SPECIAL MEETING MINUTES
CALL TO ORDER/PLEDGE OF ALLEGIANCE:
Steven M. Mullet, Mayor, called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance.
ROLL CALL:
Bob Baker, Deputy City Clerk, called the roll of Council. Present were Jim Haggerton, Council President;
and Joe Duffie, Joan Hernandez, Pam Carter, Pamela Linder, Dennis Robertson and Dave Fenton,
Councilmembers.
Rhonda Berry, City Administrator; Shelley Kerslake, City Attorney; Bob Baker, Deputy City Clerk; Lucy
Lauterbach, Legislative Analyst; Jim Morrow, Public Works Director; Brian Shelton, City Engineer; Steve
Lancaster, Community Development Director; Jack Pace, Deputy Director of Community Development;
Nora Gierloff, Planning Supervisor, Community Development; Nick Olivas, Chief of Fire; and Don
Tomaso, Fire Marshal.
CITIZEN COMMENT /CORRESPONDENCE: None.
a. Approval of minutes September 7, 2004 (Regular meeting)
b. Accept as complete the Sewer Lift Station No. 12 Pump Upgrade and Generator Project
with Gary Harper Construction, Inc.; authorize release of retainage subject to the
standard claim and lien release procedures (final cost of project; $217,726.67).
DUFFIE MOVED; HERNANDEZ SECONDED; TO APPROVE THE CONSENT AGENDA AS
PRESENTED. The motion carried 7 -0.
UNFINISHED BUSINESS:
Sound Transit Issues (continued from 9/7/04 Regular meeting).
Council Deliberation:
a. L03 -057, L03 -058 L03 -060; Unclassified Use Permit, Shoreline Variance and Design
Review (quasi judicial)
b. Proposed ordinance authorizing Mayor to execute a Development and Transit Way
Agreement (legislative)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
AUTHORIZING THE MAYOR TO EXECUTE A DEVELOPMENT AND TRANSIT WAY
AGREEMENT WITH SOUND TRANSIT FOR DEVELOPMENT OF THE TUKWILA
FREEWAY ROUTE PROJECT, AND TO ALLOW THE NON EXCLUSIVE USE OF
CERTAIN AREAS OF THE PUBLIC RIGHTS -OF -WAY; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
Much debate and deliberation occurred. As a result, four motions were made (and appear within these
minutes). A verbatim transcript was create by Gayle Hays, a Court Reporter from Byers Anderson,

Inc., and will be provided upon completion. Ms. Hays anticipates a completion date of Monday,
September 20, 2004.

ROBERTSON MOVED; HAGGERTON SECONDED; TO DIRECT STAFF TO PREPARE A FINDING
FOR THE UNCLASSIFIED USE PERMIT STATING NOISE BARRIERS ARE REQUIRED FOR ALL
NOISE IMPACTED RESIDENTIAL PROPERTIES ALONG THE LINK LIGHT RAIL PATH. The motion
carried 7 -0.
Motion #2
LINDER MOVED; DUFFIE SECONDED; TO DIRECT STAFF TO PREPARE A FINDING TO REQUIRE
ADEQUATE SCREENING TO VISIBLE DETENTION PONDS, FROM, AND ADJACENT TO
RESIDENTIAL AREAS, WITH A SIX -FOOT FENCE, SO THE SCREENING IS UP TO THE SIX -FOOT
FENCE ALL YEAR LONG, ALONG THE LINK LIGHT RAIL PATH. The motion carried 7 -0.
Motion #3
CARTER MOVED; ROBERTSON SECONDED; TO DIRECT STAFF TO PREPARE A FINDING TO
REQUIRE MONITORING THE NOISE AND VIBRATION FOR A PERIOD OF THREE YEARS TO
DETERMINE ADEQUATE WAYS AND MEANS TO MITIGATE IT, IF THEY EXCEED ANTICIPATED
NUMBERS. The motion carried 7 -0.
Motion #4
LINDER MOVED; CARTER SECONDED; TO DIRECT STAFF TO PREPARE A FINDING TO REQUIRE
A MECHANISM FOR EVALUATING THE SECURITY AT THE 154 STREET STATION, TRAINS AND
GUIDEWAY, AND A PROCESS FOR REMEDY OR MITIGATION, IF REQUIRED. (INFORMATION
FROM SOUND TRANSIT SECURITY TO TUKWILA POLICE AND BACK IN TERM OF ISSUE
RESOLVING SUGGESTIONS). The motion carried 7 -0.
CONSENSUS EXISTED FOR STAFF TO PREPARE FINDINGS OF FACT AND CONCLUSIONS OF
LAW, AND RETURN ON SEPTEMBER 20, 2004, WITH IT. AT THE SAME MEETING, COUNCIL WILL
CONSIDER A MOTION TO ADOPT THE PROPOSED, RELATED ORDINANCE, WHICH AUTHORIZES
THE MAYOR TO EXECUTE A DEVELOPMENT AND TRANSIT WAY AGREEMENT.
8:51 p.m. HERNANDEZ MOVED; DUFFIE SECONDED; TO TAKE A RECESS. The motion
carried 7 -0.
9:08 p.m. Mayor Mullet reconvened the meeting.
REPORTS:
a. Mayor
Mayor Mullet reported continued efforts on the proposed 2005 budget. Maintenance and operations
portions should be complete within one week, and the Capital Improvement Plan will soon follow.
Mayor Mullet also reported nearly completed progress on the hiring of a new Finance Director.
Continued discussions and negotiations must take place before the candidate can accept or reject the
position.

