A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, REJECTING THE BID SUBMITTED BY CDK
CONSTRUCTION SERVICES, INC., FOR THE FOSTER GOLF LINKS
CONSTRUCTION PROJECT, AND AWARDING THE BID TO WADE
PERROW CONSTRUCTION, LLC IN THE AMOUNT OF $3,044,768.00.
WHEREAS, sealed bids were received for the Foster Golf Links Clubhouse Project, and
WHEREAS, bids were opened and read aloud by the City Clerk's Office on April 21,
2003, and the apparent low bidder was CDK Construction Services, Inc. of Duvall,
Washington "CDK whose proposal was in the amount of $2,718,000 00 before taxes, and
WHEREAS, upon examination and inquiry by City staff of the CDK bid documents, a
mispresentation of fact was discovered on the face of the bid documents. The City of
Tukwila has determined that the mispresentation was material, and
WHEREAS, a material mispresentation of fact within CDK's bid documents makes
CDK's bid unreliable, and as unreliable bids must be rejected in the public's interest, CDK's
bid must therefore be rejected as not responsible or responsive as required by the
provisions of the "Foster Golf Links Project Manual," and
WHEREAS, Wade Perrow Construction, LLC., of Gig Harbor, Washington ("Wade
Perrow"), made the next lowest bid of $2,798,500 00 before taxes, and
WHEREAS, upon examination and inquiry by City staff, the City of Tukwila
determined that the Wade Perrow bid is responsive,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS.
Section 1. The above "whereas" recitals are herein adopted as findings of fact.
Section 2. The bid submitted by CDK Construction Services, Inc. bid for the Foster
Golf Links Clubhouse Project is not reliable due to a material misrepresentation of fact, and
is hereby rejected as not responsible or responsive.
Section 3 Wade Perrow Construction, LLC., is determined to be the lowest responsive
bidder with a bid of $2,798,500 00 before taxes
Section 4. The Mayor is hereby authorized to sign a contract with Wade Perrow
Construction, LLC., of Gig Harbor, Washington for the Foster Golf Links Clubhouse Project
in the amount of $3,044,768 00, which represents the bid of $2,798,500 00 plus Washington
State Sales Tax.
