Assessor's Property Tax Parcel /Account Number(s): 284300 -0030 284300 -0020 284300 -0015 284300 -0010 284300 -0005 284300 -0065 284300 -0060 284300 -0055 284300 -0046 284300 -0045 284300 -0040 284300 -0035 WHEREAS, King County petitioned to vacate West Marginal Place South from South 110th Street, extending approximately 370 feet south; and WHEREAS, the City of Tukwila City Council conducted a public hearing on May 28, 1996 for the purpose of considering the vacation of certain property located in the City of Tukwila, as described above; and WHEREAS, TMC 11.60 identifies street vacation procedures including a public hearing by resolution, review and comment by the Departments of Community Development and Public Works, and forwarding all relevant information to City Council, all of which have been done; and and City of Tukwila Washington Ordinance No. /2. 7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, VACATING CERTAIN PROPERTY LOCATED WITHIN THE CITY, DEDICATED FOR STREET PURPOSES, GENERALLY DESCRIBED AS WEST MARGINAL PLACE SOUTH BEGINNING AT SOUTH 110TH STREET AND RUNNING APPROXIMATELY 370 FEET SOUTH, INCLUDING THE CUL -DE -SAC; AMENDING THE OFFICIAL STREET MAP OF THE CITY; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, utilities exist within the right -of -way which require relocation and easement; WHEREAS, following conclusion of the public hearing, the Committee of the Whole found the vacation request should be forwarded to the City Council; and WHEREAS; the City Council has determined that the fulfillment of the conditions specified herein shall constitute consideration in lieu of money, as authorized by the Tukwila Municipal Code 11.60.050; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A. Vacation. The following property located in the City of Tukwila is hereby vacated: West Marginal Place South, beginning at South 110th Street and extending approximately 370 feet south, including the cul -de -sac (refer to Site Map, as shown on Exhibit A and attached hereto). B. Conditions. This vacation is conditioned upon satisfaction of the following: 1. Relocation of Seattle water line facilities and granting of an easement by King County to Seattle. 2. Relocation or removal of Seattle City Light facilities and granting of an easement by King County to Seattle City Light, if the facilities are moved on site. STV-WMargP1S 2/7/00 1 Section 2. Duties of City Clerk. The City Clerk is hereby directed to record a certified copy of this ordinance with King County, upon determination by the City Public Works Director that the conditions referenced above have been satisfied. Section 3. Amendment of Official Street Map. Upon the recording of a certified copy of the ordinance, the City Public Works Director shall amend the City's official street map to be consistent with this ordinance. Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 5. Effective Date. This ordinance or a summary thereof shall take effect five (5) days after passage and publication as provided by law; provided that the vacation specified above shall not become effective until the conditions contained herein have been fully satisfied.
