PROCLAMATION
WHEREAS, an average of 700 people die in boating-related accidents each
year in the United States; nearly 70 percent of these are fatalities caused by
drowning; and
WHEREAS, the vast majority of these accidents are caused by human error
or poor judgment, and not by the boat, equipment, or environmental factors; and
WHEREAS, a significant number of boaters who lose their lives by
drowning each year would be alive today had they worn their life jackets; and
WHEREAS, modern life jackets are more comfortable, more attractive, and
more wearable than styles of years past and deserve a fresh look by today's
boating public;
NOW, THEREFORE, I, Steven M. Mullet, Mayor of the City of Tukwila, do
hereby proclaim May 21-27, 2005:
National Safe Boating Week
in the City of Tukwila, and I urge all citizens who boat to "Boat Smart. Boat Safe.
Wear it." and practice safe boating habits.

ISSUE
Accept construction contract as complete and authorize release of retainage in the amount of
$11,030.07.
BACKGROUND
The Notice to Proceed for Contract No. 04-080 with Western Engineering Constructors, Inc.,
of Seattle, Washington, was issued on September 20, 2004, for the construction of Project No.
03-DR04. The project upgraded the stormwater pump station at Fort Dent, which was
discovered to be in disrepair and without sufficient capacity.
This contract was completed on December 31, 2004. Additions included reinforcing the grass
near the pump station to allow Public Works maintenance vehicle access without destroying the
park lawn. Closeout paperwork has been completed and verified, and the project is now ready
for final acceptance.

1. W ater~ Power~ and Gas for Tukwila Vallev South Ji~ said there is a very tight time frame
if the City is to design the 'water system for La Pianta. Highline Water Service serves the
Tukwila Valley South area, but they do not have the capacity to design the system in-house.
Highline's policy is for the developer to pay the costs of the design and construction of a new
water system. The water pipe systeql needs to be designed with the other pipes (sewer and
surface water) in the public right-of-way. Puget Sound Energy is dealing with La Pianta
separately, though if their lines need to be sited in the right-of-way those lines will need to be
coordinated also. The cost of designing the \vater line is $70,000 to be added to the David Evans
contract. Committee members asked if Evans is able to compete the work by November, 2005
and were told he can.
Funding for the water design and construction is still undecided. It may be a combination of La
Pianta, Tukwila, and Highline. La Pianta wants the city to fund the water through grants and
bonds. Highline will share in the cost of the major spine running do\vn the Southcenter
extension, because the new pipe is a replacement for the pipe in the current road. Highline thinks
the difference in the cost between the size of their current pipe and the cost of the new larger
pipe should be paid by La Pianta. La Pianta wants the cost to be paid by city grants and bonds.
The discussions about who pays ho\v much will continue. The design by David Evans will
proceed to COW and Regular Meetings. Recommend desien bv David Evans for $70~OOO to

2. Fort Dent Stormwater Pump Station #19 and Drainaee The pump station at Fort Dent
was found to be undersized, in poor condition, and unable to completely pump the stonn water.
Staff awarded a contract to Western Engineering Constructors to upgrade the pump station and
install a compatible control panel and related equipment. Added work included grass crete to
prevent maintenance vehicles ITom sinking into the soft grass between the pump station and the
parking lot. It was a successful project, done by a good contractor. All runoff from Fort Dent
goes to tbe pond, and the pump station then pumps it into the river. Recommend contrllct
acceptance and release of retaina2e to consent a2enda of a Re2ular Meetin2.
3. 420d Ave. Brid2e Repair Last year this bridge had an erosion problem that was due to
surface water runoff. That was repaired, and now a ne\v and serious problem has emerged. Due
to the bridge being on a turn of the river where there is an eddy swirling at the bridge supports,
dirt has eroded around the supports. After studying the problem, staff detenmned that a proper
repair would be to install sheet piling. Funds are available in the bridge program to do the work.
Staffwill hire a contractor and get emergency exemptions from Fish and Wildlife and SEP A
Shoreline requirements. Dave said the pictures in the packet told the story of how badly the
repair was needed. Recommend emen!encv declaration to COW and Re2ular Council for
approval.

