Ms. Green and Ms. Salas have been nominated to fill the currently vacant Positions #2 and #8 on
the Equity and Diversity Commission. Both are employees of the Tukwila School District and

July 31, 2005.

SUBJECT: Inter- active Voice Response upgrade to Permits Plus

BACKGROUND
Permits Plus is the automated development permit management and tracking system we have
been using for several years. We have implemented several upgrades to the system in recent
years to improve customer service and efficiency.
For 2003 we budgeted sufficient funds to implement an Inter- active Voice Response upgrade to
the system. This will allow our customers, contractors and homeowners to schedule inspections,
obtain inspection results or cancel inspection by telephone 24 hours a day, 365 days a year.
Persons wishing to schedule appointments by speaking with a Department representative directly
will still be able to do so during normal business hours. The cost of the upgrade is $34,900.
City Council authorization for the Mayor to execute the attached agreement will allow us to
complete this upgrade within the next few months.

October 14 meeting. The Committee has forwarded the proposed contract to the COW (meeting

1. Regional Affordable Housing The State passed legislation in the last Session that allocates
new funding for affordable housing from a small surcharge on any property transactions. An
interlocal with its agreement for spending funds is needed to adhere to the legislation which
states that the funds are to be administered "according to an interlocal agreement between the
county and the cities within the county". 40% of the funds will be allocated to the State, and
Counties cities) will get 60 In King County there will be three sub regions: South King,
Seattle, and North/East King County. Another goal of the legislation is that both existing and
future needs for affordable housing be addressed. Acquisition, rehabilitation and new
construction are the highest priority, then transitional housing operations and maintenance, and
then funds for emergency shelters. The process will use County administration so the overhead
costs will be low. Tukwila already participates on the HOME Working Group, which will be
used to recommend funding projects to the Joint Recommendations Committee. A member from
Seattle will be added to the HOME group, since they are not currently represented there. The
funds will be used to help house people who are at or below the 50% of median income. Need
shall be determined by the 2000 census of people paying over 30% of their income for housing.
Planning to meet future affordable housing needs will also need to be included in the funding.
Recommend interlocal agreement to Regular Meeting.
2. Contract with Charles River Associates Dan Brand who works for Charles River
Associates is one of the foremost experts in the country about transit ridership issues. He has
worked on the City's behalf on Sound Transit issues about parking on S. 154` /TIB. A new
contract for his work is $25,000 to help peer review Sound Transit's proposals about parking that
are based on their ridership forecasts. Recommend contract to COW.
3. Interactive Voice Response Telephones Permit staff has been using an automated computer
program called Permits Plus to track permits. This year's budget included funding to upgrade to
a voice response telephone program whereby contractors or people doing permit work can call
the system at any time to request an inspection, cancel inspection requests, and hear the results of
inspections. The committee wanted to be sure people didn't have to use the system if they
preferred to talk to a person, which Steve said they could do. Steve thought it would make
customers happy, as well as be easier on staff. Recommend agreement for system to COW.
4. Foster Golf Course Work In April the City let a contract for work on the golf course to be
done in conjunction with the clubhouse work. Holes 1, 2, 8, and 9 and the teaching and practice
greens were all improved, and the grass is starting to grow on all of them. Mike said the project
was completed within budget, though there were five change orders. The change orders had
mostly to do with irrigation and soils condition, and some were related to the dirt left over from
the clubhouse that the contract had to find a new use for because it came later than originally
expected. The final contract price was $354, 660.80. Recommend acceptance of Golf Course
proiect as complete to consent agenda of a Regular Meeting.

BACKGROUND
Dan Brand of' Charles River Associates has been a consultant to the City for the past two years.
'He has provided technical review of the parking and transportation related impacts of the
proposed Link Light Rail project. The original contract amount has been exhausted, however the
project has continued to evolve and so the need for his expertise is ongoing.
PROPOSED CONTRACT
We have drafted a new contract for your consideration, see attached. It is structured as a time
and materials contract with a not to exceed amount of $25,000. This is appropriate because the
scope of work is to respond to Sound Transit's proposals and aid in the City's parking
requirement determination for the 154 Street Station park and ride rather than to produce a
specific product.

The consultant's agreement is for design of the drainage and roadway improvements in the
Cascade View neighborhood. Nine firms submitted proposals and KPG was chosen as the
most qualified to incorporate all of the projects planned in the area, including coordination
with Tukwila International Blvd Phase II.