b. Council
Councilmember Joe Duffie reported ongoing discussions with Tukwila Police regarding excessive
speeding in area neighborhoods. Additionally, he cautioned all present to "watch for children" as school
is once again in session.
Councilmember Joan Hernandez reported attendance to the September 8 Washington State
Consolidated Plan for Priorities and Goals relative to Affordable Housing. She also attended the
September 9 Tourism workshop and September 13 Transportation Committee meeting.
Council President Jim Haggerton attended the September 7 Tukwila Governmental Affairs meeting; and
the September 9 Cascade Water Alliance Special meeting of the Finance Committee. He then reported
on intended attendance to future meetings which will be reported post occurrence.
Councilmember Pam Carter reported attendance to the August 26 Association of Washington Cities
(AWC) Streamlined Sales Tax meeting and the September 9 Transportation Policy Board meeting.
Councilmember Pamela Linder reported attendance to the September 9 South King County Human
Services Forum. She then reported on intended attendance to future meetings which will be reported
post occurrence.
Councilmember Dennis Robertson spoke of a serious animal control issue in his immediate
neighborhood. Three reports (of pit bulls out of control) have been filed with appropriate King County
staff and action is yet to be taken.
Mr. Robertson then spoke of an AWC- sponsored class on budget preparation and budget preparedness.
Based on course content and experience, the Councilmember suggested the entire Council participate in
the same training. A brief discussion was held and additional information will be sought and delivered.
Based upon review of information received, a decision will be made as to whether or not to proceed with
the proposed workshop.
Councilmember David Fenton attended the September 7 Finance and Safety Committee meeting.
City Administrator Rhonda Berry had no report.
d. Legislative Analyst
Lucy Lauterbach reminded Council that the Ikawa delegation would arrive on Saturday, September 18.
MISCELLANEOUS:
Council President Haggerton expressed concern with proposed artwork for the proposed Link Light Rail
Station at 154' Street. He suggested Council should receive advanced notice as to what the City's Art
Commission is doing, and that it is his understanding they are somewhat involved in proposed artwork for
the station.
JoAnne McManus, community member, praised recent work of the Tukwila Fire Department.
Responding to a (confirmed) gas leak in her neighborhood last weekend, Tukwila Firefighters were able
to cap the leak until Puget Sound Energy personnel arrived on scene. The part of the story Ms.
McManus felt strongly about however was praising the firefighters who made a special provision for a
little boy (at the site of the leak) who nearly died twice and required a bone marrow transplant to survive.
Hearing the little boy's story, firefighters allowed the boy to board the truck and take a ride to the end of
the driveway. Ms. McManus noted the little boy would never forget the experience.
