Handouts are available at the Building counter which provide more detailed information on application and plan submittal requirements. Application and plans must be complete in order to be accepted for plan review. VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is subject to possible revision by the Building Division to comply with current fee schedules. BUILDING OWNER / AUTHORIZED AGENT It the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. Maintenance of Easement Areas. 5.1 Maintenance and Repairs. During the term of this Agreement, the parking spaces on both Properties shall be maintained, accessible and available for parking, and all 2 maintenance and repairs, whether ordinary or extraordinary, capital or expense in nature, major or minor, of any particular Easement Area and all improvements constructed thereon shall be performed by the owner of the property on which such maintenance and repair work is required, at such owner's sole cost and expense. All such work shall be performed in such manner and at such intervals by the owners of the Easement Area as shall be required to at all times maintain such Easement Area in a reasonable condition consistent with the standards of similar commercial developments located within the immediate market area. 5.2 Unified Operation. Boeing and Tri -Land shall each perform their maintenance and repair obligations under the foregoing Paragraph 5.1, insofar as it is possible, in such manner as to establish, maintain and present, both in appearance and in fact, a coordinated and unified operation of the Easement Area and, further, not in such manner as will (i) increase or make more burdensome the respective costs and expenses or obligations of the other said owner in performing their maintenance and repair obligations pursuant to such Paragraph, or (ii) impair the efficient and orderly management and operation of the property covered by such Easement Area and the improvements thereon. 6. Taxes and Insurance. Boeing and Tri -Land each shall V, pay the property taxes and assessments applicable to their CD respective portions of the Easement Area. Boeing and Tri -Land 04 shall obtain and at all times maintain an insurance policy or CD policies insuring Boeing and Tri -Land against liability for L� injury or death of persons or damage to property arising out of CD the use, operation and maintenance of the Easement Area on their respective Properties, such insurance to be in a sum of not less than One Million Dollars and 00/100 ($1,000,000.00) combined single limit with respect to injuries to or death of persons and with respect to destruction of or damage to property. Upon Boeing's or Tri- Land's request, the other party shall submit written evidence that such insurance policy or policies are in effect. 7. Right to Cure. If either Boeing or Tri -Land shall fail or refuse to perform any of their respective obligations or duties as set forth in this Agreement, and if such failure or refusal shall continue for Thirty (30) Days after Boeing or Tri -Land, as the case may be, receives written notice thereof from the other party hereto (unless, within such Thirty (30) Day period, Boeing or Tr,i -Land, as the case may be, has commenced and is diligently pursuing the performance of the obligation or duty • specified in such notice), then the party giving such written notice shall have the right, but not the obligation, to perform or pay the obligation or duty that the other party hereto has failed or refused to perform or pay, and, in connection therewith, each party hereto grants to the other, and their 3 :. respective agents, employees and independent contractors, full right on, to and from their respective easement areas for the purposes of performing such obligations or duties. All costs and expenses incurred by Boeing or Tri -Land, as the case may be, in connection with the performance of such other party's obligation or duty, plus Ten Percent (10 %) of the total thereof for overhead and supervision, shall be repaid by such other party within Ten (10) Days after demand, together with interest thereon at the rate of Ten Percent (10 %) per annum from the date of demand until repaid. 8. Reasonable Care. Boeing and Tri -Land shall each exercise reasonable care in the use and enjoyment of the Easement Area and in exercising any of its respective rights under this Agreement. Boeing and Tri -Land shall not utilize portions of the other's property other than the Easement Area without obtaining the prior written approval of the other, which approval may be withheld in the sole discretion of such other owner. 9. Tenants. Boeing and Tri -Land acknowledge and agree that each of them may have a tenant or tenants at their respective Properties (the "Tenants ") and that the Tenants may in turn be responsible under their leases for the performance and C"7 payment of certain of the obligations of Boeing and Tri -Land hereunder including, without limitation, under Paragraphs 4, 5, 6, 7 and 8 above. The Site Plan also reflects that the Tri -Land Property has 97 spaces, which, together with the 62 spaces from the Boeing Property, equals a total of 159 spaces. These 159 spaces available to the Tri -Land Property, plus the balance of the 68 spaces remaining for the Boeing Property, totals 227 spaces, the amount shown as necessary on the Project Data sheet. This material is provided for your review, but the parking analysis is not made a part of the Reciprocal Easement Agreement. I trust that is consistent with your desires. The only flammable materials stored or used in the project is wood furniture. In the warehouse the furniture is stored on 14 foot high metal storage racks consisting of 375 linear feet of 8 foot wide racks and 375 linear feet of 4 foot wide racks. 2. A review of the existing requirements for the showroom floor indicates that the number and width of exits for this area meet the minimum requirements. Therefore, we respectfully request an Alternative Design Approval for the proposed space plan as it is shown in the permit submittal drawings. The current design for the renovation of the Dania store sales area consists of a series of 9 foot high partitions located in a large warehouse space with 25 foot high ceilings. These partitions :serve to break down the large warehouse feel to form smaller areas used as vignettes for the merchandising of furniture. This design and floor plan Is a furniture retail industry standard which has been accepted by jurisdictions across the nation. Examples can be seen in local and nation -wide stores as Ikea, Sears Homelife, Levitz, and Dania. This design concept is used In other situations as well, such as flea markets convention trade shows. We feel that the present floor plan meets the intent of the code for purposes of safe egress from the building for the following reasons: 1. The building meets the required number, width and location of exits. 2. The design provides delineated walkways (aisles marked by a contrasting floor finish, in this case porcelain tile) through each area bounded by the 9 foot high partitions throughout the sales area. These aisles conform to UBC Section 1014 and provide two means of egress from all spaces that require two exits, as well as from most of the smaller spaces that do not require two exits. These aisles, by definition, lead to required exits or other aisles leading to a required exit. 3. The comment reads as follows: A review of the existing requirements for the showroom floor indicates that the number and width of exits for this area meet the minimum requirements. However , the wall schedule indicates that the proposed partitions are 9 -feet in height and consequently these partitions serve to create a series of rooms. It this lies the existing issue. Some of the rooms or areas support and occupant load which requires that two exists serve these room or areas. For rooms that require two exists, one may provide egress through an adjoining room, and the other must provide access directly to an exit. This is not the case in at least three areas that are defined by the 9 -foot partitions and require two exists from said area. We feel that the proposed design fulfills the intent of the applicable codes. Therefore, we respectfully request an Alternative Design Approval for the proposed space plan as it is shown in the permit submittal drawings. The current design for the renovation of the Dania store sales area consists of a series of 9 foot high partitions located in a large warehouse space with 25 foot high ceilings. These partitions serve to break down the large warehouse feel to form smaller areas used as vignettes for the merchandising of furniture. This design and floor plan is a furniture retail industry standard which has been accepted by jurisdictions across the nation. Examples can be seen in local and nation -wide stores as Ikea, Sears Homelife, Levitz, and Dania. This design concept is used in other situations as well, such as flea markets convention trade shows. We feel that the present floor plan meets the intent of the code for purposes of safe egress from the building for the following reasons: 1. The building meets the required number, width and location of exits. 2. The design provides delineated walkways (aisles marked by a contrasting floor finish, in this case porcelain tile) through each area bounded by the 9 foot high partitions throughout the sales area. These aisles conform to UBC Section 1014 and provide two means of egress from all spaces that require two exits, as well as from most of the smaller spaces that do not require two exits. Parking to the west of the project site is on a separate lot.
