WHEREAS, the City of Tukwila City Council conducted a public hearing on July 19, 1999 and August 16, 1999 for the purpose of considering the vacation of certain property located in the City of Tukwila, as described above; and WHEREAS, TMC 11.60 identifies street vacation procedures including a public hearing by resolution; review and comment by the Departments of Community Development and Public Works; and, forwarding all relevant information to City Council, all of which have been done; and WHEREAS, water, electrical and communication utilities exist within the right -of -way which is being vacated; and WHEREAS, the City has identified the need for South 158 Street to be relocated and kept open as a public through street; and WHEREAS, TMC 11.60 requires an appraisal to determine the fair market value of the right -of -way to be vacated and the City is due compensation in an amount equal to one -half of the fair market value; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Vacation. The following property located in the City of Tukwila is hereby vacated: South 158th Street from Military Road to approximately 675 feet easterly and Military Road from South 158 Street to approximately 125 feet southerly, and more particularly shown on Exhibit A, attached hereto. Section 2. Utilities. The existing utilities shall be relocated or retained in place in an easement to the mutual satisfaction of the City and the respective utility. Section 3. Street Relocation. The petitioner, Sterling Realty Organization, shall design and construct the relocation of South 158 Street to meet City of Tukwila standards. Right -of- way for the relocated street shall be dedicated by statutory warranty deed. Sterling Realty Organization shall meet with the property owners and residents on South 158 Street and Military Road to review and gain consensus for the relocated street design including adequate setbacks for residential properties, adequate landscape buffers, and maintenance. Section 4. Compensation. An independent appraisal shall be performed to determine the fair market value of the right -of -way to be vacated. The City shall be compensated one half the fair market value. STV- So158th 9/9/99 Section 5. Permit Applications. The petitioner, Sterling Realty Organization, shall not proceed with any permit applications or materials regarding the proposed development of property adjoining South 158 Street prior to determination by the Public Works Director that the conditions referenced above have been satisfied. Section 6. Duties of City Clerk. The City Clerk is hereby directed to record a certified copy of this ordinance with King County, upon determination by the City Public Works Director that the conditions referenced above have been satisfied. Section 7. Amendment of Official Street Map. Upon the recording of a certified copy of the ordinance, the City Public Works Director shall amend the City's official street map to be consistent with this ordinance. Section 8. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 9. Effective Date. This ordinance shall take effect five (5) days after passage and publication as provided by law; Provided that the vacation specified above shall not become effective until the conditions contained herein have been fully satisfied. On A 9, /9” the City Council of the City of Tukwila passed Ordinance No. /i 7K vacating South 158 Street from Military Road to approximately 675 feet easterly and Military Road from South 158 street to approximately 125 feet southerly, located in the City of Tukwila; with existing utilities to be relocated or retained in place in an easement, and including design and construction for relocation of South 158 Street; providing for severability and establishing an effective date.
