AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, AMENDING
PORTIONS OF ORDINANCE 1758, §1, TUKWILA
ZONING CODE, AS CODIFIED IN TITLE 18 OF THE
TUKWILA MUNICIPAL CODE; RELATING TO
BREW PUBS; PROVIDING FOR SEVERABILITY;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, brew pubs are becoming a more common addition to restaurants, and can be
viewed as being similar to cocktail lounges; and
WHEREAS, modern brew pubs do not emit obnoxious odors; and
WHEREAS, brew pubs must meet standards adopted by the Puget Sound Air Pollution
Control Agency for odor, dust, smoke and other airborne pollutants;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Ordinance 1758, §1, as codified at Section 18.06 of the Tukwila Municipal Code, is
hereby amended to add the following definition:
18.06.073 Brew Pub.
"Brew pub" means a restaurant -type establishment that meets the following criteria:
1. sells beer for consumption on site and sale in sealed containers;
2. restaurant portion can be no larger than 8,000 square feet;
3. produces beer in batch sizes not less than seven U.S. barrels (thirty one gallons);
4. produces no more than 2,000 barrels of beer per year;
5. the brew house is enclosed with an air treatment system;
6. revenue from food sales must comprise at least 60% of total business revenues
Section 2. Ordinance 1758, §1, as codified in Title 18 of the Tukwila Municipal Code, is
hereby amended to allow brew pubs as an outright permitted use in the following zones:

Section 3. Ordinance 1758, §1, as codified at Section 18.20.040 of the Tukwila Municipal
Code, is hereby amended to read as follows:
18.20.040 Conditional Uses.
The following uses may be allowed within the Residential Commercial Center district, subject to the
requirements, procedures, and conditions established by the Conditional Use Permits chapter of this
title.
1. Brew pubs.
2. Churches and community center buildings.
3. Convalescent, nursing and retirement homes for not more than 12 patients.
4. Fire and police stations.
5. Fraternal organizations.
6. Libraries, museums or art galleries (public).
7. Radio, television, microwave, cellular or observation stations and towers.
8. Recreation facilities (public) including, but not limited to, sports fields, community centers, and
golf courses.
9. Restaurants, including cocktail lounges in conjunction with a restaurant.
10. Schools, preschool, elementary, junior, or senior high schools (public) and equivalent private
schools.
Section 4. Severability. Should any section, paragraph, sentence, clause or phrase of this
ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise
invalid for any reason, or should any portion of this ordinance be pre empted by state or federal law
or regulation, such decision or pre emption shall not affect the validity of the remaining portions of
this ordinance or its application to other persons or circumstances.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force five (5) days after passage
and publication as provided by law.

On ij the City Council of the City of Tukwila passed Ordinance
No. /81 'mending portions of Title 18 of the TMC to add a definition for "brew pub,"
define zones in which brew pubs are an outright permitted use, and add brew pubs to the
conditional uses within the residential commercial center district; providing for severability and
establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
