PIsn AmendmP„ h dist ibuted 3/03) Deparu~ent of Community Development Steve Lancaster, Director MEMORANDUM August 19, 2003 ~ . /-'- TO: Tukwila City Council FROM: Steve Lancaster, Department of Community Development SUBJECT: ANNUAL COMPREHENSIVE PLAN AMENDMENTS FOR 2003 Background Three proposed Comprehensive Plan and Zoning Code amendments were submitted for consideration in the 2003-2003 annual amendment process. The City Council held a public meeting on the amendments on March 17, 2003 and forwarded them to the Planning Commission for consideration. The Planning Commission held a public hearing on the amendments on June 26, 2003. One amendment was carried over to July 24, 2003, and considered at that time. The Community Affairs and Parks Committee discussed the amendments on 8/12/03 and forwarded the amendments to the City Council for a briefing and public hearing. The requested amendments and the Planning Commission recommendations are the following: 1. L02-062 Comprehensive Plan amendment--Office in MIC/H £02-063 Zoning Code Amendment--Of~ce in MIC/H Request: The Council asked staff to study the changing shape of industry, the viability of industrial retention and the market for office uses in the MIC/H area to decide whether office should be allowed as a stand-alone use in the MIC/H zone. Plannin~ Commission Recommendation: Planning Commission recommended the following: Allow new office developments in the MIC/H zone as Conditional Uses and subject to the following restrictions: a) The maximum size of new office developments shall not exceed 100,000 Square feet of gross floor area per lot that was legally established priofto mm/dd/yy (the effective date of the adoption of the ordinance). b) No new offices shall be allowed on lots that abut the Duwamish River and North of the turning basin. Based on the direction by the Planning Commission, staff has prepared the attached draft ordinance for the City Council's consideration. II. L02-064 Comprehensive Plan amendment--Revise Sensitive Areas policies L02-064 Zoning Code amendment--Revise Sensitive Areas policies Request: Approve "plaeeholder" amendment for Comprehensive Plan and Zoning Code to include "best available science," other issues per State of Washington Growth Management Act requirements. Planning Commission recommendation: Defer consideration until 2003-2004 Growth Management Act update III. L02-067 Rezone LDR to 0 (Barghausen/Robb) L02-068 Comprehensive Plan amendment LDR to 0 (Barghausen/Robb) Request: Approve rezone/Comprehensive Plan change at 6550 and 6542 Southcenter Boulevard from Low Density Residential (LDR) to Office (O) Planning Commission recommendation: Deny request. Applicant may reapply for consideration if access and encroachment issues are resolved before 12/31/03. Next steps: The amendments will return before the City Council for a final public hearing on September 2, 2003. After the hearing, the City Council will make their decision. At that point, the City Council may: · Adopt an amendment as recommended by the Planning Commission; · Adopt a modified version of an amendment; or · Reject the amendment. Comp Plan Amendments The Council held a public hearing on three proposed comp plan amendments last March. The issues then went to the Planning Commission, which held a public hearing on them. The first issue regards possible office zoning for the Heavy Manufacturing and Industrial zone (MIC/H) in the north of the Ci~,. The ECO Northwest report had looked at this issue of saving industrial land or using it for more readily available commercial uses such as office. They concluded it is uncertain what future industrial uses will need the land, but that it is increasingly rare, and Tukwila's position close to Seattle and the ports makes it valuable as industrial land. Shaunta said Boeing owns land north of the tuming basin, which is at about 103rd Street. The Planning Commission recommended that land on the river north of the turning basin not allow stand-alone offices, as industrial uses there could ship industrial products out on the river. Shaunta expressed concern that Boeing's offices could become non-conforming, as they are on the river north of S. 103~a. She asked that the entire MIC/H area be allowed to have conditional use offices. Though they only own 2% of the lots, Boeing owns 25% of the land area in that north area. They would lose flexibility if their offices attached to manufacturing buildings on the river could not be stand-alone offices. In talking about what kinds of future uses could need MIC/H land, Steve said computer companies which have big generators make a lot of noise, and could be sited in industrially zoned land. The second amendment was a placeholder in case the City had time to do an update to the Sensitive Areas Ordinance, but the update won't be done this year, so the issue can be deferred to 2004. The third amendment was a request for a rezone of the area just east of City Hall at the T-line bridge. The owners have requested rezoning from low density residential to office zoning. The committee talked about access to the properties, and agreed with staff that it was too difficult to allow more than residential use until better access can be obtained. Recommend amendments to COW. 2. Second Quarter Reports The Committee asked about Cascade Park's schedule. Brace said it should be seeded this month. Public Works will put sidewalks in on the half-street on 37th this month also. Also, the house at the northwest comer has been purchased and will be demolished. On Codiga Farm, the Army Corps is going through some changes in their Chief Administrator, which could be why park development is going slowly with them. They claim the bank is too steep for a boat ramp. The barn has been taken down. The issue of using people convicted of non-violent crimes, to work out their fines by picking up trash and other community service work is being pursued by Judge Walden through using King County to supervise. On Community Development, the