TUKWILA MONICIPAL CODE AND ORDINANCE 486
AUTHORIZING THE BOARD OF ADJUSTMENT TO
CONSIDER VARIANCES REGARDING UNDERGROUND
UTILITY INSTALLATION REQUIREMENTS AND
ESTABLISHING CRITERIA FoR THE GRANTING THEREOF.

`ORDINANCE AMENDING SECTION 13.08.100 OF THE
TUKWILA MUNICIPAL CODE AND ORDINANCE 486
AUTHORIZING THE BOARD OF ADJUSTMENT TO
CONSIDER VARIANCES REGARDING UNDERGROUND
UTILITY INSTALLATION REQUIREMENTS AND
ESTABLISHING CRITERIA FOR THE GRANTING THEREOF.
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
That Section 13.08.100 of the Tukwila Municipal Code
and ordinance 486 be amended to read as follows:
13.08.100 Variance Procedure. All applications for
variances from the foregoing underground requirements shall
first be filed with the Tukwila Board of Adjustment through the
Planning Department.
A variance shall not be granted by the Board
of Adjustment unless the Board finds that all the facts
and conditions exist as stipulated in Section 18.72.100
(1) (6) of the Tukwila Municipal Code. In addition the
Board must find that:
1. The utility owner or user or any other affected
party can demonstrate that it would work an undue
hardship to place the facilities concerned under-
ground. By undue hardship is meant a technological
difficulty associated with the particular facility,
or with the particular real property involved, or
a cost of undergrounding such a facility which out-
weigh the general welfare considerations implicit
in underground installation.
Chapter 18.72 of the Tukwila Municipal Code shall be
followed as it related to fees, hearings, notices, decisions,
appeals, etc.

WASHINGTON, And approved by the Mayor at a regular meeting thereof
this day of 1975.
