Ordinance No. 7
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, PROHIBITING THE USE AND /OR
POSSESSION OF TOBACCO PRODUCTS BY MINORS UNDER
THE AGE OF EIGHTEEN AT PUBLIC PARKS AND
FACILITIES; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, smoking by minors under the age of eighteen years continues to be a
problem at City public parks, at the Tukwila Community Center, and at other City
facilities; and
WHEREAS, smoking has been determined by the United States Surgeon General
to be detrimental to the public health and welfare; and
WHEREAS, the City deems it appropriate to pass an ordinance furthering the
public health, safety and welfare of its citizens; and
WHEREAS, the State of Washington under RCW 70.155 provides that it does not
preempt the City from enacting its own ordinance to regulate the use of tobacco
products by minors;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. A new Tukwila Municipal Code Section 12.08.050 is hereby created to
read as follows:
12.08.050. Tobacco Use by Minors.
A. Minors under the age of eighteen are prohibited from possessing, smoking or
otherwise using tobacco products on Tukwila public park property, at the Tukwila
Community Center and the outside areas adjacent to the Center, and at other City
facilities.
B. A violation of this section is an infraction and the violator is subject to a civil
fine of up to one hundred dollars. A notice of infraction shall be issued and assessed in
the same manner as traffic infractions. The provisions contained in Chapter 46.63 RCW
for the disposition of traffic infractions apply to the disposition of infractions of this
section except as follows:
1. The provisions in Chapter 46.63 RCW relating to the provision of records
to the Department of Licensing in accordance with RCW 46.20.270 are not
applicable to this section; and
2. The provision in Chapter 46.63 RCW relating to the imposition of
sanctions against a person's driver's license or vehicle license are not applicable to
this section.

Section 2. Severability. Should any section, paragraph, sentence, clause or phrase
of this ordinance, or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be pre empted by state or federal law or regulation, such decision or pre-
emption shall not affect the validity of the remaining portions of this ordinance or its
application to other persons or circumstances.
Section 3. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City, and shall take effect and be in full force
five (5) days after passage and publication as provided by law.

On S /9. 9 the City Council of the City of Tukwila passed Ordinance
No. 7 prohibiting the use and /or posession of tobacco products by minors under
the age of eighteen years at City public parks, at the Tukwila Community Center, and at
other City facilities; providing for severability and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
