AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, ACCEPTING THE TRANSFER OF FOUR
WATER METERS SITUATED AT THREE CUSTOMER ACCOUNTS IN
FOSTORIA GARDEN TRACTS FROM KING COUNTY WATER
DISTRICT NO. 125., PROVIDING FOR SEVERABILITY AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, RCW 35.13A.050 authorizes cities and towns to accept the transfer of, and
assume the responsibility for, facilities owned by water districts whose boundaries overlap
those of the City, and
WHEREAS, King County Water District No. 125 is the owner of four three fourths inch
water meters in Fostoria Garden Tracts, and
WHEREAS, the City of Tukwila has built a parallel water system in Fostoria Garden
Tracts to serve these accounts in the future, and, due to the construction of the Macadam Road
Bridge affecting the distribution system, Water District No. 125 now requests the City to accept
the transfer of the ownership of, and assume responsibility for the maintenance of, the
aforementioned water meters and has furnished to the City a bill sale conveying said water
meter, and
WHEREAS, the City's Public Works Department has recommended to the City Council
that the water meter be accepted by the City and the City Council has determined to follow the
recommendation of the Public Works Department;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Acceptance of Transfer of ownership and Responsibility for Maintenance.
The City Council of the City of Tukwila hereby approves and accepts the transfer and
conveyance to the City of four water meters owned by King County Water District No. 125
and located at the following addresses:

4334 S. 133rd St. Two 3/4 inch meters and two services
13130 44th Ave. S. One 3/4 inch meter and service
4446 S. 131st Pl. One 3/4 inch meter and service
The City of Tukwila does hereby accept ownership of and full responsibility for
maintenance of said water meter under the same terms and conditions as the City maintains
other meters located within the City.
Section 2. Severability. If any section, sentence, clause or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.

Section 3. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force five (5) days after
passage and publication as provided by law.

WATER METERS SITUATED AT THREE CUSTOMER
ACCOUNTS IN FOSTORIA GARDEN TRACTS FROM KING
COUNTY WATER DISTRICT NO. 125., PROVIDING FOR
SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE.
On //r4 the City Council of the City of Tukwila passed Ordinance
No. /70 ac(epting the transfer of four water meters located in the City from King
County Water District No. 125 due to construction affecting the distribution system;
providing for severability and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone who submits a
written request to the City Clerk of the City of Tukwila for a copy of the text.
