Contract Negotiations Per RCW 42.30.110(1)(g) 30 minutes Executive session began. Executive session ended. REGULAR MEETING MINUTES CALL TO ORDER /PLEDGE OF ALLEGIANCE: Calling the meeting to order and leading the Pledge of Allegiance at 7:00 p.m., was Steve Mullet, Mayor. ROLL CALL: Bob Baker, Deputy City Clerk, called the roll of Council. Present were Council President Jim Haggerton; and Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Pamela Linder, Dennis Robertson and Dave Fenton. OFFICIALS: Rhonda Berry, City Administrator; Shelley Kerslake, City Attorney; Bob Baker, Deputy City Clerk; Steve Lancaster, Director of Community Development; Bob Benedicto, Building Official; and Frank Iriarte, Deputy Director of Public Works. APPOINTMENT Eauitv Diversity Commission Bruce Linton Position #4, Term expires 07 -31 -06 (Reappointment) Unable to be present, Mr. Linton agreed to serve if re- appointed. HERNANDEZ MOVED; DUFFIE SECONDED; TO REAPPOINT BRUCE LINTON TO THE EQUITY AND DIVERSITY COMMISSION, POSITION #4, WITH A TERM TO EXPIRE 07- 31 -06. The motion carried 7 -0. CITIZEN COMMENT /CORRESPONDENCE: Ralph Danner, 6005 46 Avenue South, Tukwila. presented the Council with a petition in favor of action. Said petition reports deep concern "about the abuse of traffic laws on South 160 Street. The major abuse is speeding. Some drivers are also passing others, which is dangerous on a two -lane roadway. Speeders create not only a hazard to pedestrians and other vehicles but generate an unreasonable amount of noise at all times of the day and night. This is a residential area with a 25 mph speed limit. Definitive action needs to be taken to correct this problem." Of the 40 signatures received, 32 separate households are represented. Regardless of whether or not the Council will take action, Mr. Danner seeks a response to the petition. Mayor Mullet said the item would be sent to the Transportation Committee for consideration. He also informed Mr. Danner that staff is currently considering a traffic- calming program for use in some residential neighborhoods. Based on that, Councilmember Robertson asked the Mayor for a copy of the traffic calming program and a listing of related costs. The Mayor suggested it could be presented during the budget process in the coming months. Consensus existed for Public Works staff to prepare a budget item in connection with the traffic calming program. Peaav Van Ieperen. 13927 56 Avenue South, Tukwila. spoke of a rental house on her street which was recently "trashed inside and out." In recent history, owners of the home reported plans to clean the City of Tukwila Page 2 of 6 City Council Regular Meeting Minutes August 16, 2004 land and remodel the home. Those plans were never realized. Deplorable conditions exist (no water, power, hanging wires, etc.) and Ms. Van Ieperen believes someone is living in the home. Also a great problem to Ms. Van Ieperen is the fact a large truck has recently been parked in the yard with "garbage in the back." Kathy Stetson, Code Enforcement Officer, City of Tukwila, informed Council she is aware of the home of which Ms. Van Ieperen speaks. Further, Ms. Stetson provided a status update on the case. A remodel had begun without permits. A permit was then sought yet expired with insufficient information to process it. The property owner has now received a Notice of Pre Citation. To come into compliance and take appropriate action, the owner has until August 27, 2004. Heidi Waters. 3510 South 130 Street, Tukwila. spoke against the speeding which occurs on her street as well as the inherent dangers associated with it. Ms. Waters stated her belief that "money is an issue" with the City and has spoken with Robin Tischmak and Cyndy Knighton about the situation. Due to the cross traffic in her neighborhood, Ms. Waters spoke out of concern for the safety of (pedestrians) walkers. The citizen also made known her desire to keep the "charming character of the homes in Tukwila." To that end, she spoke in favor of lit streets coupled with associated undergrounding. Councilmembers complimented Ms. Waters for the efforts (her own and those of her neighbors) during the recent National Night Out. Many attended their Block Watch program outing that night and spoke highly of their efforts toward the event. CONSENT AGENDA: a. Approval of Minutes August 2, 2004 Regular Meeting. b. Approval of Vouchers 309459 309788, in the amount of $1,284,757.48. c. Authorize Mayor to sign a lease for Seattle Southside Visitors Services' new office space at 14220 Interurban Ave. South. d. Authorize Mayor to sign an Interlocal Agreement providing tourism and marketing services between Seattle Southside Visitors Services and the City of Kent. e. Accept