Present were Council President Pam Carter; and Councilmembers Joe Duffie, Joan Hernandez, Jim Haggerton, Pamela Linder and Dave Fenton. OFFICIALS: Rhonda Berry, Acting City Administrator; Shelley Kerslake, City Attorney; Lucy Lauterbach, Council Analyst; Bob Baker, Deputy City Clerk; Alan Doerschel, Finance Director; Kim Walden, Municipal Court Judge; Keith Haines, Chief of Police; Bruce Fletcher, Parks and Recreation Director; Evelyn Boykan, Human Services Manager; Stacy Hansen, Human Services Specialist; Beth Button, Domestic Violence Victims Advocate; Pat Brodin, Public Works Operations Manager and Jim Morrow, Public Works Director. Steven M. Mullet, Mayor, arrived at 7:50 p.m. SPECIAL PRESENTATIONS: a. Introduction of New Employee Kerry McShane, Administrative Support Technician. Court Clerk Municipal Court Kim Walden, Municipal Court Judge, introduced the newest Court Clerk, Kerry McShane. An Allentown homeowner and area native, Ms. McShane brings a paralegal background to the City. Judge Walden noted Kerry brings a tremendous enthusiasm and a terrific work ethic. With no background in the court field, Kerry is "catching on so quickly." b. Update on Community Oriented Policina Police Chief Keith Haines Police Chief Keith Haines, also a member of the Community Oriented Policing Citizens' Advisory Board (COPCAB), introduced other visiting members Christine Smith, Marja Murray and Bev Lemon. The Chief notified Council that Ms. Smith has an annual update and two awards for presentation. Christine Smith, COPCAB Chair, stated pride for the past year of hard work, fun and dedication to policing and community teamwork. The year 2003 was also a year of goals, learning and of community partnerships. Goals and accomplishments included continuing Board education, advocating for the continued expansion of the Police Department (facilities), community education on the ban of fireworks, and the creation of a COPCAB website. Annually, the COPCAB Board awards a Community Oriented Policing Award. For the year 2003, two recipients are being named. Police Officer Ted Rutt and Police Volunteer Mary Hulvey were both named recipients and received their awards from Ms. Smith. Mr. Rutt was recognized for his many charitable contributions to the community and Ms. Hulvey was recognized for logging in over 2,500 volunteer hours since December, 2001. Streets Utilities PowerPoint) Tour Pat Brodin, Public Works Operations Manaaer Jim Morrow, Public Works Director, reported on current flooding conditions in the area. Timing is coincidental as it is Mr. Brodin's crews which respond to this type of problem. At the time he reported, six people were working on problem areas (with flooding issues). Crews will work through the evening at 140 and Macadam as water is coming down the hillside with enough debris to block drainage ditches. Crews are also working with diverting water away from a residence which has already sustained slight damage. Pat Brodin, Public Works Operations Manager, was present to report "how Public Works Maintenance does business." Mr. Brodin noted various Maintenance divisions include Water, Sewer, Surface Water, Streets, Fleet and Facilities. Not always noticed is the work performed in sweeping, mowing, litter and leaf cleanup, snow removal and the Vegetative Control program efforts. In seeing how Tukwila is regionally located, we need Public Works staff to sustain the infrastructure for visitors to our community and for our residents. We need to operate the water and sewer for people to enjoy our amenities. We need to maintain the drains, roadways and signals for people to access our businesses. Adequate infrastructure (properly maintained) is the very essence of a jurisdiction that will flourish and revitalize itself. Mr. Brodin touched upon duties handled by each division of Maintenance. By naming the various duties of each division, Mr. Brodin impressed upon Council why repairs cost what they do, and why it is not easy to get things done "in a hurry." Council stated appreciation for Mr. Brodin's presentation and for the work performed by his crews on a daily basis. He was also commended for the work put into the "Street Utilities Tour" via pictures and PowerPoint presentation. PROCLAMATION: October 2003 National Domestic Violence Awareness Month Evelyn Boykan, Human Services Manager, reported on recent tasks and accomplishments of the Domestic Violence Task Force. In addition to working smarter and better together the Domestic Violence Task Force completed the Domestic Violence project with the Somali Family Safety project. This was an effort to work with that community and raise awareness about this issue. Many people were reached in terms of raising awareness. The community wants to continue working on this effort. The Task Force continues its education with the separate departments and with the Task Force as a whole. Meeting places and times have changed to meet the needs of those on the Task Force. Keith Haines, Police Chief and Domestic Violence Task Force member, reported men play an important role in the nation's effort to stop violence against women. All men have the opportunity to serve as role models for other men (and boys) in regard to the treatment of women and girls. Boys must be taught at a young age that using violence against women is wrong and should not be tolerated. Chief Haines spoke in favor of a recent campaign