HomeMy WebLinkAboutOrd 1905 - Weapons Possession �vJILA, i Q i• 0 +its\ 11908'y`N f Tukwi*la C ity o Washington Ordinance No. /9?> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TMC 8.10.010 TO ADOPT CHANGES TO STATE LAW PROVISIONS REGARDING THE POSSESSION OF WEAPONS AND ADOPTING BY REFERENCE RCW 9.41.300; REPEALING ORDINANCE NO. 1363, AS CODIFIED AT TMC 8.10.040; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council desires to amend TMC 8.10.010 to incorporate changes in state law relating to the possession of firearms; and WHEREAS, the City Council desires to eliminate TMC 8.10.040 because it is inconsistent with state law, and adopt by reference RCW 9.41.300 relating to the possession of weapons in TMC 8.10.010; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Firearms and dangerous weapons prohibitions. TMC 8.10.010 is hereby amended to read as follows: The following statutes of the State of Washington, as presently constituted and hereinafter amended, are adopted by reference: RCW 9.41.010 Terms defined. RCW 9.41.050 Carrying firearms. RCW 9.41.060 Exceptions to restrictions on carrying firearms. RCW 9.41.070 Concealed pistol license Application Fee Renewal. RCW 9.41.080 Delivery to ineligible persons. RCW 9.41.090 Dealer deliveries regulated Hold on delivery. RCW 9.41.098 Forfeiture of firearms Disposition Confiscation. RCW 9.41.100 Dealer licensing and registration required. RCW 9.41.120 Firearms as loan security. RCW 9.41.140 Alteration of identifying marks Exceptions. RCW 9.41.170 Alien's license to carry firearms Exception. RCW 9.41.230 Aiming or discharging firearms, dangerous weapons. RCW 9.41.240 Possession of pistol by person from eighteen to twenty -one. RCW 9.41.250 Dangerous weapons Penalty. RCW 9.41.260 Dangerous exhibitions. RCW 9.41.270 Weapons apparently capable of producing bodily harm Unlawful carrying or handling Penalty Exceptions. Section 2. Repealer. Ordinance No. 1363, as codified at TMC 8.10.040, is hereby repealed. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. NOS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TMC 8.10.010 TO ADOPT CHANGES TO STATE LAW PROVISIONS REGARDING THE POSSESSION OF WEAPONS AND ADOPTING BY REFERENCE RCW 9.41.300; REPEALING ORDINANCE NO. 1363, AS CODIFIED AT TMC 8.10.040; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. 4.4.2.1,4/W Z2, e.O/j the City Council of the City of Tukwila passed Ordinance No. l '7 adopting by reference State of Washington statutes relating to the possession of weapons; incorporating changes in state law relating to the possession of firearms; eliminating a section that is inconsistent with state law; providing for severability; and establishing an effective date.