ISSUE
Vacation of a portion of 35th Avenue South to accommodate the Tukwila Station related to the
Sound Transit Central Link Light Rail Tukwila Freeway Route Project.
BACKGROUND
This is one of seven vacations related to the Link: Light rail Project. At the Public Hearing on
April 4, 2005 several questions/issues arose. These questions were addressed by the Committee
of the Whole on April 25, 2005. The Committee of Whole agreed to send this vacation to the
Regular Council Meeting for approval.
ANALYSIS
This portion of 35th Av. S. lies south of S. 154th St. and north ofSR-518, between Sound Transit
property and WashDOT right-of-way. The proposed vacation limits include the cul-de-sac bulb.
There is approximately 23,891 square feet of concrete and asphalt paved right-of-way.
Since April 25, 2005, Sound Transit has completed a lot consolidation. No land-locked parcels
will be created by this vacation.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the vacation ordinance.

TUKWILA, WASHINGTON, VACATING CERTAIN PROPERTY
LOCATED WITHIN THE CITY, DEDICATED FOR STREET
PURPOSES, GENEMLL Y DESCRIBED AS 35th AVENUE SOUTH,
RUNNING SOUTHWESTERLY FROM SOUTHCENTER BOULEVARD
(SOUTH 154TH STREET) FOR APPROXIMATELY 354 FEET,
INCLUDING THE PARTIAL CUL-DE-SAC BULB; AMENDING THE
OFFICIAL STREET MAP OF THE CITY; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit Way Agreement for Sound Transit Central Link Light Rail Tukwila Freeway Route
Project on December 8, 2004; and
WHEREAS, TMC 11.60 identifies street vacation procedures including public notification,
a public hearing, review and comment, and submittal of relevant information to City Council,
all of which have been done; and
WHEREAS, Sound Transit Link Light Rail proposes a station at this location; and
WHEREAS, 35th A venue South has been right-of-way for more than 25 years; and
WHEREAS, Sound Transit provided a real property appraisal from a member of the
American Institute of Real Estate Appraisers in the amount of $446,088.00; and
WHEREAS, utilities exist in the right-of-way being vacated; and
WHEREAS, the City of Tukwila City Council conducted a public hearing on April 4, 2005
for the purpose of considering the vacation of certain property located in the City of Tukwila,
as described in the ordinance title; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to certain conditions;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vacated:

Approximately 23,891 square feet of 35th ~ venue South, running southwesterly
from Southcenter Boulevard (South 154th Street) for approximately 35 feet, including the
partial cul-de-sac bulb.

B. This vacation is conditioned upon satisfaction, by April 30, 2007, of the following:
1. Provision of compensation for $446,088.00.

3. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development and
Transit Way Agreement referenced herein.
Section 2. Duties of Public Works. The Public vVorks Department is hereby directed to
record a certified copy of this ordinance with King County, upon determination by the Public
Works Director that the conditions referenced above have been satisfied.
Section 3. Amendment of Official Street Map. Upon the recording of a certified copy of
the ordinance, the City Public "Yorks Director shall amend the City's official street map to be
consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City. This vacation shall not become effective until the conditions
contained herein have been fully satisfied, until all fees owed the City have been paid, and
until five (5) working days after the date that this ordinance and all relevant documents have
been recorded with King County Records.

ISSUE
Vacation of a portion of 48th Avenue South to accommodate the Sound Transit Central Link

BACKGROUND
This is one of seven vacations related to the Link Light rail Project. At the Public Hearing on
April 4, 2005 several questions/issues arose. These questions were addressed by the Committee
of the Whole on April 25, 2005. The Committee of Whole agreed to send this vacation to the
Regular Council Meeting for approval.
ANALYSIS
The proposed vacation limits along 48th Avenue South run westerly from SR-599 for
approximately 165 feet (measured along the centerline). These limits represent the area of right-
of-way the City no longer needs. This right-of-way is fully paved.
The westerly portion, running approximately 95 feet along the centerline, will not be vacated.
A Draft ordinance is attached for revie\v and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the vacation ordinance.