called Take the P /edge, from the Department of Justice, Office of Violence Against Women. The Pledge reads as follows: "I pledge to never commit, condone or remain silent about domestic violence. I pledge to challenge other men to recognize that they can be powerful without making others powerless. I pledge to teach our sons how to step up and to encourage men to work together with women to end domestic violence in every community and across the nation." Copies of The Pledge were available for those present. Kerri Bergland, City Prosecutor, reported 161 domestic violence charges have been filed in the Tukwila Municipal Court, through September, 2003. She spoke of the background behind domestic violence, the victims involved. She spoke of holding perpetrators accountable and the need for parenting classes as City of Tukwila Page 3 of 8 City Council Regular Meeting Minutes October 20, 2003 well as domestic violence education courses, not anger management courses, as originally believed necessary to treat offenders. According to statistics, domestic violence perpetrators are the most likely individuals to cause bodily harm to others, including police officers, family members, witnesses to their actions and innocent bystanders. To that end, awareness of and education about the situation, charges and seriousness of it all is key to keeping the community at less risk. Kim Walden, Municipal Court Judge, spoke on behalf of the Court's efforts to support the Domestic Violence Task Force. She reminded Council of her goal to make the Court more accessible to the public. To that end, the Court would like to allow victims of domestic violence to petition the court for an Order of Protection. Plans are currently in the works for such a program to be in place by early 2004. Next, Judge Walden informed the Council that all defendants convicted of domestic violence are ordered to complete batterers treatment on active probation. Before closing, the judge explained the difference between anger management classes and batterer treatment. Beth Button, Domestic Violence Victims Advocate, spoke of changes made within the past few years, relative to her position. Results have been very positive, as she has worked with Police Department Officers and Detectives. The Violence Against Women Act Grant has begun using a portion of their funds for training (specifically for legal advocates) on a monthly basis. Advocates have the opportunity to provide input and actually vote on the kind /type of training to be offered. Examples of training attended by Ms. Button include Teen Violence, Culturally-Specific Dynamics of Domestic Violence, Civil Issues for Community Advocates, and Batterers Treatment Programs including specific information on curriculums offered. Another positive enhancement to the domestic violence advocacy program, begun in the Tukwila Police Department, is the availability of cellular phones to victims. These cellular phones are donated by community members and are maintained in the patrol area of the department. These are given to victims for protection and to avoid mis -use or abuse, victims are only allowed to dial 9 -1 -1. Finally, Ms. Button reported all police patrol officers are required to distribute Domestic Violence Check Sheets in every call they respond to for domestic violence verbal disputes. If a crime has not occurred, yet an argument has taken place, the officer will leave such a check sheet, which explain mandatory arrest laws and victims° rights, as well as resources available to victims of domestic violence. Reading from the original proclamation, Mayor Mullet proclaimed October, 2003 as National Domestic Violence Awareness Month in the City of Tukwila. Additionally, the Mayor encouraged everyone in Tukwila to take an active role in supporting victims in leading healthy lives, safe from violent and abusive behavior. CITIZEN COMMENT /CORRESPONDENCE: JoAnne McManus. 5610 South 133r Tukwila. stated appreciation for the Tukwila Public Works Department during a recent power outage. The outage occurred while a Qwest employee was using a truck to work on a pole on South 133 Street and was struck by a falling tree. The truck operator was not injured in spite of the fact he was working in the bucket of the repair vehicle. An unknown Public Works representative responded to the scene to direct traffic, assist in tree clean up, and kept the neighbors informed as to the status of their power. Bruce Fletcher, Director, Parks and Recreation, was pleased to announced receipt of a check in the amount of $95,628.00. The check represents grant monies received from I. A. Approval of Minutes October 6, 2003 Regular Meeting b. Approval of Vouchers 302358 302733, in the amount of $1,787,218.01 c. Accept as complete the Foster Golf Course Improvement Project with Bernhardt Golf, a Division of Bernhardt Industries, Inc.; authorizing release of retainage (final project cost $354,660.80.) Dlus WSST. for the ourchase of two Dumos for the Sewer Lift Station #12 Uoarade Proiect Councilmember Linder reported review and approval of this item at the Utilities Committee on October 7, 2003. The 2003 CIP includes upgrades to Lift Station #12. This, the second phase of the upgrade, includes installation of new pumps and a generator. The pumps will be purchased by the City and provided to the contractor for installation as part of a contract that includes new