ISSUE
Approve consultant selection and authorize the execution of a contract with KPG, Inc., to provide P.S.
E. for the Cascade View Drainage Improvements project.
BACKGROUND
The Cascade View neighborhood experiences many drainage and groundwater problems. In July of
2002, the City completed the Cascade View Drainage and Groundwater Plan. This plan recommended
specific improvements to alleviate the effects of the groundwater within this area and to rebuild failing
roadways, curbs, gutters, and sidewalks.
The total proposed design and construction costs for the improvements are estimated at $5,069,000.
Project funding includes $307,000 for P.S. E. from Community Block Grants (CDBG), $100,000
for P.S. E. from Public Works Trust Fund (PWTF) loan, $4,197,600 for construction from PWTF
loan, and $466,400 for design and construction in City 412 funds.
ANALYSIS
A Request for Proposals for this project's P.S. E. was published in the Seattle Times and Daily
Journal of Commerce on July 10 and 17, 2003. Nine engineering firms submitted proposals and each
proposal was evaluated and scored based the required evaluation criteria. KPG obtained the highest
overall score.
KPG has designed several Small Drainage Projects within the Cascade View Area as well as completed
the Cascade View Drainage and Groundwater Plan. They are very familiar with the unique problems
of this area. In addition, KPG is also developing the P.S. E. for the Tukwila International Blvd.
Phase 2 street improvement project. Coordination between these projects will be required.

CONSULTANT AGREEMENT FOR
ROADWAY AND DRAINAGE DESIGN SERVICES
THIS AGREEMENT is entered into between the City of Tukwila, Washington, herein -after referred
to as "the City", and KPG, Inc., hereinafter referred to as "the Consultant in consideration of the
mutual benefits, terms, and conditions hereinafter specified.
1. Project Designation. The Consultant is retained by the City to perform roadway and
drainage design services in connection with the project titled 00 -DR06 Cascade View
Drainage Improvements.
2. Scope of Services. The Consultant agrees to perform the services, identified on Exhibit "A"
attached hereto, including the provision of all labor, materials, equipment and supplies.
3. Time for Performance. Work under this contract shall commence upon the giving of written
notice by the City to the Consultant to proceed. The Consultant shall perform all services and
provide all work product required pursuant to this Agreement within 300 calendar days from
the date written notice is given to proceed, unless an extension of such time is granted in
writing by the City.
4. Payment. The Consultant shall be paid by the City for completed work and for services
rendered under this Agreement as follows:
A. Payment for the work provided by the Consultant shall be made as provided on Exhibit
"B" attached hereto, provided that the total amount of payment to the Consultant shall not
exceed $512,005.18 without express written modification of the Agreement signed by the
City.
B. The Consultant may submit vouchers to the City per month during the progress of
the work for partial payment for that portion of the project completed to date. Such
vouchers will be checked by the City and, upon approval thereof, payment shall be made
to the Consultant in the amount approved.
C. Final payment of any balance due the Consultant of the total contract price earned will be
made promptly upon its ascertainment and verification by the City after the completion
of the work under this Agreement and its acceptance by the City.
D. Payment is provided in this section shall be full compensation for work performed,
services rendered, and for all materials, supplies, equipment and incidentals necessary to
complete the work.
E. The Consultant's records and accounts pertaining to this Agreement are to be kept
available for inspection by representatives of the City and state for a period of three (3)
years after final payments. Copies shall be made available upon request.
5. Ownership and Use of Documents. All documents, drawings, specifications and other
materials produced by the Consultant in connection with the services rendered under this
Agreement shall be the property of the City whether the project for which they are made is
executed or not. The Consultant shall be permitted to retain copies, including reproducible
copies, of drawings and specifications for information, reference and use in connection with
the Consultant's endeavors. The Consultant shall not be responsible for any use of the said
documents, drawings, specifications or other materials by the City on any project other than
the project specified in this Agreement.
6. Compliance with Laws. The Consultant shall, in performing the services contemplated by
this Agreement, faithfully observe and comply with all federal, state, and local laws,
ordinances and regulations, applicable to the services to be rendered under this Agreement.
7. Indemnification. The Consultant shall indemnify, defend and bold harmless the City, its
officers, agents and employees, from and against any and all claims, losses or liability,
including attorney's fees, arising from injury or death to persons or damage to property
occasioned by any act, omission or failure of the Consultant, its officers, agents and
employees, in performing the work required by this Agreement. With respect to the perform-
ance of this Agreement and as to claims against the City, its officers, agents and employees,
the Consultant expressly waives its immunity under Title 51 of the Revised Code of
Washington, the Industrial Insurance Act, for injuries to its employees, and agrees that the
obligation to indemnify, defend and hold harmless provided for in this paragraph extends to
any claim brought by or on behalf of any employee of the Consultant. This waiver is
mutually negotiated by the parties. This paragraph shall not apply to any damage resulting
from the sole negligence of the City, its agents and employees. To the extent any of the
damages referenced by this paragraph were caused by or resulted from the concurrent
negligence of the City, its agents or employees, this obligation to indemnify, defend and hold
harmless is valid and enforceable only to the extent of the negligence of the Consultant, its
officers, agents and employees.
8. Insurance. The Consultant shall secure and maintain in force throughout the duration of this
contract comprehensive general liability insurance, with a minimum coverage of $500,000 per
occurrence and $1,000,000 aggregate for personal injury; and $500,000 per occurrence/
aggregate for property damage, and professional liability insurance in the amount of
$1,000,000.
Said general liability policy shall name the City of Tukwila as an additional named insured
and shall include a provision prohibiting cancellation of said policy except upon thirty (30)
days prior written notice to the City. Certificates of coverage as required by this section shall
be delivered to the City within fifteen (15) days of execution of this Agreement.
9. Independent Contractor. The Consultant and the City agree that the Consultant is an inde-
pendent contractor with respect to the services provided pursuant to this Agreement. Nothing
in this Agreement shall be considered to create the relationship of employer and employee
between the parties hereto. Neither the Consultant nor any employee of the Consultant shall
be entitled to any benefits accorded City employees by virtue of the services provided under
this Agreement. The City shall not be responsible for withholding or otherwise deducting
federal income tax or social security or for contributing to the state industrial insurance
program, otherwise assuming the duties of an employer with respect to the Consultant, or any
employee of the Consultant.