as complete the Foster Golf Links Clubhouse, Pro Shop and Restaurant Project with Wade Perrow Construction, Inc.; and authorize release of retainage, subject to standard claim and lien release procedures (final project cost: $3,691,788.98). f. Accept turnover of street, storm detention vault, and public utilities improvements as part of the development of Sara Development (8 -Lot Short Plat) Value of transferred assets $158,888.00. DUFFIE MOVED; HERNANDEZ SECONDED; APPROVAL OF THE CONSENT AGENDA, AS PRESENTED. The motion carried 7 -0. UNFINISHED BUSINESS: a. A motion accenting the recommendations as identified in the Community Development Block Grant Proposal for 2005. and supporting the contingency plan regarding the King County Housina Repair Program Councilmember Linder reported review and approval of this item at the July 27, 2004 Community Affairs and Parks Committee meeting. She also reminded those present of a public hearing on August 9, 2004. There, one citizen comment was received from Anna Bernhard. LINDER MOVED; FENTON SECONDED; TO APPROVE THE RECOMMENDATIONS AS IDENTIFIED IN THE 2005 COMMUNITY DEVELOPMENT BLOCK GRANT PROPOSAL FOR 2005 AND SUPPORT THE CONTINGENCY PLAN REGARDING THE KING COUNTY HOUSING REPAIR PROGRAM.* City of Tukwila Page 3 of 6 City Council Regular Meeting Minutes August 16, 2004 Discussion: It was clarified that the contingency plan indicates increases or decreases come from the Housing Repair program. *Vote All ayes. b. An ordinance limiting parking on sinale familv residential property. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING REGULATIONS FOR VEHICLE PARKING AND STORAGE ON PROPERTY DEVOTED TO SINGLE FAMILY RESIDENTIAL USE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE DUFFIE MOVED; FENTON SECONDED; TO HAVE THE PROPOSED ORDINANCE READ BY TITLE ONLY. The motion carried 7 -0. Shelley Kerslake, City Attorney, read the title of the proposed ordinance. DUFFIE MOVED; FENTON SECONDED; TO ADOPT THE PROPOSED ORDINANCE AS PRESENTED.* Discussion: Discussion ensued regarding issues of need for flexibility in various portions of the ordinance at a later date; enforcement with common sense and due diligence; equal enforcement among all to improve visual impacts around the City; creation and distribution of educational flyers; (Council) receiving annual status updates (from City staff); and the real need for the content of the ordinance. Anna Bernhard. 14241 59 Avenue South, Tukwila, sought and received clarification to Section (c) of proposed Chapter 8.25.020. *Vote All ayes. APPROVED ORDINANCE #2056 c. An ordinance adoptino the 2003 International Property Maintenance Code AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING THE 2003 EDITION OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE; REPEALING ORDINANCE NO. 1593, CERTAIN SECTIONS OF ORDINANCE NO. 1837 REGARDING NUISANCES, ORDINANCE NO. 1838 SECTION 5, AND ORDINANCE NO. 1845; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE DUFFIE MOVED; FENTON SECONDED; TO HAVE THE PROPOSED ORDINANCE READ BY TITLE ONLY. DUFFIE MOVED; FENTON SECONDED; TO ADOPT THE PROPOSED ORDINANCE AS PRESENTED.* Discussion: Councilmember Linder reported this proposed ordinance has been reviewed several times and has been forwarded from the COW for action. Bob Benedicto, Building Official, is here to address Council concerns and inquiries. Discussion centered on process in Tukwila, versus that used in SeaTac, proper enforcement of the code(s), and clarification on those who approve various items within the code. It was noted the International Property Maintenance Code (IPMC) also provides the City with a mechanism to place liens on parcels of property that do not comply with its associated rules. City of Tukwila Page 4 of 6 City Council Regular Meeting Minutes August 16, 2004 Councilmember Duffie spoke of concerns surrounding the property located at 4644 South 148 Street. There, blackberries have covered the home. No electricity or water services the home, and it is believed that someone is occupying the home. This is another issue currently being handled by Kathy Stetson, Code Enforcement Officer. *Vote All ayes. APPROVED ORDINANCE #2057 d. An ordinance setting water connection fees for anv new development in the Duwamish neighborhood. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ESTABLISHING WATER CONNECTION FEES FOR THE DUWAMISH NEIGHBORHOOD; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE Councilmember Carter reported review of this proposed ordinance at a recent Utilities Committee meeting. As water, sewer, surface water and street improvements in the Duwamish neighborhood have been completed, water connection fees may now be set. CARTER MOVED; FENTON SECONDED; TO HAVE THE PROPOSED ORDINANCE READ BY TITLE ONLY. The motion carried 7 -0. Shelley Kerslake, City Attorney, read the title of the proposed ordinance. DUFFIE MOVED; LINDER SECONDED; TO ADOPT THE PROPOSED ORDINANCE AS PRESENTED.