HomeMy WebLinkAboutOrd 1804 - Parking Time Limits in Designated Stalls on Municipal Properties (Repealed by Ord 1975) 1LA J i i O r 1908 Tu kwila C ity o Washington g Ordinance No. /gi!� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE 1370 §1 (PART) AS CODIFIED AT TUKWILA MUNICIPAL CODE SECTION 9.20.030, MUNICIPAL PROPERTY, PROVIDING FOR TIME LIMITS FOR PARKING IN DESIGNATED PARKING STALLS ON MUNICIPAL PROPERTIES, IN MUNICIPAL PARKS AND AT TRAILS; CREATING A NEW SECTION WHICH PROVIDES THAT THE POLICE CHIEF OR DESIGNEE MAY ENFORCE THE PROVISIONS OF AND ISSUE CITATIONS UNDER TMC 9.20.030; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Tukwila Municipal Code 9.20.030 sets forth local traffic and parking regulations for municipal property and parks; and WHEREAS, the City Council finds it advisable to amend TMC 9.20.030 to provide for a maximum parking time of six hours, or for a lesser amount of time as may be posted, in designated parking stalls for municipal parks and to provide for enforcement of such limit; and WHEREAS, the City Council finds that enforcement of TMC 9.20.030 may be greater facilitated by authorizing the Police Chief to designate individuals who can enforce the provisions of TMC 9.20.030 and issue citations thereunder; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Municipal Property. Ordinance No. 1370 §1 (part), as codified at TMC Section 9.20.030, is hereby amended to read as follows: 9.20.030 Municipal property (A) Municipal vroverty General. (1) No person shall stop, stand or park a vehicle in any garage, parking area or other property operated by the City, where signs prohibit or restrict such stopping, standing or parking without lawful authority or permission. A violation shall be deemed a parking infraction subject to abatement by issuance of an infraction notice and /or impoundment in the same manner as provided in Section 9.32.020 through 9.32.110 of the T.M.C. (2) In addition, where not specifically signed, any motor vehicle so stopped, standing or parked on municipal property for a period of 24 hours or more without authority or permission, shall be deemed a parking violation. Such violation may be summarily abated by issuing a notice of infraction and /or by impounding the vehicle in the same manner as provided in Section 9.32.020 through 9.32.110 of the T.M.C.. The impounding of such a vehicle shall not prevent or preclude the institution and prosecution of charges in the Municipal Court or elsewhere for violation of this section. PARKPARK.DOC 5115197 No person shall stand, stop or park a vehicle in any park or trail except in areas designated for such purposes. Any vehicle left in a parking stall for a municipal park or trail for a period of time exceeding the maximum amount of time permitted as posted, or if a time limit is not posted, then for a period of time exceeding twenty -four (24) hours, without lawful permission or authority shall be cited with a parking infraction and shall be subject to impound in the same manner as provided in Sections 9.32.020 through 9.32.110 of the T.M.C. Any vehicle left in a park or at a trail, and not in a parking stall, shall be cited with a parking infraction and subject to immediate impound in the same manner as provided in Section 9.32.020 through 9.32.110 of the T.M.C. Section 2. Police Chief or Designee. A new TMC Section 9.20.035 is hereby created to read as follows: 9.20.035 Police Chief or Designee For the purpose of issuing infractions under TMC 9.20.030, the Chief of Police may designate other individuals, including individuals not commissioned as police officers, to enforce 9.20.030 and to issue citations to violators as provided therein. Section 3. Severability. Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be pre empted by state or federal law or regulation, such decision or pre emption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law.