committee asked about code enforcement. Steve said there are some culture clashes in Tukwila between those who've lived a certain more rural way for a long time who are willing to put up with some junk cars or other code enforcement issues, and others who like yards and houses neat, clean, and trim. The City walks a fine line, trying to address the more flagrant violations, but not all the smaller minor violations. Joe heard reports from the community that one car that has been repeatedly tagged for too-long parking violations merely erases the police messages on his window each time he gets them. Joan asked about development below Fosterview, and was told it is an 8-9 home short plat. Finally, Steve reported that Sound Transit may be locating its track through some of the property east of S. 51st at I-5. BACKGROUND Project grant applications to be considered for Transportation Improvement Board (Tilt) funding are due August 29, 2003. ACTION TAKEN Public Works staff met with Tilt staff to review and discuss potential project applications. The following four projects were discussed. Table is listed in 000's. Transportation Committee August 11, 2003 Present: Richard Simpson, Chair; Dave Fenton, Pam Linder Jim Morrow, Brian Shelton, Pat Brodin, Gall Labanara, Cyndy Knighton, Sue Byers of KPG Engineering, and Dennis Robertson 1. South 144th Street Proiect Update The design °f this Pr°ject was put °n h°ld while Cascade View -- Community Park and street improvements were being completed. S 144th Project is now back on track with Phase I (TIB to Military) slated for construction in 2004. The design contract with KPG also includes a design repor~ for Phase II (TIB to 42"d). A State TIB grant was obtained for $1,016,000. Cyndy went over the entire street design and explained how S 144th St is a high use pedestrian corridor that must coexist with significant traffic volumes. Traffic calming will be included and there will be a transition with the Tukwila Int'l Blvd improvements. Both sides of the street will have 6 to l0 ft. sidewalks as well as 5-ft. bike lanes. There was discussion on the pedestrian flow at Larry's and True Value and the need for a crossing and some changes in the respective driveways. Metro has approved th~ in-lane bus stop and it will have the same theme as TIB. The trash pickup at the bus shelter is of concern and Jim said he would work with our staff or Rabanco for trash pickup. Dave asked about ROW and there are still strips of land that we will need to purchase to complete the project. Richard also spoke of looking into a flashing signal at the 37th Ave intersection due to a blind spot. A public meeting is tentatively scheduled for the week of September 15 and Dave Fenton offered the use of a meeting room at Samara. Information. 2. Transportation Improvement Board Grant Applications Jim explained that grant applications are due 8/29/03 and he wanted approval before moving forward. Four projects are slated for potential yet only three are recommended. TIB Phase Eli is the last gap to complete from S 132nd to S 138t~ and the Board suggested that we should leave the phases as is to insure greater success. No. 3 includes the traffic signals in the CBD and No. 4 is Phase II orS 144t~ St (TIB to 42"d) and both are suggested for submittal. No. 2 is S/C pkwy and there are many decisions and cost estimates that need to be finalized before submittal. Para would like a cost range of the three submittals to get an estimate of the City funds needed for the budget. Dave also mentioned connectivity in the CBD and Sim assured him that any improvements now include adding conduit. To COW with addRional cost estimates. 3. Grant Successes PWTF has tentatively assured us of the receipt of loans for the Cascade View Drainage Project and AllentowrdFoster Pt Phase II Sewer Project for a total of $10 million. The official list will be posted 8/19/03. Also received $3.3 million from WSDOT for TIB Phase III construction and Puget Sound Regional Council (PRSC) approved $615,800 for TIB Phase II construction. Miscellaneous ~ Cascade Glen Pam reported that there are dead trees along 40th Ave S and wanted to make sure that they are replaced. Jim said that there is a two-year maintenance bond that will take care of these things. ~' 1-405 Tukwila Urban Center Received a new map that identifies all of the connections and improvements that are needed in the agreement between WSDOT and Tukwila for the 1-405 corridor. Public Works This City's sewer rate was last increased in 1996 under Ordinance No. 1776 and is no longer sufficient to operate the sewer enterprise fund. The customer's monthly bill includes the KC Metro sewer treatment rate of $23.40 and the City's portion of $5.00, which pays for the system operations, maintenance and improvements. Last year the fund dipped into reserves by $194,000. A $2.00 increase is needed to stop the use of the ending fund balance and will cover replacement costs and any contingencies. Ordinance No. 936 set the inspection fees in 1975 and needs to be updated to our current practices and fees. BACKGROUND Tukwila last adjusted the sewer rates in December of 1996 under Ordinance No. 1776, increasing the City portion from $4.00 to $5.00. The customer's monthly bill includes Metro's sewer treatment rate of $23.40 and the City portion of $5.00, which pays for the system operations, maintenance, and improvements. Tukwila sewer rates are no longer sufficient to operate the enterprise fund and stay out of the red. In 2002, the fund dipped into the reserves by $194,000. Moreover the cost to operate has increased each year due to electrical costs, the growth of infrastructure, the aging pipe and pump facilities, and the additional requirements of maintenance of system grease in the CBD. Currently, Tukwila has the lowest residential rate in the immediate area and remains one of the lowest in comparison to all regional agencies in Washington. WHEREAS, the City Council desires to have in place an equitable and adequate