CITY COUNCIL SPECIAL MEETING MINUTES
Immediately following COW Meeting
CALL TO ORDER:
Calling the City Council Special meeting to order at 10:23 p.m. was Steven M. Mullet, Mayor.
ROLL CALL:
Calling the roll of Council was Bob Baker, Deputy City Clerk. Present were Council President Jim
Haggerton; and Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Pamela Linder, Dennis
Robertson and Dave Fenton.
OFFICIALS:
Steven M. Mullet, Mayor; Rhonda Berry, City Administrator; Lucy Lauterbach, Legislative Analyst; and
Bob Baker, Deputy City Clerk.
Clerical Note:
CONSENT AGENDA:
As many of these items were discussed during a Committee of Whole meeting,
immediately preceding this meeting, little discussion /debate occurred and is
therefore not included.
Approval of Vouchers #309978 309969, in the amount of $479,453.07
DUFFIE MOVED; HERNANDEZ SECONDED; TO APPROVE THE CONSENT AGENDA AS
PRESENTED. The motion carried 7 -0.
BID AWARDS:
a. Award a construction contract to Dennis R. Craia, Inc., in the amount of $429.869.34, for
the 2004 Small Drainage Program (base bid and Additive Item A)
CARTER MOVED; LINDER SECONDED; TO AWARD A CONSTRUCTION CONTRACT TO DENNIS R.
CRAIG, INC., IN THE AMOUNT OF $429,869.34, FOR THE 2004 SMALL DRAINAGE PROGRAM
(BASE BID AND ADDITIVE ITEM A). The motion carried 7 -0.
b. Award a construction contract to Western Engineering Constructors, Inc., in the amount
of $221,588.17 for the Fort Dent Stormwater Pump Station #19 and Drainage
Improvements project
CARTER MOVED; LINDER SECONDED; TO AWARD A CONSTRUCTION CONTRACT TO WESTERN
ENGINEERING CONSTRUCTORS, INC., IN THE AMOUNT OF $221,588.17, FOR THE FORT DENT
STORMWATER PUMP STATION #19 AND DRAINAGE IMPROVEMENTS PROJECT.*
Discussion:
A contingency amount of 10% is built into the construction contract.

NEW BUSINESS:
a. Authorize City's withdrawal from all lawsuits filed by the Airport Communities Coalition
(ACC) on behalf of ACC member cities.
HAGGERTON MOVED; FENTON SECONDED; TO AUTHORIZE THE CITY'S WITHDRAWAL FROM
ALL LAWSUITS FILED BY THE AIRPORT COMMUNITIES COALITION (ACC) ON BEHALF OF ACC
MEMBER CITIES.
Council President Haggerton reported debate of this issue took place at last week's ACC meeting. At
that time, three lawsuits were still active. All but one ACC member city (Normandy Park) voted in favor of
withdrawing from those lawsuits.
*The motion carried 7 -0.
b. Authorize Mavor to sign letter of withdrawal from the Airport Communities Coalition and
recommend the organization be dissolved.
HAGGERTON MOVED; LINDER SECONDED; TO AUTHORIZE THE MAYOR TO SIGN A LETTER OF
WITHDRAWAL FROM THE AIRPORT COMMUNITIES COALITION AND RECOMMEND
DISSOLUTION OF THE ORGANIZATION.
Council President Haggerton reported a signed letter from Tukwila's Mayor constitutes the City's
withdrawal from ACC. And, contrary to recent reports, "to date, there has been no formal vote by the
ACC to dissolve the organization."
*The motion carried 7 -0.
c. An ordinance raising City Metro rates for sanitary sewer service (pass through rate
increase for 2005)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
AMENDING TUKWILA MUNICIPAL CODE 14.16.065, TO RAISE THE CITY /METRO
RATE FOR SANITARY SEWER SERVICE DUE TO AN INCREASE BY THE
METROPOLITAN KING COUNTY COUNCIL; REPEALING ORDINANCE NO. 1979 AND
NO. 2026, SECTION 4; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE
CARTER MOVED; FENTON SECONDED; TO READ THE PROPOSED ORDINANCE BY TITLE ONLY.
The motion carried 7 -0.
Rhonda Berry, City Administrator, read the title of the proposed ordinance.
CARTER MOVED; DUFFIE SECONDED; TO ADOPT THE PROPOSED ORDINANCE AS READ.
The motion carried 7 -0.
APPROVED ORDINANCE #2059
d. Authorize the Mavor to sign Supplemental Agreement No. 1 to AG 03 -144. with PACE, in
the amount of $50,078.00, to perform construction inspection and project management.
CARTER MOVED; LINDER SECONDED; TO AUTHORIZE THE MAYOR TO SIGN SUPPLEMENT #1
TO AG 03 -144, WITH PACE, IN THE AMOUNT OF $50,078.00, TO PERFORM CONSTRUCTION
INSPECTION AND PROJECT MANAGEMENT. The motion carried 7 -0.
