Foster Clubhouse Update TUKWILA CITY COUNCIL February 3, 2003 7:00 p.m. Council Chambers City Hall REGULAR MEETING MINUTES Mayor Steve Mullet called the Regular Meeting to order at 7:00 p.m. and led the audience in the Pledge of Allegiance. Council President Pam Carter; and Councilmembers Joe Duffie, Joan Hernandez, Jim Haggerton, Pamela Linder, Dave Fenton and Richard Simpson. John McFarland, City Administrator; Rhonda Berry, Assistant City Administrator; Bob Noe, City Attorney; Jane Cantu, City Clerk; Lucy Lauterbach, Council Analyst; Jim Morrow, Public Works Director; Bob Baker, Deputy City Clerk; Alan Doerschel, Finance Director; Tom Keefe, Outgoing Fire Chief; Nick Olivas, Incoming Fire Chief; Bruce Fletcher, Director of Parks and Recreation; Rick Still, Assistant Director of Parks and Recreation and Marty O'Brien, Golf Maintenance Supervisor. a. Honoring Tom Keefe upon his retirement as Chief of Tukwila Fire Department Presentation of a Plaque and Proclamation Mayor Mullet read from the document proclaiming "...sincere appreciation to Chief Thomas P. Keefe, for 15 years of dedicated and honorable service to the City of Tukwila..." and wished him well in his future endeavors. Next, Mayor Mullet provided Chief Keefe with a plaque containing a key to the City "...in recognition of 15 years of dedicated service as Chief to the Tukwila Fire Department..." Councilmembers each gave Chief Keefe their best wishes and expressed appreciation for the tireless efforts personally and professionally by the Chief. Chief Keefe reported it had been an interesting and challenging 15 years. He also stated he was glad he "did it" but wouldn't do it again. Additionally, the outgoing Chief stated their home in Mesquite, Nevada. "closed" on January 31, 2003, and they intend to move by April 1, 2003. The Keefes plan to open their own flower shop by the first of October, 2003. b. Oath of Office Administered to Nick Olivas, Incoming Fire Chief Mayor Mullet administered the Oath of Office to incoming Tukwila Fire Chief, Nick Olivas. Chief Olivas reported learning a great deal from Chief Keefe and described him as a "good leader mentor and friend. He stated it pays to listen and to pay attention. He is very much looking forward to working with his "outstanding" and "dedicated" crews in his new position. Bruce Fletcher, Parks Recreation Director, provided Council with the history of the Foster Clubhouse project. He reported bidding, demolition and construction phases are "just around the corner." City of Tukwila Page 2 of 5 Regular Meeting February 3, 2003 Rick Still, Assistant Parks Recreation Director, called the project at hand "complex He related they will save the Foster Tree by installing a protective fence this week. In addition to the current clubhouse, there are 5 buildings to be demolished. Grading and tree removal bids should be received within a week. Building permits are currently being sought. An extensive peer review of the new clubhouse building design has been conducted and the architect has made some minor changes. The City will now seek permits for building the new facility. Building of the clubhouse should be completed in January 2004 and if all goes as planned, the concessionaire will be approximately two months behind. Marty O'Brien, Golf Maintenance Supervisor, provided an overview of the anticipated renovations to Foster Golf Links greens and tees. Mr. O'Brien shared a conceptual drawing of the renovations with Council and explained how the course would operate in its temporary condition. In addition to a new first tee and fairway shaping, a new green, bunker and fairway shaping will occur on the 2nd hole. There will be a new green and three bunkers on the 8 hole and a new fairway, green and bunker on the 9 hole. A new putting green and water feature will be added, too. A practice green (learning center) will be added indoors (near the new Pro Shop). Golf professionals will be brought in to teach hitting techniques. During the renovations, the 1S 2 and 9 holes and 8 green will be closed. Staff's intent is to maintain an equitable income during the renovation process and golfers will thus be invited to play the "back nine" as a nine -hole course, played twice, for an 18 -hole game. Holes 3 through 8 will be played as a 6 -hole Executive course. Some lower and /or special fees will be drafted and presented to Council. For further consideration /discussion, this item will be presented at the February 11 Community Affairs and Parks Committee meeting. CITIZEN COMMENT /CORRESPONDENCE: None. The motion carried 7 -0. OLD BUSINESS: An ordinance amending TMC 2.68.027 re: Removal of Municipal Court Judge AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1324 PART 16, CODIFIED AS TUKWILA MUNICIPAL CODE 2.68.027, "REMOVAL OF JUDGE PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE DUFFIE MOVED; FENTON SECONDED; READING OF THE PROPOSED ORDINANCE BY TITLE ONLY. The motion carried 7 -0. Bob Noe, City Attorney, read the title of the proposed ordinance. FENTON MOVED; DUFFIE SECONDED; ADOPTION OF THE PROPOSED ORDINANCE AS READ. The motion carried 7 -0. APPROVED ORDINANCE #2013 NEW BUSINESS: Briefing on Streamlined Sales Tax Alan Doerschel Finance Director Alan Doerschel, Finance Director, informed Council of a legislative effort by the Washington State Department of Revenue (along with a core group of 25 other states) to alter the sales tax rules to bring continuity among all states