ORDINANCE NO. 977 77
AN ORDINANCE OF THE CITY OF TUKWILA RELATING TO THE PEACE,
SAFETY AND WELFARE OF THE PEOPLE OF THE CITY OF TUKWILA.
WHEREAS, R.C.W. 35.24.290 authorizes 3rd class cities to make
ordinances as may be deemed expedient to maintain peace and safety within
the limits of such city, and;
WHEREAS, the existing ordinances of the City of Tukwila contain
no provision prohibiting the unlawful presence of a person upon the property
ore premises of another, and;
WHEREAS, it appears necessary to preserve the peace, safety and
welfare of the citizens of the City of Tukwila to establish such a provision.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN
AS FOLLOWS:
CRIMINAL TRESPASS
(1) A person is guilty of criminal trespass if he knowingly
enters or remains unlawfully in a building or on the premises of another.
(2) In a prosecution for criminal trespass, it may be inferred
that a person has acted unlawfully where such person is found upon a
premises which is fenced or otherwise enclosed in a manner to exclude
intruders.
(3) A defense to criminal trespass shall be established where
a person so charged produces evidence satisfactory to the trier of fact
that the person was present on the premises or in the building without
criminal intent.
(4) This ordinance shall be in full force and effect five days
from and after passage by the City Council and publication as required
by law.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof, this 7th day of June 1976.
