Additional legal is on page of documents(s) Assessor's Property Tax Parcel /Account Number(s) 0 ti cu 0 IU 4/ Alt 5 4. .1t l a' ~A _-1,1 �ti 2 0 City o f Tukwila Washington Ordinance No. /S AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, VACATING 55TH AVENUE SOUTH FROM S. 139TH STREET TO S. 140TH STREET, LOCATED IN THE CITY OF TUKWILA, AMENDING THE OFFICIAL STREET MAP OF THE CITY; PROVIDING FOR SEVERABILITY; Q'1 AND ESTABLISHING AN EFFECTIVE DATE. f.\d GC WHEREAS, the City of Tukwila City Council conducted a public hearing on September 2, 1997, and September 22, 1997 for the purpose of considering the vacation ,.4 of certain property located in the City of Tukwila, as described above; and QO WHEREAS, TMC 11.60 identifies street vacation procedures including a public hearing by resolution; review and comment by the Departments of Community Development and Public Works; and, forwarding all relevant information to City Council, all of which have been done; and WHEREAS, all the affected property owners have responded affirmatively to e2 acquiring the vacated right of way abutting their respective properties; and In WHEREAS, the right -of -way to be vacated has a fair market value of $2,873.38, for C,, which the City is entitled to compensation equal to half of such fair market value; and C WHEREAS, the City has identified the need to retain a public utility easement from South 139th Street to South 140th Street; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Vacation. The following property located in the City of Tukwila is hereby vacated: 55th Avenue South from South 139th Street to South 140th Street. Section 2. Reservation of Easement. A 20- foot -wide public utility easement is reserved from South 139th Street to South 140th Street on the westerly 20 feet of the 32- foot -wide right -of -way being vacated. Section 3. Compensation. The City shall receive $1,436.69 as compensation in full for the right -of -way vacated herein ($2,873.38 x .5 $1,436.69). STV55.DOC 7/2/98 1 Section 4. Duties of City Clerk. The City Clerk is hereby directed to record a certified copy of this ordinance with King County, upon determination by the City Public Works Director that the conditions referenced above have been satisfied. Section 5. Amendment of Official Street Map. Upon the recording of a certified copy of the ordinance, the City Public Works Director shall amend the City's official street map to be consistent with this ordinance. Section 6. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 7. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law; provided that the vacation specified above shall not become effective until the conditions contained herein have been fully satisfied.
