AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, DISSOLVING
THE BOARD OF ADJUSTMENT; REPEALING
ORDINANCE NOS. 860, 1593 §5, AND 1738 §2;
CREATING A NEW CHAPTER OF THE TUKWILA
MUNICIPAL CODE ESTABLISHING THE OFFICE OF
HEARING EXAMINER; AMENDING VARIOUS
ORDINANCES WHICH REFER TO THE BOARD OF
ADJUSTMENT; PROVIDING FOR SEVERABILITY;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila currently contracts with a Hearing Examiner to
preside over appeals under Tukwila Municipal Code 8.45; and
WHEREAS, the City Council finds it appropriate to utilize a Hearing Examiner for
other appeals of administrative decisions; and
WHEREAS, the City Council now desires to dissolve the Board of Adjustment and
create the Office of Hearing Examiner;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Repealer. Ordinance Nos. 860, 1593 §5, and 1738 §2, as codified at
Chapter 2.76 of the Tukwila Municipal Code, are hereby repealed.
Section 2. Hearing Examiner. A new TMC Chapter 2.76, Hearing Examiner, is
hereby created to read as follows:
2.76.010 Office of the Hearing Examiner established.
The Office of the Hearing Examiner is hereby created, and "Hearing Examiner"
shall mean any person appointed by the Mayor, and approved by the City
Council, for the purpose of presiding over appeals and other matters as
enumerated below.
2.76.020 Powers and duties Designated.
The Hearing Examiner shall have the powers and duties assigned to that office by
ordinance. In deciding any of the matters assigned to the Hearing Examiner, the
Hearing Examiner shall issue a written report citing the facts and reasons that
support the decision.
2.76.030 Action final.
The action of the Hearing Examiner shall be final and conclusive unless, within ten
days from the date of action, the original applicant or an adverse party files a
petition to the superior court.

Section 4. Severability. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of
any other section, sentence, clause or phrase of this ordinance.
Section 5. Effective Date. This ordinance or a summary thereof shall be
published in the official newspaper of the City, and shall take effect and be in full force
five (5) days after passage and publication as provided by law.

AN ORDINANCE OF THE CITY OF TUKWILA,
WASHINGTON, DISSOLVING THE BOARD OF ADJUSTMENT;
REPEALING ORDINANCE NOS. 860, 1593 §5, AND 1738 §2;

On 7"l Q.tf 997_, the City Council of the City of Tukwila passed Ordinance
No. U, dissolving the Board of Adjustment and creating the Office of Hearing
Examiner; providing for severability and establishing an effective date.

written request to the City Clerk of the City of Tukwila for a copy of the text.
