HomeMy WebLinkAboutOrd 1845 - 1997 Uniform Housing Code (Repealed by Ord 2057) i�a...... t y:, i 0 1908 C ity o f T Washington Ordinance No. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE 1738; AMENDING TUKWILA MUNICIPAL CODE CHAPTER 16.06 TO ADOPT THE 1997 EDITION OF THE UNIFORM HOUSING CODE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council has determined to update its current regulations regarding premises, dwellings, rooming houses, lodging houses or parts thereof, which by reason of their structure, equipment, maintenance, use or occupancy affect or are likely to affect adversely the public health, safety and general welfare, by adopting the 1997 Edition of the Uniform Housing Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Repealer. Ordinance No. 1738, as codified at Chapter 16.06 of the Tukwila Municipal Code, is hereby repealed. Section 2. Uniform Housing Code Adopted. Section 16.06.020 is hereby amended to read as follows: 16.06.020 Uniform Housing Code Adopted. The Uniform Housing Code, 1997 Edition and Standards thereto as adopted by International Conference of Building Officials, is adopted and incorporated by reference as if fully set forth, with the following modifications: 1. Pages number v through vii, "Codes and Related Publications," and "Table of Contents," of the Uniform Housing Code, 1997 Edition adopted by the City, are hereby deleted. 2. All references to "the building official" in the Uniform Housing Code, 1997 Edition adopted by the City, are hereby revised to read "the code enforcement officer or designee." 3. Section 203.1, "General," of the Uniform Housing Code, 1997 Edition adopted by the City, is hereby revised to read: 203.1 General. In order to hear and decide appeals of orders, decisions, or determina- tions made by the code enforcement officer relative to the application and interpretations of this code, there shall be a Hearing Officer, including, but not limited to, a City employee(s) or any other person or entity hired for the purpose of presiding over appeals filed pursuant to this chapter. The Hearing Officer shall render all decisions and findings in writing to the appellant with a duplicate copy to the code enforcement official. Appeals to the Hearing Officer shall be processed in accordance with the provisions contained in Chapter 8.45 of the Tukwila Municipal Code. 4. Section 701.1 of the Uniform Housing Code, 1997 Edition adopted by the City, is hereby revised to read: UHC.DOC 7131198 1 Section 701.1 Heating. Every dwelling and guest room shall be provided with heating facilities capable of maintaining a room temperature of at least 65°F when the outside temperature is 24 °F or higher, measured at a point three feet above the floor in all habitable rooms, baths and toilet rooms. When the outside temperature is less than 24°F, the heating facility must maintain an average temperature of at least 58°F measured at the same floor level in the same rooms. 5. Chapter 12, "Appeal," of the Uniform Housing Code, 1997 Edition adopted by the City, is hereby deleted. 6. Chapter 13, "Procedures for Conduct of Hearing Appeals," of the Uniform Housing Code, 1997 Edition adopted by the City, is hereby deleted. 7. Sections 1501.2, 1502.1, 1502.2 and 1612 of the Uniform Housing Code, 1997 Edition adopted by the City, are hereby deleted. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law.
