AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, AMENDING ORDINANCE NOS.
1771 AND 1811 AS CODIFIED AT TUKWILA MUNICIPAL
CODE CHAPTER 8.75, "CURFEW FOR MINORS
EXTENDING THE EXPIRATION DATE; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, 897 juveniles were arrested for crimes in 1996, with approximately 10% of
those crimes occurring between 10:00 Pm and 6:00 AM; and
WHEREAS, in response to the juvenile crime rate City Council passed Ordinance 1771,
the minor curfew ordinance, in 1996; and
WHEREAS, Ordinance 1771 provided that it be reviewed by City Council one year from
its effective date; and
WHEREAS, in 1997, after considering the Police Department's report issued pursuant to
TMC 8.75.060, the Court of Appeals decision in State v. J.D., 86 Wn.App. 501 (1997), and after
considering amendments to Ordinance 1771 made in response to the Court's directives in State v.
J.D., City Council extended the effect of Ordinance 1711 for another year by passing Ordinance
1811; and
WHEREAS, after passage of the curfew ordinance in 1996, both juvenile crime and
juvenile victimization fell in 1997 and again in 1998; and
WHEREAS, the Police Department supports having the curfew ordinance because it is an
effective tool for its use in reducing crime; and
WHEREAS, City Council has now considered the Police Department's report pursuant to
TMC 8.75.060 for 1998;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Amendment. Ordinance 1771, Section 6, "Expiration," and Ordinance 1811,
Section 4, codified at Tukwila Municipal Code 8.75.060, are hereby amended to read as follows:
8.75.060 Expiration.
A. The results of this ordinance shall be reviewed by the City Council ten months after its
enactment. The Police Department and administration will consider the effectiveness of the
continuing need for these sections. The report should include, but not be limited to, reporting on
the practicality of enforcing the ordinance and any problems with enforcement; what types of
placement of curfew violators were made; the impact of juvenile crime statistics and juvenile
victimization; the public perception of juvenile crime, number of minors cited for a curfew
violation; and any official citizen complaints about these sections.
B. The ordinance shall expire one year after its effective date of passage unless prior to
that date the City Council shall provide for its extension by ordinance.

Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect five (5) days
after passage and publication as provided by law.
