Ordinance 1813 was amended or repealed by the following ordinances. mills) A fended vended by Ord # Sections Repeal pealed by Ord # 1 2461 i Q ro rsos. fTukwfla City o Washington Ordinance No. 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE 1482, AS CODIFIED AT CHAPTER 5.44 OF THE TUKWILA MUNICIPAL CODE; PROVIDING A COMPETITIVE BID PROCESS FOR CITY CONTRACTED TOW TRUCK BUSINESSES; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, in 1988 the City Council passed Ordinance 1482 which established rules and regulations for the operation of vehicle tow service in the City of Tukwila; and WHEREAS, in the spirit of competitive pricing in a free market society, it is the opinion of the City that a competitive bid for tow service will better serve our citizens; and WHEREAS, we have modeled this recommendation after successful programs in other Puget Sound municipalities; and WHEREAS, it is recommended that Section 5.44.200 of this ordinance be modified to accommodate a competitive bid process; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Ordinance 1482, as codified at Section 5.44.200 of the Tukwila Municipal Code, is hereby amended to read as follows: 5.44.200 Police requests When the owner of a motor vehicle has not requested a specific towing firm and relies upon the Police Department to call a tow service or for any other Police Department initiated tow of a vehicle, the Police Department may utilize the services of a duly licensed tow company under one or more sole provider contracts. The conditions and administrative regulations applicable to providing acceptable tow, impound, and vehicle storage service via a City tow contract shall be promulgated by the Chief of Police and approved by the Office of the Mayor. A tow company under contract with the City shall comply with the administrative regulations promulgated pursuant to RCW 56.55.240(4). The City Clerk shall facilitate advertising, a schedule, and bid opening for submitted contract bid proposals. The Chief of Police shall submit a recommendation to the Office of the Mayor for contract awarding. The Office of the Mayor shall solicit authorization from the City Council to enter into a contract for tow services with a company or companies meeting prescribed qualifications. Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law.
