HomeMy WebLinkAboutOrd 1805 - Sexual Misconduct with Minors and Children ILA, ...........wq�y 1908 f it o Washington Ordinance No. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NOS. 1363 §1 (PART) AND 1677 X12 AS CODIFIED AT TMC 8.06.010, CRIMES RELATING TO CHILDREN AND MINORS, TO INCLUDE THE CRIME OF SEXUAL MISCONDUCT WITH A MINOR IN THE SECOND DEGREE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the State legislature recently passed RCW 9A.44.096 relating to the Crime of Sexual Misconduct with a Minor in the Second Degree; and WHEREAS, the City has experienced having a person guilty of this crime in the City, and being unable to prosecute the person under City statutes because Tukwila had not yet adopted the code; and WHEREAS, the City Council finds it advisable to amend Ordinance Nos. 1363 §1 (part) and 1677 X12 as codified in TMC 8.06.010, Conduct Prohibited, to adopt by reference the crime of Sexual Misconduct with a Minor in the Second Degree; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Conduct Prohibited. Ordinance Nos. 1363 §1 (part) and 1677 X12 as codified in TMC 8.06.010 Crimes Relating to Children and Minors, is hereby amended to read as follows: 8.06.010. Conduct Prohibited. The following statutes of the State of Washington are adopted by reference: A. RCW 9A.44.096 Sexual misconduct with a minor in the second degree. B. RCW 9.68A.110 (1) (2) (5) Certain defenses barred, permitted. C. RCW 9.68A.120 Seizure and forfeiture of property. D. RCW 9.68A.140 Definitions. E. RCW 9.68A.150 Minor Access to Erotic Materials. F. RCW 9.68A.160 Penalty. Section 2. Severability. Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be pre empted by state or federal law or regulation, such decision or pre- emption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. On 6/6 the City Council of the City of Tukwila passed Ordinance No.) g 05 adopting by reference 9A.44.096 of the Revised Code of Washington- Sexual Misconduct with a Minor in the Second Degree; providing for severability and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
