONDUCT; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, the City Council desires to amend Ordinance No. 1363, as codified at TMC
8.50.020A.2., relating to lewd conduct, to include non obscene expression as an exemption to the
definition of "lewd act
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Non obscene expression. Ordinance No. 1363, as codified at TMC 8.50.020A.2.,
is hereby amended to read as follows:
2. "Lewd act" means:
a. Touching, caressing or fondling the genitals;
b. Exposure of one's own erect penis;
c. Masturbation;
d. Sexual intercourse; or
e. Urination or defecation other than in a restroom.
Provided, however, that the foregoing definition shall not apply to any:
f. "Expressive dance" as defined in TMC 8.50.020A.1.;
g. Play, opera, musical or other similar work;
h. Class, seminar or lecture conducted for a scientific or educational purpose;
i. Nudity within a locker room or other similar facility used for changing
clothing in connection with athletic or exercise activities; or
j. Non obscene expression.
Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.

Section 3. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect five (5) days
after passage and publication as provided by law.

Ordinance No. /To' ig# amending TMC 8.50.020A.2., relating to lewd conduct, to
include non obscene expression as an exemption to the definition of "lewd act providing
for severability; and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who
submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