rate structure to finance the operation and maintenance of the sewer utility; and WHEREAS, the City Council also desires to establish the appropriate fees for work requiring a permit and inspection; and WHEREAS, the City needs additional revenues to adequately fund the sewer utility and capital improvements; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 3. Ordinance 1714, as codified at TMC 14.16.030, is hereby amended to read as follows: 14.16.030 Schedule of Charges Rates and charges for sewer service furnished and available for use shall be paid by the owner of the property and shall be as follows: 1. Residential Sewage Service (single dwelling unit) A flat monthly rate ef$5.00 per menth for each single- family residence shall be charged in accordance with the fee schedule to be adopted by motion or resolution of the Tukwila City Council. Every person 62 years of age or older (if married, then either spouse) and every person totally and permanently disabled residing in a separately metered dwelling and who is paying directly for such Sewer Rates 8/21103 separately billed service either as owner, purchaser or renter and whose individual disposable income, if a single person, or whose combined disposable income, if a married couple, from all sources is less than $26 $32,000 per year, shall pay a rate equal to 50% of sewer service charges. Every such person shall file with the Finance Department their affidavit that he or she is qualified to be charged the special rate. Such affidavits are to contain information as required by the Finance Director in order to establish eligibility. Each affidavit will also include an unqualified promise to inform the City of any changes in financial condition that would disqualify the person for special rates. The Finance Director may require affidavits on an annual basis if deemed necessary. 2. Residential Sewage Service (multiple dwelling unit, permanent type) A flat monthly rate of $5.00 per month for each dwelling unit shall be charged in accordance with the fee schedule to be adopted by motion or resolution of the Tukwila City Council. 3. School Sewage Service The rate shall be the commercial /industrial sewage rate. 4. Commercial and Industrial Sewage Service Each account will be charged a flat monthly rate of $10.00 in accordance with the fee schedule to be adopted by motion or resolution of the Tukwila City Council. In addition, the charge for sewage service on premises using more than 750 cubic feet of water per month shall be at the rate per 750 cubic feet, in accordance with the fee schedule to be adopted by motion or resolution of the Tukwila City Council of $10.00. 5. Penalty charge There shall be a penalty charge ef$2.00 each month on sewer accounts more than 30 days in arrears in accordance with the fee schedule to be adopted by motion or resolution of the Tukwila City Council. Section 4. Ordinance 1714, as codified at TMC 14.16.065, is hereby amended to read as follows: 14.16.065 City/METRO Rate A. Regular Rate: The City /METRO charges as provided in Section 14.16.060 and as required by the Agreement for Sewage Disposal between METRO and the City of Tukwila is set at the sum of $23.40 (effective 1/1/02) per month per residential customer and per residential customer equivalent as now defined or hereafter amended in the agreement for sewage disposal between METRO and the City of Tukwila. B. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such Sewer Rates 8/21/03 invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 7. Effective Date. Jim informed us that thc sewer enterprise fund was in the red last year, and this rate increase will stop the use of the ending fund'~oalance and will cover replacement costs and any contingencies. Action Memorandum to Mayor Mullet, dated 08 -14 -03 Minutes Finance and Safety Committee 08 -18 -03 ITEMNO. 3, 6 L MEMORANDUM TO: Mayor Mullet Finance and Safety Committee FROM: Bruce Fletcher, Director of Parks & Recreation DATE: August 14, 2003 SUBJECT: Aquatics Facilities Operations Technician The two park transfers from King County (Ft Dent Park & Tukwila pool) have given our residents and visitors more recreational opportunities in our fine city. The overwhelming success has our staffworking extremely hard to keep the new property and facility operational. The department management direction at the pool has been to increase the programs and hours of operation, which will produce more participation and revenue. The increased offerings have produced favorable numbers and our revenue projection has increased from $160,000 to $175,000. To give you an example of the increase, King County averaged $94,000 annually. With the implementation of the 2004 fee increase, the projected revenue will further increase to $190,000. With the successful swimming pool venture, we have a~so experienced some challenges. The increased demand has kept our Facilities Operations Technician (pool maintenance operator) in high demand. When we did the initial research for adequate swimming pool staff, the county provided us with numbers that indicated a need for a ½ time pool operator. The numbers that the county did not provide were the specialized maintenance hours needed. When the county needed specialized work, they called in their specialized electricians, plumbers, custodian's, HVAC technicians, painters and so on. In Tukwila, our technician is doing it all. The problem is that after 4 hours of work, his day is done. I would like you to consider increasing the ½ time Facilities Operations Technician to full time. The increased hours will enable this position to properly take care of the pool needs in a 30-year- old facility. We have found that many maintenance items have been ignored for many years and unfortunately a preventative maintenance program has not been in place. The added hours are needed for the swimming pool, and also provides expertise with the Fort Dent restroom facility, Tukwila Community Center, and the Parks/Golf Maintenance facility.
