MINUTES
CALL TO ORDER:
Calling the meeting to order at 8:20 p.m. was Steven M. Mullet, Mayor.
ROLL CALL:
Calling the roll of Council was Bob Baker, Deputy City Clerk. Present were Council President Pam Carter;
and Councilmembers Joe Duffle, Joan Hernandez; Jim Haggerton; Pamela Linder, Dave Fenton and
Richard Simpson.
Steven M. Mullet, Mayor; Rhonda Berry, Acting City Administrator; Lucy Lauterbach, Legislative Analyst;
Bruce Fletcher, Director, Parks and Recreation; Rick Still, Assistant Director, Parks and Recreation; Mike
Sweeney, Owner's Representative; and Bob Baker, Deputy City Clerk.
CONSENT AGENDA
Approval of Minutes June 2. 2003 Reaular Meetina
DUFFIE MOVED; HERNANDEZ SECONDED; TO APPROVE THE CONSENT AGENDA (MINUTES)
AS PRESENTED. The motion carried 7 -0.
BID AWARD:
Award a contract to Dupont Flooring Systems in the amount of $91,875.67. including Washinaton
State Sales Tax (WSST), for the Tukwila Community Center Carpet Replacement Proiect
FENTON MOVED; HERNANDEZ SECONDED; TO AWARD A CONTRACT TO DUPONT FLOORING
SYSTEMS IN THE AMOUNT OF $91,875.67, INCLUDING WASHINGTON STATE SALES TAX,
FOR THE TUKWILA COMMUNITY CENTER CARPET REPLACEMENT PROJECT.*
Discussion In response to an inquiry from Councilmember Hernandez, Alan Doerschel, Finance Director,
explained no other bids were received as the City has a State contract for all carpet purchases and
installation. The (303) facilities list called for replacing the carpet in 2002. The install is complete and
any subsequent punch list items have now been performed.
*The motion to award the contract carried 7 -0.
NEW BUSINESS:
a. Accept as complete the Tukwila Community Center Carpet Replacement Proiect, with
Dupont Floorina Systems (Final Cost: 191,875.67. includina WSST)
DUFFIE MOVED; CARTER SECONDED; TO ACCEPT AS COMPLETE THE TUKWILA COMMUNITY
CENTER CARPET REPLACEMENT PROJECT, WITH DUPONT FLOORING SYSTEMS, IN THE
AMOUNT OF $91,875.67, INCLUDING WASHINGTON STATE SALES TAX. The motion carried 7 -0.

b. Discussion and possible action, including possible resolution for the award of Foster Golf
Links Clubhouse Construction Proiect contract
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, REJECTING THE BID SUBMITTED BY CDK CONSTRUCTION
SERVICES, INC., FOR THE FOSTER GOLF LINKS CONSTRUCTION PROJECT; AND
AWARDING THE BID TO WADE PERROW CONSTRUCTION, LLC, IN THE AMOUNT
OF $3,044,768.00
HERNANDEZ MOVED; DUFFIE SECONDED; TO HAVE THE PROPOSED RESOLUTION READ IN
ITS ENTIRETY. The motion carried 7 -0.
Rhonda Berry, Acting City Administrator, read the proposed resolution in its entirety.
HERNANDEZ MOVED; FENTON SECONDED; TO ACCEPT THE RESOLUTION AS READ.*
Discussion Councilmember Duffie asked Mike Sweeney, Owner's Representative, to explain the reason
behind the resolution.
Mr. Sweeney reported that bids for this project were read on May 21, 2003. The apparent low bidder
was CDK Construction Services, Inc. Upon examination and inquiry by City staff (due diligence) of CDK
bid documents, a misrepresentation of fact was discovered. City staff concluded that misrepresentation
to be material, making the bid documents unreliable, non responsible and non responsive in the public's
best interests.
The resolution awards the bid to the next lowest responsive bidder, Wade Perrow Construction, LLC, in
the amount of $2,798,500.00, plus Washington State Sales Tax, creating a total of $3,044.768.00.
*The motion to accept the resolution, as read, carried 7 -0.