* Discussion: Construction costs of the project equaled $397,543. There are approximately 100 water connections possible in that neighborhood. This sets the initial connection fee at $3,975.44. Of the 100 mentioned, approximately 60 are pre- existing and need not pay the connection fee. Another (approximate) 40 are anticipated and will be charged the price reflected above. That fee, according to the proposed ordinance, will increase 1% per year, for 10 years, in accordance with RCW 35.92.025. Any new water connection should be assessed a proportionate connection charge, determined by the infrastructure construction cost and total number of potential connections. *Vote All ayes. APPROVED ORDINANCE #2058 REPORTS: a. Mayor Mayor Mullet reported a "first cut" of the 2005 budget. He informed Council that staff was being held to a 4% increase. He also attended an August 16 Shared Strategies meeting (a related, oversight group to WRIA 9). b. City Council Councilmember Joe Duffie raised an issue of great concern parking on Bremmer's Hill. Recently, cars have parked on both sides (going up and down) of the hill. He stated room does not allow for parked vehicles and those using the roadway. The Councilmember sought assistance from City staff. Shelley Kerslake, City Attorney, agreed to prepare an informational memorandum on the issue. City of Tukwila Page 5 of 6 City Council Regular Meeting Minutes August 16, 2004 Councilmember Joan Hernandez announced cancellation of today's Finance and Safety Committee meeting. She also noted an exchange between her husband and former Mayor Ed Bauch's wife, Ethel. Mrs. Bauch wanted to know if anyone had informed the Ikawa, Japan representatives of the passing of Mr. Bauch. Mayor Mullet responded in the affirmative. Council President Jim Haggerton attended the August 12 Finance Committee meeting of the Cascade Water Alliance. The Council President then spoke briefly about Council's desire for a neighborhood "get together" (informal meeting). Councilmember Duffie volunteered to make arrangements with Tukwila Elementary School officials if the desire still exists. No formal agenda is proposed. It is a "mix with neighbors" session to find out what Council can do to help community members. More discussion will follow. Councilmember Pam Carter raised the issue of a potential lunch date with area legislators. This is a project on which Lucy Lauterbach is working. At this time, no alternate date certain has been selected to replace that of the date that conflicts with the funeral date of former Tukwila Mayor Ed Bauch (August 20). It was suggested that a breakfast meeting might be held instead of a lunch meeting if that works better with everyone's schedule. More information will follow. Ms. Carter attended last Wednesday's Concert in the Park. She spoke favorably of the event and its location. With a very accessible location the series was attended by a wide variety of music lovers. Councilmember Pam Linder attended the Highway 99 Action Committee meeting on August 10. She reported that in nine years, the Committee has collected over 14,000 pounds of trash. Councilmember Dennis Robertson attended the August 12 WRIA 9 Steering Committee meeting. Councilmember Dave Fenton had no report. c. Staff City Administrator Rhonda Berry sought clarification from Councilmember Fenton for a proposed meeting issue. The Councilmember noted his desire for King County Animal Control officers to attend a Finance and Safety Committee meeting to discuss vicious dogs in residential neighborhoods of Tukwila. d. City Attorney City Attorney Shelley Kerslake had no report. e. Legislative Analyst Legislative Analyst Lucy Lauterbach was not present. MISCELLANEOUS: Councilmember Fenton sought a response (from Council) in connection with a proposed team building session for all members on the City Council. He also volunteered to facilitate the session and provide a meal from personal funds (versus City dollars). Considerable discussion took place and each Councilmember expressed their viewpoint on the proposed session /meeting. In the end, consensus did not exist to schedule and /or hold such a session. Councilmember Hernandez reported receipt of a telephone call from a community member earlier today. That person reportedly received a telephone call from a member of the Tukwila City Council seeking support of a petition approving Tukwila Village. Mrs. Hernandez asked what would motivate such an action. No comment was received and no further discussion took place.
