AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, ESTABLISHING A
UTILITY TAX ANNUAL REBATE PROGRAM FOR
SENIOR AND DISABLED LOW INCOME RESIDENTS;
PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Tukwila City Council passed Ordinance No. /V 5 1 establishing a
utility tax to provide revenue for City services and capital facilities; and
WHEREAS, Section 15 of said utility tax ordinance provides that a utility tax
annual rebate program will be developed for the City's senior or disabled low- income
residents; and
WHEREAS, the City Council desires to establish a utility tax annual rebate
program and the low income criteria and application procedures;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Utility tax annual rebate program established. A utility tax annual
rebate program is established for senior and disabled low- income residents in accordance
with the eligibility criteria and guidelines described in this ordinance. The first period
covered under this program is February 1, 2003 December 31, 2003, and then every
calendar year thereafter.
Section 2. Utility tax annual rebate for electricity and gas services. For electricity
and natural gas services, eligible Tukwila households may apply annually to receive a
utility tax rebate.
To qualify for utility tax annual rebate from electric and gas services, a household must:
A. Be a household residing in Tukwila.
B. Every person 62 years of age or older (if married, then either spouse) or
every person totally and permanently disabled residing in a separately metered dwelling
and who is paying directly for such separately billed service either as owner, purchaser or
renter and whose individual disposable income if a single person, or whose combined
disposable income (as defined in RCW 84.36.383), if a married couple, from all sources is
less than $32,000 per year, shall receive an annual utility tax rebate on their electric and
natural gas energy bills. Every such person shall file with the Finance Department their
affidavit that he or she is qualified to receive the rebate. Such affidavits are to contain
information as required by the Finance Director in order to establish eligibility. Each
affidavit will also include an unqualified promise to inform the City of any changes in
financial condition that would disqualify the person for the rebate. The Finance Director
may require affidavits on an annual basis if deemed necessary.
C. The Finance Director shall adopt rules and procedures for the filing of
reimbursement claims, and for the administration of the utility tax annual rebate
program.
Utility Tax Relief -1
Section 3. Severability. Should any section, paragraph, sentence, clause or phrase
of this ordinance, or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be pre empted by state or federal law or regulation, such decision or pre-
emption shall not affect the validity of the remaining portions of this ordinance or its
application to other households or circumstances.
Section 4. Effective Date. This ordinance shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after the date of
publication.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, ESTABLISHING A UTILITY TAX
ANNUAL REBATE PROGRAM FOR SENIOR AND DISABLED
LOW INCOME RESIDENTS; PROVIDING FOR SEVERABILITY'
AND ESTABLISHING AN EFFECTIVE DATE.
On November 18, 2002, the City Council of the City of Tukwila passed
Ordinance No.1999, which established an annual rebate program on electricity
and natural gas services for senior or disabled low- income residents; providing
for severability; and establishing an effective date.
The full text of this ordinance will be mailed without charge to anyone
who submits a written request to the City Clerk of the City of Tukwila for a
copy of the text.
