WHEREAS, Ordinance 1794 was passed May 5, 1997 in an effort to restrict commercial truck parking in residential neighborhoods, and WHEREAS, the current prohibition against commercial trucks parking in residential neighborhoods has been circumvented by people parking their trucks in yards and other areas within residential neighborhoods, and WHEREAS, a revision in the commercial vehicles in residential areas ordinance is needed due to an increase in the number of commercial vehicle sizes and perceived problems with trucks and truck trailers in neighborhoods, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Ordinance No. 1794 1 (part), as codified at Tukwila Municipal Code 9.28.020, is hereby amended to read as follows: 9.28.020 Commercial vehicles in residential areas. A. Definitions. For purposes of this section: 1. Commercial vehicle means: (a) Any vehicle 8 feet or larger in width, 20 feet or longer in length, or 9 feet or taller in height, the principal use of which is the transportation of commodities, merchandise, produce, freight or animals, or (b) Bulldozers, cranes and similar construction equipment; 2. Residential area means any district which is zoned LDR, MDR, or HDR by the City. 3. Trailer means any vehicle without motive power designed for carrying persons or property within or on itself, and drawn by a vehicle with motive power. The term "trailer" includes trailer coach, tractor trailer, semi trailer or utility trailer, but does not include recreational vehicles. B. Conduct Prohibited. No person shall park a commercial vehicle or trailer in any residential area except as allowed in the following section. C. Exemptions. 1. While loading or unloading, providing that the vision of traffic is not obstructed. Further, for purposes of this section, only a reasonable amount of time shall be allowed for loading and TRUCKPKG.DOC 8128197 1 unloading, the amount of which time is to be determined according to the nature and extent of the loading and unloading operation. 2. When necessary to avoid conflict with other traffic, or in compliance with law or the direction of a peace officer or a traffic- control device. 3. In order to make non recurring, emergency repairs. 4. Commercial vehicles are allowed to park in the private driveway of the owner of such vehicle, provided that (a) No more than one commercial vehicle is allowed to be parked. (b) Commercial vehicles shall not intrude into sidewalks, ped paths, or public rights of way, and shall not obstruct sight visibility from adjacent driveways. (c) Commercial vehicles shall be maintained in a clean, well -kept state which does not detract from the appearance of the surrounding area. (d) Commercial vehicles shall not be allowed in parking lots of apartments, condominiums, or other living arrangements other than a single family home. (e) Trailers normally used as part of a tractor trailer combination shall not be allowed to park in residential zoned areas. (f) Commercial vehicles shall not be parked in residential areas except on the normal driveway of the vehicle operator's house. 5. Utility trucks owned by a public or quasi public agency when the drivers are required by their employment to engage in public works or repairs. 6. Tukwila school district buses for a period of three hours during the days and hours when pupils are in school or during special events, if they do not obstruct traffic flow or block sight distance on the road or from driveways. Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. On ,-.4/ _i 9, 7 the City Council of the City of Tukwila passed Ordinance No. /R' amending TMC 9.28.020 to further restrict commercial truck parking in residential neighborhoods; providing for severability and establishing an effective date.
