COUNCIL ATTENDANCE: OFFICIALS: SPECIAL PRESENTATIONS: TUKWILA CITY COUNCIL AUGUST 23, 2004 7:00 p.m. Tukwila City Hall Council Chambers COMMITTEE OF WHOLE MEETING MINUTES Present were Council President Jim Haggerton; and Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Pamela Linder, Dennis Robertson and David Fenton. Steven M. Mullet, Mayor; Rhonda Berry, City Administrator; Lucy Lauterbach, Legislative Analyst; Bob Baker, Deputy City Clerk; Police Chief Keith Haines; Jim Morrow, Public Works Director; Bob Giberson, Acting City Engineer; Jack Pace, Deputy Director of Community Development; Minnie Dhaliwal, Senior Planner; and Rebecca Fox, Senior Planner. a. Oath of Office New Police Officer Mike Richardson Keith Haines, Chief of Police, introduced Mike Richardson. Coming to the City from the Port of Seattle, Mr. Richardson is a lateral hire and comes from a "police family." Mayor Mullet administered the oath of office to Tukwila's newest police officer. b. Recognition of City employees Keith Haines, Chief of Police, recognized Jay Seese, Tukwila Police Officer, for his selfless acts and efforts during an April 27, 2004 incident. During that very volatile situation, Officer Seese came to the aid of a downed (unconscious) fellow police officer, Corrine Purucker. Officer Purucker was assaulted by an assailant in spite of efforts to subdue the man. Upon contact with the assailant, Officer Seese was struck in the head (by the assailant) with the flashlight of Officer Purucker. Fighting to maintain control of the situation, it was with pepper spray in the air and a "split head" that Officer Seese was able to act in defense of himself and Officer Purucker and call for additional backup. Calling Officer Seese's actions "swift and appropriate," Chief Haines was proud to award Jay Seese with the department's highest award the Medal of Valor. Many Tukwila Police Officers and staff were present to see Officer Seese receive the award. c. King County Library System Capital Replacement Bond Measure Bill Ptacek. Director of King County Library System, presented Council with a 6- minute video entitled, "2004 Bond Video." Relating information regarding the long -term viability of the King County Library System (KCLS), Mr. Ptacek spoke in favor of a proposed replacement bond measure on the September 14, 2004 ballot. Passage of the ballot measure is a way for community members to support the KCLS infrastructure and would ensure libraries remain in good shape, patron needs are met, and needed resources are obtained at libraries around King County. City of Tukwila Page 2 of 8 City Council Committee of Whole Minutes August 23, 2004 Three new libraries will be built if the measure is successful. Additional books and materials will be ordered, additional computers will be installed and additional meeting space will be made available. If the ballot measure is unsuccessful, monies will need to be derived from the KCLS operating budget and this will result in staffing and operational hour reductions. Also affected will be the number of books purchased. Finally, libraries will not be maintained to their current degree, and new libraries would not be erected. The replacement bond will cost each homeowner approximately $25 per year, and requires a 60 approval rate for passage. Mr. Ptacek spoke in favor of KCLS being able to accommodate all the necessary changes associated with current levels and natures of use. Judge LeRov McCauley, King County Superior Court Judge and KCLS Board member, spoke of the importance of maintaining an open, active and viable library system. As a juvenile court judge, he expects each detained juvenile offender to utilize the services of KCLS before release. Judge McCauley is the newest member of the KCLS Board of Directors. Councilmember Hernandez thanked Mr. Ptacek for "doing a better job" in communicating KCLS desires to the public with this issue, compared to those in the past. Mr. Ptacek acknowledged the compliment. He said the two groups could work together. Raising the issue of Tukwila Library, Mr. Ptacek stated KCLS plans to keep that library at its current size, as the most notable growth at any library is the Foster Library. He reported the array of services at that particular library is "working quite well." Councilmembers Carter, Linder, Robertson and Fenton spoke in favor of the bond measure. Councilmember Duffie would like to be in favor of the measure, yet has "doubts." He asked the Council President to call for audience comment; especially from the current and /or former patrons of Tukwila