AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, ADOPTING
THE RIVERTON STORMWATER QUALITY
MANAGEMENT PLAN AND INCORPORATING
THE PLAN INTO ITS ADMINISTRATION UNDER
THE CITY'S SURFACE WATER MANAGEMENT
ORDINANCE; PROVIDING FOR SEVERABILITY;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila entered into a Grant Agreement G9500201 effective
March 31, 1995, to carry out the Riverton Stormwater Quality Management Plan; and
WHEREAS, the City of Tukwila hired a consultant, Entranco Engineers, Inc., to assist the
City in carrying out this Plan to identify water quality problems and develop water quality
improvement actions and projects to solve these problems; and
WHEREAS, the Final Draft Plan is now complete and reviewed by Ecology for
compliance of Sections SW -1 through SW -4 of the Puget Sound Water Quality Management
Plan. Ecology's comments have been fully addressed and incorporated into the Final Draft
Plan and, after final review by the Department of Ecology, has been approved by Ecology; and
WHEREAS, the Riverton Creek Citizens Action Committee (referred to in the Grant
Agreement as The Steering Committee) was formed and the Committee's participation was
achieved through three (3) meetings as part of the Plan development process. The Committee
assisted the City in the development of the water quality issues, Plan goals and the priorities
for the Plan recommendations. At their third and final meeting, the Citizens Action
Committee reached a consensus to endorse the Plan (with added comments which have been
received and addressed in the Final Draft Plan); and
WHEREAS, Section 4.4 of Grant Agreement G9500201 calls for adoption of the Riverton
Stormwater Quality Management Plan by the City Council, and also the Plan into the City's
Stormwater Management Ordinance by reference to provide the means for implementation
and regulatory enforcement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Adoption and Applicability.
A. The Riverton Stormwater Quality Management Plan is hereby adopted, and shall
become binding as of the effective date of this Ordinance on properties and the operations of
agencies within the Riverton Creek Basin, within the City of Tukwila. Tukwila Municipal
Code 14.30.080, A.2, is hereby amended to include this plan as part of the additional design
criteria for the City's drainage review requirements.
B. The goals, objectives, development standards, development regulations and
implementation strategies contained within the Riverton Stormwater Quality Management
Plan are hereby adopted as a basis for the evaluation of development and the construction and
operations of King County, METRO, WSDOT, City, Sewer and Water Districts and private

development activities within the Riverton Creek planning area pursuant to Section 1.7
Drainage Review Requirements, A. Storm Water Design Standards, #2 Additional Criteria in
Basin Plans.
Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 3. Effective Date. This ordinance or a summary thereof shall be published in
the official newspaper of the City, and shall take effect and be in full force and effect five (5)
days after passage and publication as provided by law.
PASSED BY THE CITY COUNCIL OF THE CITY OF- KWILA, WASHINGTON, at a
Regular Meeting thereof this day of r ,1998.

On /99k the City Council of the City of Tukwila passed
Ordinance No.° 4/ adopting the Riverton Stormwater Quality Management
Plan and incorporating the Plan into its administration under the City's Surface Water
Management ordinance as called for in Grant Agreement G9500201, and amending
TMC 14.30.080, A.2., to include this plan as part of the additional design criteria for the
City's drainage review criteria; providing for severability and establishing an effective
date.
The full text of this ordinance will be mailed without charge to anyone who
submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