WHEREAS, 48th Avenue South has been right-of-way for more than 25 years; and
WHEREAS, Sound Transit provided a real property appraisal from a member of the
American Institute of Real Estate Appraisers in the amount of $8.12/square foot of right-of-
way; and
WHEREAS, utilities exist in the right-of-way being vacated; and
WHEREAS, the City of Tukwila City Council conducted a public hearing on April 4, 2005
for the purpose of considering the vacation of certain property located in the City of Tukwila,
as described in the ordinance title; and
WHEREAS, commercial trucks currently use the westerly portion of 48th Avenue South
as a turn-around; and
WHEREAS, following conclusion of the public hearing, the City Council found the
property should be vacated, subject to certain conditions;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vac,\ted:
Approximately 6,600 square feet of 48th Avenue South, m:r;ming northeasterly from
South 134th Place to the Interstate 5 on-ramp at State Route 599.

B. As Sound Transit owns all lots that will be land-locked, Council waives a provision for
access easement(s).
C. This vacation is conditioned upon sahsfaction, by April 30, 2007, of the following:

3. Provision of easement(s) to Sound Transit for construction, operatIOn and
mamtenance of the Tukwila Freeway Route Project consistent with the Development and

record a certified copy of this ordinance with King County, upon determination by the Public
Works Director that the conditions referenced above have been satisfied.
Section 3. Amendment of Official Street Map. Upon the recording of a certified copy of
the ordinance, the City Public Works Director shall amend the City's official street map to be
consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City. This vacation shall not become effective until the conditions
contained herein have been fully satisfied, until all fees owed the City have been paid, and
until five (5) working days after the date that this ordinance and all relevant documents have
been recorded with King County Records.

ISSUE
Vacation of a portion of 47th Avenue South to accommodate the Sound Transit Central Link
Light Rail Tukwila Freeway Route Project.
BACKGROUND
This is one of seven vacations related to the Link Light rail Project. At the Public Hearing on
April 4, 2005 several questions/issues arose. These questions were addressed by the Committee
of the Whole on April 25, 2005. The Committee of Whole agreed to send this vacation to the
Regular Council Meeting for approval.
ANALYSIS
The proposed vacation limits run the full length of the 4ih Av. S., situated between S. 134th
PI. and SR-599. These limits represent the area of right-of-way the City no longer needs.
The right-of-way surface consists of gravel currently used for parking, approximately ten feet of
paving and a ditch.
This vacation will create at least one land-locked parcel. Access to these parcels will be
provided by an access easement over the westerly end of 47th Av. S.
The existing building on the Tukwila Property LLC lot does not have required fire access to the
back of the building. This vacation will allow installation of the fITe access to meet fire code.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the vacation ordinance.

WHEREAS, 47th Avenue South has been right-of-way for more than 25 years; and
WHEREAS, Sound Transit provided a real property appraisal from a member of the

approximately 310 feet, from South 134th Place to the Washington Department of
Transportation right-of-way.

AMENDING THE OFFICIAL STREET MAP OF THE CITY; PROVIDING
FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila and Sound Transit executed the Development and
Transit Way Agreement for Sound Transit Central Link Light Rail Tukwila Freeway Route
Project on December 8, 2004; and
WHEREAS, TMC 11.60 identifies street vacation procedures including public notification,
a public hearing, review and comment, and submittal of relevant Information to City Council,
all of which have been done; and
WHEREAS, South 146th Street has been unopened right-of-way for more than 25 years;
and
WHEREAS, Sound Transit provided a real property appraisal from a member of the
American Institute of Real Estate Appraisers in the amount of $73,635.00; and
WHEREAS, there is a utility in the right-of-way being vacated; and
WHEREAS, the vacation of South 146th Street will not create land-locked lots of record;
and
WHEREAS, the City of Tukwila City Council conducted a public hearing on April 4, 2005
for the purpose of considering the vacation of certain property located in the City of Tukwila,
as described in the ordinance title; and
WHEREAS, following conclusion of the public hearing, the City Council has found the
property should be vacated, subject to certain conditions;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The foHowing property located In the City of Tukwila is hereby vac,\ted:
Approximately 8,860 square feet of South 146th Street, running southeasterly for
approximately 222 feet, from 51st Avenue South to Interstate 5 right-of-way.

