AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, AMENDING
ORDINANCE 1758 §1 (PART) AND TUKWILA
MUNICIPAL CODE TITLE 18 ALLOWING ESSENTIAL
PUBLIC FACILITIES AS UNCLASSIFIED USES IN
VARIOUS ZONES; REPEALING ORDINANCE 1770
SECTION 43; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, essential public facilities include elements necessary for the development and
maintenance of public infrastructure in both residential and business neighborhoods; and
WHEREAS, undergrounding wherever feasible will help to lessen the impact of those
facilities; and
WHEREAS, essential public facilities already exist in residential and office areas of the
City, and are not objectionable because of the value they provide;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Unclassified Uses. Ordinance 1758 §1 (part) and Tukwila Municipal Code
Title 18 are hereby amended as follows:
The following zones in the Tukwila Zoning Code shall allow the essential public facilities listed
below the table, as unclassified uses:
Zone 1 I Unclassified Use Section
Low Density Residential (LDR) 18.10.050
Medium Density Residential (MDR) 11 18.12.050
1High Density Residential (HDR) 11 18.14.050
Mixed Use Office (MUO) 1 18.16.050
Office (0) I 1 18.18.050
j Neighborhood Commercial Zones (NCC) 1 18.22.050
1. Neighborhood stormwater detention and treatment facilities
2. Stormwater pump stations
3. Water utility reservoirs and related facilities
4. Sewage lift stations
5. Water pump stations
6. Other uses not specifically listed in this Title which the Director determines to be:
a. Similar in nature to other uses allowed through the unclassified use permit;
b. Consistent with the stated purpose of the district;
c. Consistent with the policies of the Tukwila Comprehensive Plan.
Section 2. Decision Criteria. Ordinance 1758 §1 (part) and Section 18.66.060 of the Tukwila
Municipal Code are hereby amended as follows:
18.66.060 Criteria.
The City Council shall be guided by the following criteria in granting an unclassified use permit:
1. All facilities shall be undergrounded when possible.
2. The proposed use will not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity;
3. The proposed use shall meet or exceed the same standards for parking, landscaping, yards
and other development regulations that are required in the district it will occupy;
4. The proposed development shall be compatible generally with the surrounding land uses;
5. The proposed use shall be in keeping with the goals, objectives, and policies of the
Comprehensive Land Use Policy Plan;
6. All measures shall be taken to minimize the possible adverse impacts which the proposed use
may have on the area in which it is located;
7. For uses in residential areas demonstrate that there is no reasonable nonresidential alternative
site for the use;
8. For uses in residential areas demonstrate that the use provides some tangible benefit for the
neighborhood.
Section 3. Repealer. Ordinance 1770, §43 is hereby repealed.
Section 4. Severability. Should any section, paragraph, sentence, clause or phrase of this
ordinance, or its application to any person or circumstance, be declared unconstitutional or
otherwise invalid for any reason, or should any portion of this ordinance be pre empted by state
or federal law or regulation, such decision or pre emption shall not affect the validity of the
remaining portions of this ordinance or its application to other persons or circumstances.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force five (5) days after passage
and publication as provided by law.

DATE.
On 1/ /5 /97 the City Council of the City of Tukwila passed Ordinance
No. f t amending Title 18 of the TMC to list essential public facilities which shall be
allowed as unclassified uses, and amend the design criteria for granting an unclassified use
permit; repealing Ordinance 1770 43; providing for severability and establishing an effective
date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