Library. Anna Bernhard, JoAnne McManus, Louise Strander, and Steve Schneider, all Tukwila residents, spoke in opposition to the proposed bond measure. Dwight McLean, Tukwila resident, spoke in favor of the proposed bond measure. Caroline Morgan, Tukwila resident, spoke in opposition to the current hours of operation at the Tukwila Library. Calling them restrictive, she reported it hard to get there at a good time and noted computers are not always available. Councilmember Carter reminded Council of a KCLS Board meeting on August 25, 2004 wherein they will consider correspondence sent by the City Council, as it relates to the Interlocal Agreement currently at issue. Councilmember Robertson spoke in favor of governmental agencies working together, especially with respect to the current issue of the Interlocal Agreement. He spoke in favor of working together to come to a mutual understanding with respect to the agreement as well as finding a way to better work together. Judge McCauley thanked Council for the opportunity to address them and noted the KCLS has no intent to disrespect the City of Tukwila or its Council. Additionally, he said the KCLS Board would listen and work to make this the best library system in the country. He is aware of the past relationship between the two entities and is certain all "will be fine." Finally, the judge spoke in favor of the bond issue. To that end, a proposed, draft resolution was left with Mayor Mullet in the event Council wishes to accept it at a future meeting. T At the request of Mr. Taniguchi, no presentation will be made. CITIZEN COMMENT /CORRESPONDENCE: Dwight McLean 12015 38 Avenue South, Tukwila, was very pleased with the results of last weekend's Highway 99 Action Committee BBQ. At that event, posters were hung showing conceptual ideas of Tukwila Village (in its completed stage) and signatures were sought in connection with a petition containing a heading as follows: CONTINUANCE OF TUKWILA VILLAGE A PETITION TO THE CITY COUNCIL WE THE UNDERSIGNED ENCOURAGE THE CITY OF TUKWILA TO COMPLETE THE PLANS FOR TUKWILA VILLAGE. WE UNDERSTAND THE CITY AND RESIDENTS HAVE COMMITTED, FOR THE PAST SEVERAL YEARS, TO UPGRADE AND IMPROVE CONDITIONS ALONG THE HIGHWAY 99 CORRIDOR (TUKWILA INTERNATIONAL BLVD). WE URGE THE CITY COUNCIL NOT TO DIVERT THE FUNDING OF THIS UNCOMPLETED PROJECT, AS WE BELIEVE IT WILL STIMULATE NEEDED ECONOMIC DEVELOPMENT OF THIS AREA, PROVIDE ADDITIONAL JOBS TO LOCAL RESIDENTS, AND BETTER SERVE THE NEEDS OF MANY RESIDENTS IN TERMS OF SHOPPING, SAFETY, AND OTHER HUMAN RESOURCES. WE UNDERSTAND FUNDING RESOURCES ARE SCARCE. HOWEVER, WE BELIEVE THE FUTURE BENEFITS WILL FAR OUTWEIGH THE SETUP COSTS, AND WILL PROVIDE A REAL CITY CENTER IN WHICH ALL OF TUKWILA CAN TAKE PRIDE. Citing a change in the City Council and a perceived sense of "cold feet," Mr. McLean spoke against taking the project apart piece by piece or "scaling it back" in order to save money. The petition presented shows support for the project. Councilmembers Duffie and Hernandez noted the project is still one of the three top projects as far as they are concerned. Council President Haggerton commented that although a person cannot actually see a lot of progress on the project, staff is still negotiating on parcels of property and other things are being done behind the scenes to further its progress. As Mr. McLean (and his family) and Art Rosengren worked hard on the Highway 99 Action Committee BBQ on August 21, 2004, individual Councilmembers thanked them for their efforts and success. Councilmember Robertson noted, in response to Mr. McLean's comments, that while the 15% rate of return required by developers shown in the ClearPath report appears to be usury, the consultants who wrote the report most likely knew their subject. Because of this, Mayor Mullet proposed elimination of the Tukwila Village residential component and parking garage to reduce overall cost. He noted the everyone may have "give a bit" to see the project through to completion as it does not appear the City can afford to provide monies necessary to induce developers to build the original project. SPECIAL ISSUES a. Briefing Comprehensive Plan Amendments and Growth Manaaement Act (GMA) Amendments (Recommendations from Plannina Commission) Jack Pace, Deputy Director of the Department of Community Development, informed Council that staff is ready to present the Planning Commission's recommendations for GMA related amendments to the Comprehensive Plan as well as two annual amendments proposed by private parties. Rebecca Fox, Senior