B. This vacation is conditioned upon satisfaction, by April 30, 2007, of the following:
1. Provision of compensation for $73,635.00.

3. Provision of easement(s) to Sound Transit for construction, operation and
maintenance of the Tukwila Freeway Route Project consistent with the Development and
Transit Way Agreement referenced herein.
Section 2. Duties of Public Works. The Public Works Department is hereby directed to
record a certified copy of this ordinance with King County, upon determination by the Public
Works Director that the conditions referenced above have been satisfied.
Section 3. Amendment of Official Street Map. Upon the recording of a certified copy of
the ordinance, the City Public Works Director shall amend the City's official street map to be
consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City. This vacation shall not become effective until the conditions
contained herein have been fully satisfied, until all fees owed the City have been paid, and
until five (5) working days after the date that this ordinance and all relevant documents have
been recorded with King County Records.

ISSUE
Vacation of a portion of South 133rd Street to accommodate the Sound Transit Central Link
Light Rail Tukwila Freeway Route Project.
BACKGROUND
This is one of seven vacations related to the Link Light rail Project. At the Public Hearing on
April 4, 2005, several questions/issues arose. These questions were addressed by the Committee
of the Whole on April 25, 2005. The Committee of Whole agreed to send this vacation to the
Regular Council Meeting for approval.
ANALYSIS
This portion of S. 133rd Street lies between SR-599 and private property (previously vacated
portion ofS 133rd Street). There is an existing 10' access easement and an existing 60' utility
easement in the previously vacated portion ofS 133rd Street lying to the west. This right-of-way
is not used for public access. The vacation limits represent the area of right-of-way the City no
longer needs.
This right-of-way is fully paved and is currently used by Farwest Paints to maneuver trucks onto
a ramp.
A Draft ordinance is attached for review and comment. A vacation is not complete until all of
the conditions are met.
RECOMMENDATION
Approve the vacation ordinance.

A RESOLUTION OF THE CITY COUNCIL OF- THE CITY OF TUKWJLA,
WASHINGTON, DECLARING AN EMERGENCY IN RESPONSE TO
DAMAGES TO PUBLIC PROPERTY DUE TO EROSION.
WHEREAS, it has been determined that significant erosion has occurred at the
northwest comer of the 42nd Avenue South bridge approach; and
WHEREAS, the erosion has resulted in significant loss of roadway and structural
support; and
WHEREAS, the repairs to the roadway and bridge abutment are required immediately;
and
WHEREAS, RCW 39.04.280 provides for emergency declarations and competitIve
bidding exemptions; and
WHEREAS, the Mayor of Tukwila has declared an emergency in order to allow CIty
forces to respond with appropriate resources to restore damage and prevent further impact to
public and private property; and
WHEREAS, the CIty Council wishes to provide their support and endorsement of the
Mayor in his action to declare an emergency and for the City's efforts to respond to the
emergency;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWJLA,
WASHINGTON, HEREBY RESOL YES AS FOLLOWS:
The City Council supports the Mayor in his declaration of emergency, due to damages
and the need for protective actions brought about by erosion, and hereby authorizes City
resources to respond in the manner which is most effernve and expedient, without regard for
the procedures and formalities which would otherwise govern the assignment of duties,
procurement of materials, and contracting of servIces. This situation is an emergency as
defined in RCW 39.04.280(3).

SPONSOR'S In 2004, the City of Seattle approached Tukwila with an offer to pave the Tukwila portion
SUMMARY of 16 Ave S using the City of Seattle asphalt paving crew for a fixed cost of $45,000. The
Interlocal Agreement defines the responsibilities of each jurisdiction. This portion of the
roadway was scheduled for overlay in 2004 but was delayed due to the proposal. Our
preliminary cost estimate for the overlay was $62,639, so we will save over $17,639, to be
used for the 2005 Overlay and Repair Program.
