HomeMy WebLinkAboutOrd 1992 - Amend 1995 Comprehensive Land Use Plan - Zoning on LDR to C/LI at InterurbanCity of Tukwila Washington Ordinance No. / 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING THE CITY'S 1995 COMPREHENSIVE LAND USE PLAN AS ADOPTED BY ORDINANCE NO. 1757, TO CHANGE THE ZONING ON THE MAP FROM LDR TO C/LI AT INTERURBAN AVENUE AND SOUTH 139TH, AND TO ADOPT CERTAIN TRANSIT - RELATED POLICIES; PROVIDING FOR SEVERABLITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Tukwila's Comprehensive Plan and development regulations are to be reviewed and updated as appropriate; and WHEREAS, the City of Tukwila Planning Commission, after having received and studied staff analysis and comments from members of the public, has recommended the adoption of certain amendments; and WHEREAS, the City Council provided notice and opportunities for public comment as noted below: 1. After due public notice, the City Council held a public meeting on March 18, 2002 to receive public comments, and a public hearing on August 5, 2002 to receive public testimony related to amendments to the Comprehensive Plan and Zoning Code; 2. Notice of the public meeting was published and mailed in the Hazelnut; notices of the public meeting and hearing were mailed to surrounding residents, businesses and owners; the site was posted; notice of the public hearing was posted at Tukwila City Hall and was published in the Seattle Times; and WHEREAS, future expansion may be required at the City's maintenance facilities; and WHEREAS, it is desirable to develop transit- oriented land uses in the vicinity of transit; and WHEREAS, spillover parking has been a problem adjacent to certain transit facilities; and WHEREAS, the City Council, after due consideration, believes that certain amendments to the City's Comprehensive Plan and development regulations are necessary; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amend the Tukwila 1995 Comprehensive Plan Land Use map to designate parcel #00028000006, generally located along Interurban Avenue between South 139th Street and South 140th Street, as Commercial/ Light Industrial, rather than Low - Density Residential (see Exhibits 1 and 2). Amended Land Use 8 /16 /02.doc Section 2. Amend the Zoning Map to designate parcel #00028000006, generally located along Interurban Avenue between South 139th Street and South 140th Street, as Commercial /Light Industrial, rather than Low - Density Residential (see Exhibits 1 and 2). Section 3. Amend the Zoning Map to remove the Public Recreation Overlay from parcel #00028000006, generally located along Interurban Avenue between South 139th Street and South 140th Street. (see Exhibits 3 and 4). Section 4. Amend Goal 13.4 Public Transportation, Transit, Rideshare, and Personal Rapid Transit, of the Tukwila 1995 Comprehensive Plan Transportation Chapter, as adopted by Ordinance No. 1757, to add the following policy: Policy 13.4.14: Encourage transit- oriented uses and development patterns in the vicinity of high capacity transit stations. Section 5. Amend Goal 13.4 Public Transportation, Transit, Rideshare, and Personal Rapid Transit, of the Tukwila 1995 Comprehensive Plan Transportation Chapter, as adopted by Ordinance No. 1757, to add the following policy: Policy 13.4.15: Require that parking facilities developed in conjunction with transit facilities be adequately sized and managed to prevent spillover parking onto private property. Section 6. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 7. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. On August 19, 2002, the City Council of the City of Tukwila passed Ordinance No.1992, amending the City's 1995 Comprehensive Plan and changing the zoning at Interurban Avenue and S. 139th Street from LDR to C /LI; and amending Comprehensive Plan Policy No. 13.4 to encourage transit - oriented uses and development patterns in the vicinity of high capacity transit stations; providing for severability; and establishing an effective date. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