10. Covenant Against Contingent Fees. The Consultant warrants that he has not employed or
retained any company or person, other than a bonafide employee working solely for the
Consultant, to solicit or secure this contract, and that he has not paid or agreed to pay any
company or person, other than a bonafide employee working solely for the Consultant, any
fee, commission, percentage, brokerage fee, gifts, or any other consideration contingent upon
or resulting from the award or making of this contract. For breach or violation of this warrant,
the City shall have the right to annul this contract without liability, or in its discretion to
deduct from the contract price or consideration, or otherwise recover, the full amount of such
fee, commission, percentage, brokerage fee, gift, or contingent fee.
11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under
this Agreement, will not discriminate on the grounds of race, color, national origin, religion,
creed, age, sex or the presence of any physical or sensory handicap in the selection and
retention of employees or procurement of materials or supplies.
12. Assignment. The Consultant shall not sublet or assign any of the services covered by this
Agreement without the express written consent of the City.
13.. Non Waiver. Waiver by the City of any provision of this Agreement or any time limitation
provided for in this Agreement shall not constitute a waiver of any other provision.
14. Termination.
A. The City reserves the right to terminate this Agreement at any time by giving ten (10)
days written notice to the Consultant.
B. In the event of the death of a member, partner or officer of the Consultant, or any of its
supervisory personnel assigned to the project, the surviving members of the Consultant
hereby agree to complete the work under the terms of this Agreement, if requested to do
so by the City. This section shall not be a bar to renegotiations of this Agreement
between surviving members of the Consultant and the City, if the City so chooses.
15. Attorneys Fees and Costs. In the event either party shall bring suit against the other to
enforce any provision of this Agreement, the prevailing party in such suit shall be entitled to
recover its costs, including reasonable attorney's fees, incurred in such suit from the losing
party

17. Integrated Agreement. This A oo...ent, together with attachments or addenda, represents
the entire and integrated Agreement between the City and the Consultant and supersedes all

Scope of Work
The City of Tukwila intends to design and construct drainage, roadway, and sidewalk
improvements within the public right of way in the Cascade View neighborhood. The
project area consists of the following roadway segments:

The project scope is to provide surface and subsurface drainage facilities for the area in
general accordance with the recommendations identified in the 'Cascade View
Neighborhood Drainage and Groundwater Study' (August 2002, KPG, Inc.). The
Consultant will work in a collaborative manner with City staff to finalize design standards
for drainage facilities, drainage connections to private systems, roadway cross section,
pedestrian facilities, and streetscape restoration treatment prior to proceeding with final
design. The basis of design will be summarized in a brief design memorandum.
It is anticipated that roadway and drainage improvements will generally be contained within
the existing right of way; however, it may be necessary to obtain easements for a new
outfall location to Tukwila International Boulevard and Southgate Creek to the east. This
scope of work includes property services to secure easements for up to four parcels in
order to install this outfall pipeline. The exact location of the outfall will be determined in
close coordination with upcoming Tukwila International Boulevard improvements.