pumps, electrical wiring and equipment. Alan Doerschel, Finance Director, noted the similarities between this proposed ordinance and that which was recently adopted. Refunding the 1994 bonds will save the City approximately $373,000.00. These bonds will replace higher interest rate bonds during the next ten years. Shawn Keatts, underwriter, Lehman Brothers, was present to answer questions and provide clarification. APPROVED RESOLUTION #1533 City of Tukwila Page 6 of 8 City Council Regular Meeting Minutes October 20, 2003 NEW BUSINESS: a. Authorize Mayor to execute an agreement with WSDOT that will provide $50,000.00 of state funding for construction of the West Valley Highway /Strander Boulevard Intersection Improvements project. Councilmember Linder reported the review and approval of this item at the October 13 Transportation Committee. The Washington State Department of Transportation is responsible for pavement and restoration for West Valley Highway from SR 516 (Kent) to I -405. This agreement provides funding from WSDOT to overlay the roadway within limits of the West Valley Highway /Strander Boulevard Intersection construction project. By entering into the agreement, the City saves up to $50,000.00 in paving costs. LINDER MOVED; FENTON SECONDED; TO AUTHORIZE THE MAYOR TO EXECUTE AN AGREEMENT WITH WSDOT THAT WILL PROVIDE $50,000.00 OF STATE FUNDING FOR CONSTRUCTION OF THE WEST VALLEY HIGHWAY /STRANDER BOULEVARD INTERSECTION IMPROVEMENTS PROJECT. The motion carried 6 -0. b. Authorize Mayor to sign the Regional Affordable Housing Program Interlocal Cooperation Agreement with King County. Councilmember Hernandez reported review and approval of this Interlocal agreement at the October 14 Community Affairs and Parks Committee meeting. This was an effort under the Washington State Legislature that allows the setting aside of some funds received from recording of documents. Funds collected are to be used in connection with affordable housing issues. It is possible that some of these funds can /will be used in Tukwila, therefore signing of the agreement would be in the best interests of the City. HERNANDEZ MOVED; FENTON SECONDED; TO AUTHORIZE THE MAYOR TO SIGN THE REGIONAL AFFORDABLE HOUSING PROGRAM INTERLOCAL COOPERATION AGREEMENT WITH KING COUNTY.* Discussion: Evelyn Boykan, Human Services Manager, shared some statistics related to the recent census as to how this program is relevant to Tukwila. According to the census' definition of low- income and very-low- income, 87% of Tukwila households fall into either of the two categories. Forty percent of Tukwila households make less than $35,000.00 per year. What funds like these have already done for Tukwila residents is help non profit organizations purchase apartment complexes such as the Mountain View Apartments. One of the priorities for the use of these funds is for acquisition and rehab. Therefore non -profit organizations could apply for these funds on behalf of our needs in Tukwila. This is an exciting effort that coalitions around housing have worked towards for many years. To have identified a dedicated revenue stream source is a very positive thing for the City. None of the funds from the recording of documents will be used for the administration of the program. The first pot of funds is expected to be $3 million, and perhaps available by the end of 2003. Proposals are also anticipated. *Vote on the main motion carried 6 -0. c. Resolution ordering the cancellation of past -due accounts receivable and returned checks. APPROVED RESOLUTION #1535 REPORTS: a. Mayor Mayor Mullet attended a Green River Flood Control meeting last week, as well as an ACCIS Conference in Vancouver. Additionally, he attended an Auburn Chamber of Commerce luncheon and an American Legion Dinner. b. City Council Councilmember Duffle attended this evening's Finance and Safety Committee meeting. He also toured the construction efforts underway at the Foster Golf Course. Councilmember Hernandez attended the October 14 Tukwila Government Affairs luncheon and the October 15 luncheon with local -area legislators. Council President Carter attended the October 15 luncheon with local -area legislators and a Regional Transit meeting the same day. Councilmember Haggerton also attended the October 15 luncheon with local -area legislators and an October 16 Lake Tapps Task Force meeting. Councilmember Linder had no report. Councilmember Fenton attended the October 15 luncheon with local -area legislators. c. Staff Rhonda Berry had no report. City of Tukwila Page 8 of 8 City Council Regular Meeting Minutes October 20, 2003 Shelley Kerslake reported many have received notice of an upcoming "Open House" regarding Sound Transit issues in the coming weeks. She noted that much of the information to be shared at that Open House will be the same Councilmembers will be reviewing in coming months. To that end, Ms. Kerslake provided "a word of caution" and suggested Councilmembers not attend that Open House. e. Legislative Analyst Lucy Lauterbach had no report. MISCELLANEOUS: Jim Morrow, Public Works Director, reported Macadam Road (between 140 and 144 has been closed this evening due to flooding. There is a great deal of erosion in the area. At this time (9:25 p.m.) there are three backhoes and six men working to keep the groundwater and soil away from one resident's home which is severely threatened. Future reports will follow.