Planner, Department of Community Development, summarized and reviewed GMA related amendments to the Comprehensive Plan as recommended by the City's Planning Commission. The amendments are required to make Tukwila's Comprehensive Plan consistent with the GMA or to lay the foundation for the Tukwila Urban Center. City of Tukwila Page 4 of 8 City Council Committee of Whole Minutes August 23, 2004 For review by the Council, Bob Giberson, Acting City Engineer, reviewed proposed language changes to the Comprehensive Land Use Plan relative to Transportation and Utilities. He noted the updates are minimal and bring the City "up to speed" with GMA requirements. For Council consideration, Ms. Fox led Council through a review of proposed language changes (for the Comprehensive Land Use Plan) to each of the following elements: Capital Facilities, Tukwila Urban Center, Housing, Maintenance of the Plan and Economic Development. Mr. Pace, Ms. Fox and Mr. Giberson provided changes, background information, and answers to Council inquiries. Throughout the review, Council called for materials to be presented in a different manner for future review. Calling the provided information "confusing" and difficult to follow, the Council asked staff to provide entire chapters from the Comprehensive Plan with proposed changes showing strike -outs, underlines and other editorial notations to eliminate back and -forth review between that which is proposed and that which currently exists. Minnie Dhaliwal, Senior Planner, Department of Community Development, led Council through a review and synopsis of two proposed amendments by private parties. L03 -078 Comprehensive Plan map change and rezone request from LDR to C /LI as proposed by the Sabey Corporation. The requestor proposes to amend the Comprehensive Plan and Zoning designations from Low Density Residential (LDR) to Commercial /Light Industrial (C /LI) at the property located at "the western terminus of South 126 Street just east of the Tukwila International Boulevard and abutting the western edge of 34 Avenue South." The affected property is part of the approved development site of the Department of Homeland Security regional immigration services facility. After a hearing on the issue, the City's Planning Commission recommended denial of the map change and rezone request. They prefer the property remain with the current LDR zoning designation. For the record, audience member Bill Arthur left Council Chambers before review of the following item. L03 -077 Text amendments to the Tukwila Valley South element of the Citv's Comprehensive Plan as proposed by La Pianta, LLC. After deliberating a request on June 24, 2004, the City's Planning Commission finalized and forwarded recommendations to the City Council on proposed text amendments to the Tukwila Valley South element of the City's Comprehensive Plan. Using a matrix to show existing Comprehensive Plan policies, changes requested by the applicant and Planning Commission recommendations, Ms. Dhaliwal shared information with the City Council. Ms. Dhaliwal reported text amendments, if approved, would result in a draft ordinance, which would adopt such proposed amendments. Councilmember Robertson asked for a "one -page description" of a master plan including its normal purpose. Mr. Pace informed Mr. Robertson the City does not have a master plan for anything of this scale. That being said, Mr. Robertson still requested receipt of information and staff agreed to provide it. Lisa Verner, Project Coordinator for the Tukwila Valley South Annexation project, reported staff is looking to create a master plan for the affected site. Ms. Verner envisions the master plan to be "something a little more detailed than a Comprehensive Plan," yet not so specific as to identify every action as to what can /will happen on the property. City of Tukwila Page 5 of 8 City Council Committee of Whole Minutes August 23, 2004 Before closing this issue, Mr. Pace reviewed a proposed schedule with Council. A second briefing will be held on September 20, 2004 on the Natural Environment/Sensitive Areas ordinance. Another briefing will be held on September 27 (if required). A public open house will take place on September 28, with a Public Hearing to follow on October 4. Council deliberations will follow on October 11, 18 and /or 25, depending upon need. Any draft ordinances will be considered by Council on November 8 with proposed action on the ordinances to occur on November 15. b. An ordinance raising City Metro rate for sanitary sewer service (a pass through rate increase for 