C. SCOPE OF WORK
TASK 1 MANAGEMENT COORDINATION ADMINISTRATION
1.1 The Consultant shall provide continuous project management for the project
duration (estimate 10 months).
1.2 The Consultant shall prepare a comprehensive schedule and provide monthly
updates.
1.3 The Consultant shall prepare monthly progress reports identifying work in progress,
upcoming work elements, and reporting of any delays, problems, or additional
information needs.
1.4 The Consultant shall provide continuous management and administration of all
subcontractors included in this scope of work.
1.5 The Consultant shall attend design coordination meetings with City staff at
appropriate points in the design process (estimate 8 meetings).
1.6 The Consultant shall provide internal quality assurance /quality control (QA/QC)
reviews of all work products prior to submittal for City review.
TASK 2 SURVEY AND BASE MAPPING
2.1 The Consultant shall prepare 1 =20' base maps within and extending 10' beyond
the right of way for all roadway segments identified in the project description. The
basis of survey control will be the City of Tukwila datum as used on mapping for
International Boulevard. Right of way will be shown based on available County
records, assessor information, and found field information. Parcel lines will be
shown based on assessor information.
2.2 The Consultant shall contract for horizontal field utility locates prior to topographic
survey updates for inclusion on the project base maps.
2.3 The Consultant shall review the existing drainage system with City staff and perform
video inspections of storm drainage facilities to determine existing conditions. The
extent of video inspection is unknown. An allowance of $7,5000 is included for this
video inspection work.
2.4 The Consultant shall prepare a potholing plan to identify potential utility conflicts at
the 50% design level. A design allowance of $10,000 is included for potholing of
existing utilities to determine actual depth.

TASK 3 PUBLIC INVOLVEMENT
3.1 The Consultant shall prepare two (2) newsletters for distribution by the City.
3.2 The Consultant shall prepare presentation materials for each of two (2)
Community open house meetings. Meeting location, dates, and distribution of
announcements will be by the City.
3.3 The Consultant shall attend two (2) community open house meetings.
TASK 4 GEOTECHNICAL INVESTIGATION
4.1 The Consultant shall perform geotechnical investigations based on 6 borings of
15' depth to supplement geotechnical borings that were completed in a previous
study. Geotechnical review will assess the subsurface conditions at selected
locations and develop geotechnical recommendations for design and
construction of proposed underground storm piping, subgrade preparation, and
pavement needs. Geotechnical review will be performed by Landau Associates.
TASK 5 PERMIT APPROVALS
5.1 The Consultant shall prepare a SEPA checklist in support of the project for
review and processing by the City.
5.2 The Consultant, with support from Landau Associates, will evaluate potential
direct and indirect effects on federally listed species and essential fish habitat.
A draft BA and EFH will be submitted to the City for review prior to submittal to
the agencies.
5.3 The Consultant, with support from Landau Associates, shall prepare
documentation for NEPA approval in accordance with funding requirements.
We have assumed that this project will qualify for a categorical exclusion (CE)
in estimating the required level of effort.
TASK 6 UTILITY COORDINATION
6.1 The Consultant shall obtain available utility records from the franchise utilities
within the project area.
6.2 The Consultant shall distribute 50% and 90% plans to all franchise utilities and
solicit comments and coordination issues.

6.3 The Consultant shall notify franchise utility purveyors along the corridor and
provide coordination for relocations, adjustment, or anticipated facility
upgrades.
TASK 7 PREPARE BID DOCUMENTS
7.1 The Consultant shall attend two meetings with City staff to confirm design
goals and the basis for neighborhood improvements. The basis of design will
be summarized in a brief design memorandum. Items to be considered in the
design memorandum include:
Roadway classifications and cross section
Traffic calming needs, if any
Urban design streetscape approach
Pedestrian considerations
On- street parking considerations
Drainage and maintenance strategies
7.2 The Consultant shall prepare 50% plans and cost estimate for the all roadway
segments included in the project description. The plans shall be in sufficient
detail to allow review and confirmation of planned roadway, pedestrian,
channelization, drainage, and streetscape elements by the City during review.
7.3 The Consultant shall attend a 50% review meeting and provide the necessary
follow -up to proceed with final design. The City shall be responsible for
coordination of the review process with the funding agency as required at each
step of the design review process.
7.4 The Consultant shall prepare 90% Plans for review and approval by the City.
Plans shall be formatted to provide sufficient detail for convenient field layout
of all proposed facilities. City standard details and WSDOT standard plans will
be supplemented with project specific details as required. Plan information
shall include:
Drawing index and legend
o Centerline control information
o Limits of construction
Site preparation demolition drawings
Construction staging information
Typical sections and details
Temporary erosion and sediment control plans
o Roadway Plan and profiles
o Drainage system plan and profiles