in how sales tax is collected. This presumably would provide a uniform method to tax E- Commerce sometime in the future. Of great concern is that portion of the proposal to change to a "point of sale" formula. Currently, goods are taxed where the consumer picks them up, or taxed from the site that delivers the goods to the customer. The proposal will tax goods where they are delivered (customer's location and city). This would have serious consequences for Tukwila and several nearby cities. In Tukwila, over 200 businesses ship goods to customers. Alan Doerschel, Finance Director, reported attendance to a January 31 meeting, in Kent, with John McFarland, City Administrator, and Lily Jue, Internal Auditor. Approximately 15 to 20 persons were present at the meeting six or seven being from cities which would feel the negative impact of this legislation. The City of Kent has hired a consultant to review the item. That consultant has predicted a loss of $3.8 million for its own City; and an approximate $3 million loss in the City of Tukwila. The State Department of Revenue is also doing a survey to determine such impacts to cities. A year -long study of the legislation is being recommended. It appears that perhaps 10 to 12 other cities will be impacted. According to current calculations, Tukwila will be the #2 city negatively impacted with this point of sale formula. There would be no relief from this impact. Councilmembers and staff discussed this item at length. Dennis Robertson, Tukwila, asked if a new B and 0 Tax or Head Tax would have to be considered if this legislation is carried out. Mr. Doerschel responded to this and several other Council inquiries. While not knowing what could happen, several recommendations resulted from the January 31 meeting mentioned earlier. First, it was recommended to form a small group of constituents from AWC, five or six of the cities, and a lobbyist and /or attorney, to understand the issues better and be involved with the Department of Revenue in their one -year study. Secondly, it is recommended that all cities contact their representatives and "get them on our side" in terms of stopping this proposed legislation if there is to be no relief to the cities. Councilmembers headed to Washington D.C., for the upcoming NLC Conference, are encouraged to contact legislators to discuss the item and urge its end. Council President Carter asked for a talking points paper on this item. City of Tukwila Page 4 of 5 Regular Meeting February 3, 2003 REPORTS: a. Mayor Mayor Mullet reported opening of an estuary habitat restoration site for juvenile salmon at Cecil B. Moses Park on January 30, 2003. It is now connected to the river and a system of wires and fences have been installed to protect new planting of grasses. Juvenile salmon need more habitat area in this portion of the river to grow and transition to saltwater prior to migration to the Sound /Ocean. There is a February 4 Tukwila Government Affairs luncheon at the Chamber of Commerce; a Lodging Tax Advisory Board meeting on February 6; an SCA Management Board meeting also on the 6 an Audit Entrance Conference on February 4 and a Department Head /Staff Retreat on February 7 at the Museum of Flight. There is an Equity Diversity Commission meeting on February 5 and a Highway 99 Action Committee meeting on February 11. Mayor Mullet reported Police Officer Keith King may be called up and could be gone for as long as one year. Roy Steinauer and James Sturgill are slated to graduate from the Police Academy on February 4. John McFarland and Mayor Mullet reported a probable resolution which would allow continued medical coverage to family members of those men and women called up to serve in the armed forces. Mayor Mullet attended a family reunion the weekend of February 1, wherein he also learned he had become a grandfather for the third time. b. City Council Councilmember Duffle attended this evening's Finance Safety Committee. Councilmember Hernandez attended the January 31 reception for outgoing Fire Chief Tom Keefe and the Sister City- sponsored spaghetti dinner on the same evening. She will attend the February 6 Equity Diversity Commission dinner. Council President Carter attended the January 30 Northwest Area Foundation meeting with Councilmember Simpson and Evelyn Boykan, Human Services Manager. Ms. Carter reported receipt of information on a free conference /workshop on "Telling Your Story." The presenter is Arch Lustberg, an expert in the area of communications. Councilmember Haggerton attended a January 29 Cascade Water Alliance Board meeting; a January 31 ACC Budget meeting and subsequent reception for Fire Chief Tom Keefe. Mr. Haggerton also attended this evenings' Finance and Safety Committee meeting. Councilmember Linder reported a potential scheduling problem for the February Duwamish /Allentown Community meeting. March may also pose a conflict. Along with Rhonda Berry and others, Ms. Linder will continue to work on finding dates and times for the meetings as discussed at Council Retreat. Councilmember Fenton attended a January 29 Anti Auto -Theft Group meeting. Councilmember Simpson attended the January 30 Northwest Area Foundation meeting with Council President Carter and Evelyn Boykan, Human Services Manager. Additionally, he attended this evening's Finance and Safety Committee meeting. c. Staff John McFarland had no report. City of Tukwila Page 5 of 5 Regular Meeting February 3, 2003 d.