2005) Councilmember Carter reported review of this item at the August 17 Utilities Committee meeting. Citing this as an issue where new growth pays for new capacity, Ms. Carter noted King County adopted an ordinance to increase the monthly sewer charges. Unable to absorb the charges, the City of Tukwila passes these costs onto their sewer customers. Sewer rates will rise to $25.60 per month, per residence, from the current rate of $23.40. With little Council discussion, consensus existed to forward the proposed ordinance onto this evening's City Council Special meeting agenda. c. Bid Award 2004 Small Drainaae Program Councilmember Carter reported review of this item at the August 17 Utilities Committee meeting. Advertised in July and August (once each month), four bids were received in connection with the Small Drainage project. The program includes six project sites in the base bid and one alternate site designed by KPG, Inc. Sites include 1) South 146 Street (west of 41s Avenue South); 2) "The Loop" Phase 3 (South 158 3) 40 Avenue South (Southcenter Boulevard vicinity); 4) South 148 Street at West Valley; 5) South 141st Street (42n Avenue South); 6) South 130 Street (35 to 37t Avenue South); and 7) South 180 Street Grade Separation Drainage Repair the "additive item A." From four bids, staff seeks to award the project to Dennis R. Craig, Inc., of Redmond. The proposed bid award amount is $429,869.34. Jim Morrow, Director of Public Works, explained the water situation at the South 180 grade separation site. Calling it a "boat sitting on an high pressure aquifer," Mr. Morrow noted several small cracks are coming up through the roadway. Focus of the project will be to expand undersurface of drainage surface to pick up the extra water. Consensus existed to forward the proposed ordinance onto this evening's City Council Special meeting agenda. d. Bid Award Fort Dent Stormwater Pump Station #19 and Drainaae Improvements Councilmember Carter reported review of this item at the August 17 Utilities Committee meeting. The stormwater pump station is in disrepair and without sufficient capacity. Much needed drainage improvements were also made part of the bid award. Advertised twice in July, 2004, two bids were received. The low bid of $221,588.17 was received from Western Engineering Constructors, Inc. Staff is in favor of awarding the project to Western Engineering. Reporting the need for improvements, Ms. Carter noted monies for the project will be taken from the City's 303 Facilities Fund. Construction Services Supplement Fort Dent Stormwater Pump Station #19 and Drainage Improvements. Councilmember Carter reported review of this item at the August 17 Utilities Committee meeting. Describing staff as being thinly stretched, Ms. Carter reported the need for the proposed contract supplement to complete the work. The proposed contract amendment will allow the contractor (PACE) to perform construction inspection and management for the noted project. Coming in at just over $50,078.00, the 90- calendar day contract is approximately 17% of the engineer's estimated cost. Public Works Director Jim Morrow spoke in favor of the proposed contract amendment. Monies for this amendment will also be taken from the City's 303 Facilities Fund. Consensus existed to forward the proposed ordinance onto this evening's City Council Special meeting agenda. f. Briefing on Transportation Improvement Board grant applications Councilmember Hernandez reported review of this item at tonight's Transportation Committee meeting. Noting the urgency of timing, Ms. Hernandez stated grant applications must be postmarked by August 31, 2004. Jim Morrow, Public Works Director, reviewed each of three proposed grant applications (to the Transportation Improvement Board) with Council and provided relative information. Mr. Morrow spoke of applications being submitted for the following: 1) Southcenter Parkway Extension South 180t Street to South 200t Street 2) Klickitat/Southcenter Parkway /I -5 Access Revision 3) South 144 Street Phase 2 As it relates to the Southcenter Parkway Extension project, staff is seeking construction costs. With a total construction amount of $13.5 million, the City seeks a grant amount of $4.5 million. Partnership dollars in the amount of $6 million are anticipated from Mario Segale. This is to be included in the Capital Improvement Plan of 2005. Relative to the Klickitat project, City staff has previously submitted a grant application which was unsuccessful. Seeking design monies in the amount of $1,649,640.00, staff will do preliminary