7.5 The Consultant shall attend a 90% review meeting and provide the necessary
follow -up to address outstanding issues for inclusion in the final bid
documents.
7.6 The Consultant shall prepare 50 90 and final specifications for review and
approval by the City. Specifications shall be based on 2002 WSDOT APWA
standard specifications, using contract boilerplate and general special
provisions provided by the City.
7.7 The Consultant shall calculate quantities and prepare construction cost
estimates in support of the 50 90 and final plans and specifications.
7.8 The Consultant shall finalize bid documents for advertisement and award by
the City. Final bid documents will be signed by a licensed professional
engineer in the State of Washington.
TASK 8 RIGHT OF WAY
8.1 The Consultant shall prepare legal descriptions and exhibit drawings for
easements for each affected parcel (estimate 4 parcels) following City approval
of the 50% drawings. "Legal Descriptions" includes writing takes based on title
reports; "Exhibit Drawings" includes individual stamped drawings showing the
take, area and parent parcel portion abutting the right of way in a stamped and
sealed format.
8.2 The Consultant shall meet with all affected property owners (4 parcels) to discuss
easement needs and explain the project impacts and benefits.
8.3 The Consultant shall perform appraisals and negotiations to secure easements
on up to 4 parcels, if necessary.
TASK 9 BID PERIOD SERVICES
9.1 The Consultant shall provide assistance during the bidding process to include
responding to bidders questions, preparing an addendum to answer questions
of prospective bidders, providing clarifications, preparing the bid tabulation,
evaluating the bids, checking references and providing letter of
recommendation for award of contract. The estimated budget assumes a
straight forward approach with the apparent low bidder receiving the contract
award.

OTHER SERVICES
The City may require other services of the Consultant. These services could include
construction management, inspection, or additional right of way and design services. At
the time these services are required, the Consultant shall provide the City with a
detailed scope of work and an estimate of costs. The Consultant shall not proceed with
the work until the City has authorized the work and issued a notice to proceed.

1. Update on Storm Event Staff reported on the worst flooding in the City as the result of the
nearly 5" of rain that fell Monday. There was a flood at Andover Park East and Strander, which
has been a traditional flooding site. Staff worked on the site until it was fixed at 2 a.m. A bigger
pipe is needed there, and will be installed soon. The second, more serious place was on
Macadam where a large culvert that was coming from Foster and Showalter schools and all their
fields, failed. Staff is working on the problem to resolve it before another storm. A bit of hill
sloughed off on TIB north of 132nd also, but has been cleared. Information.
2 PS &E Contract Selection Cascade View Drainage Last summer the City completed a
tudy of the Cascade View drainage issues. The bill for fixing the problems is around $5 million.
The City had a request for proposals, and received nine proposals. They were ranked by four
staff, and KPG was ranked best. As they have been working on Tukwila's drainage issues for
some time, they are well equipped to be familiar with Tukwila's work issues. Funding for the
project will come from a combination of Public Works Trust Fund loans, CDBG grant, and City
funds. The design cost for this PS &E contract will be $512, 005.18. KBG has a lot of work just
now, but they have assured Public Works they will get this done on time. Recommend
authorizing Mayor's signature on contract to Regular Meeting.
3. 2004 CIP and Budgets Pam had tried to compare the 2004 -2009 CIP with the 2003 -2008
CIP projects. Finding some trouble in aligning all the projects, she requested that caveats be
listed up front when the reviews go to Council. Issues such as Cascade Water being taken from
the CIP and put into the budget; names that were changed from last year; and projects that were
removed from the list without having been done were all things that could be noted at the
beginning of any CIP reviews. Although the water finances are solvent, both sewer and surface
water cannot do the projects in their CIPs without more funds. The reviews of CIP and budget
were completed without changes. Budget and CIP reviewed.
