HomeMy WebLinkAboutOrd 0959 - LID #24 (Local Improvement District) - Assessment Roll Levy 410 Fe CITY of TUK WASHINGTON ORDINANCE NO. 959 ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 24 WHICH HAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING SANI- TARY SEWER TRUNKS, FORCE MAINS AND A LIFT STATION AND WATER MAINS, ALL IN ACCORDANCE WITH CITY STANDARDS, WITHIN AN AREA LYING SOUTHWEST OF INTERURBAN AVENUE AND NORTHEAST OF 42ND AVENUE SOUTH AND SOUTH 135TH STREET AND NORTHWEST OF 48TH AVENUE SOUTH, PURSUANT TO THE PROPERTY OWNERS' PETITION AND CITY OF TUKWILA ORDINANCE NO. 866, AND LEVYING AND ASSESSING A PORTION OF THE COST OF SAID IMPROVEMENTS AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY SHOWN ON THE ROLL AND PROVIDING FOR PAYMENT BY THE CITY OF TUKWILA OF THE REMAINING PORTION OF THE COST OF SAID IMPROVEMENTS. WHEREAS, The assessment roll levying the special assess- ments against properties located in Local Improvement District No. 24 in the City of Tukwila, Washington, created by City of Tukwila Ordinance No. 868, has been filed with the Clerk of the City of Tukwila, Washington, as provided by law, and WHEREAS, The assessment roll provides that the City of Tukwila shall pay a portion of the cost of the trunk sewer assess- ment and a portion of the cost of the trunk water assessment for the reason that these trunk installations have been constructed larger in size than necessary to serve the properties located within LID No. 24, to thus provide capacity for future expansion, which said additional cost should be paid by the City of Tukwila, as re- flected on the final assessment roll, and WHEREAS, Notice of the time and place of hearing thereon and of making objections and protests to said roll was duly pub- lished at and for the time and in the manner provided by law, fix- ing the hour of hearing thereon for the 15th day of December, 1975, at the hour of 8:00 P.M., Pacific Standard Time, in the council chambers of the City Hall in the City of Tukwila, Washington, and further notice thereof was duly mailed on %?2tWt 1975, -1- to each property owner shown on said roll and said mailing having been made at the direction of the City Clerk by Wilsey Ham, Inc., engineers for said project; and WHEREAS, At the time and place fixed and designated in said notice, the hearing was duly held and all written protests received were duly considered and all persons appearing at said hearing were heard and written protests or requests for changes of assessments having been received aJ1 the City Council having over- ruled all written protests and denied all requests for changes of assessments on said assessment roll, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS FOLLOWS: Section 1. The assessments and assessment roll of Local Improvement District No. 24, which has been created and established for the purpose of installing sanitary sewer trunks, force mains, lift station and water main, all in accordance with City standards within an area lying Southwest of Interurban Avenue and Northeast of 42nd Avenue South and South of 137th Street and Northwest of 48th Avenue South, pursuant to the property owners' petition as provided by Ordinance No. 867, be and the same are hereby in all things and respects approved and confirmed in the total sum of $282,070.07. Section 2. Each of the lots, tracts, parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefitted by said improvement in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll, the amount finally charged against the same thereon. As indicated in the final assessment roll, the City of Tukwila shall pay a portion of the total trunk sewer assessment and a portion of the trunk water assessment, the City's share of the trunk sewer assessment being $50,057.19 and the City's share of the trunk water assessment the rate of being $20,938.17. Section 3. The assessment roll, as approved and con- firmed, shall be filed with the Treasurer of the City of Tukwila for collection and said City Treasurer is hereby authorized and directed to publish notice as required by law, stating that said roll is in her hands for collection and payment of any assessment thereon and that payment of any portion of said assessment may be made at any time within thirty days from the date of the first publication of said notice, without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon hereby fixed at per cent per annum. The first installment of assessments on said assessment roll shall become due and payable during the thirty -day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for collection, and annually thereafter each succeeding installment shall become due and pay- able in like manner. If any portion of the assessment remains unpaid after the first 30 -day period, interest upon the whole un- paid sum shall be charged at the rate of annum and each year thereafter one of said installments, together with interest due on the whole unpaid balance, shall be collected. Any installment not paid prior to the expiration of the said 30 -day period during which said installment is due and payable, shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at O 0 per cent per per cent per annum and for an additional charge of five per cent penalty levied upon both principal and interest due upon such installment or installments. The collection of such delinquent installments will be enforced in the manner provided by law.