design work and an alternatives analysis for capacity and safety in order to improve traffic flow on Southcenter Parkway, Klickitat Drive and Strander Boulevard. This grant requires no additional financial commitment from the City other than that which is already budgeted. Finally, the South 144 Street project (from 42n Avenue South to Tukwila International Boulevard) is the second half of the South 144 Street project. Since design has already begun, the City seeks $753,000.00 in grant funds for construction. It is the City's intent to construct curbs, gutters, sidewalks, bike lanes, pavement restoration, illumination, drainage and utility undergrounding from Military Road to 42t Avenue South. Mr. Morrow anticipates knowing whether or not the City is successful in its attempt for grants in November, 2004. Two projects will actually be in competition for funds Southcenter Parkway Extension and the Klickitat project. If both score highly, they can both be granted monies. Each must stand on its own merit. Further, the Public Works Director noted construction projects typically score higher than those which are in the design mode. Consensus existed for staff to apply for the grants. The item will be forwarded to the next meeting (consent agenda of 9 -7 -04) to formally approve submission of the grant applications. City of Tukwila Page 7 of 8 City Council Committee of Whole Minutes August 23, 2004 REPORTS: a. Mayor Mayor Mullet reported two finalists exist for the Finance Director position. He also reported an August 25 meeting in Issaquah with the King County Library Services Board of Directors. b. City Council Councilmember Duffie attended the August 21 Highway 99 Action Committee BBQ and first annual City of Tukwila Car Show. Mr. Duffie spoke in favor of recognizing the Committee and /or its representatives in some fashion at a future Council meeting. He spoke specifically of Hubert Crowley, retired City of Tukwila Fire Chief and Dwight McLean, for their efforts. Councilmember Hernandez attended the August 18 Suburban Cities Association Open House to meet the next Executive Director. On August 20, Councilmember Hernandez attended the memorial service for Ed Bauch, former City of Tukwila Mayor. Finally, the Councilmember reported attending the August 21 Highway 99 Action Committee BBQ and first annual City of Tukwila Car Show. Council President Haggerton attended the August 17 meeting of the Airport Communities Coalition. Councilmember Carter provided a written report on the August 17 SCATBd meeting and August 21 car show. Relative to the first annual City of Tukwila Car Show, trophies were awarded as follows: Best of Show Best Car Best Truck Best Motorcycle Mike West Joe Faccone David Myre Pam Carter 1933 Studebaker Rockne 10 1934 Ford Coupe 1919 Model T Ford Farm Truck 1986 Honda Goldwing Aspencade with Flexit Sidecar The car show was put on with minimal costs to the City. Ms. Carter handled the details and received support (financial or other) from the Sabey Corporation, Les Schwab, Tukwila Police Officer Ted Rutt, City of Tukwila Parks and Recreation, and City of Tukwila Department of Community Development. Ms. Carter looks forward to the 2005 event and would like to arrive at a formal name for the event. Councilmember Linder attended the August 18 Suburban Cities Association Open House event as well as the August 21 Highway 99 Action Committee BBQ and City of Tukwila Car Show. Councilmember Robertson had no report. Rather, he had two questions. He asked if the highway cameras were operational on Highway 99 and he asked for the operational status of the radar trailer. He asked for reports from City staff on both issues at the next Finance and Safety Committee meeting. Mayor Mullet reported the City's receipt of new cameras which are planned for mounting after trees are planted in the fall. Currently, however, the Mayor reported cameras are operational, yet unable to actually "take pictures Rhonda Berry, City Administrator, noted the radar trailer is operational and currently located on 160 Street. Discussion took place on placement of the trailer. Finally, Councilmember Robertson noted plans within his residential community to purchase and mount cameras for the safety of all neighbors. It is intended that as many as five families will contribute to the cost of the camera. Discussions are continuing between him and neighbors regarding the issue. Councilmember Fenton complimented Councilmember Carter on the first annual City of Tukwila Car Show. He also enjoyed the August 21 Highway 99 Action Committee BBQ.
