(see attached map). BACKGROUND On July 20, 200S, the Sabey Corporation submitted a complete Petition for Vacation of Streets application for South 124th Street from East Marginal Way South to the Intergate East property near 3Sth Avenue South. On August lS, 200S, Council set the Public Hearing date for September 19, 200S by Resolution 1584. This date meets RCW 3S.79.010 and notification of the Public Hearing was given according to TMC 11.60.090 DISCUSSION Sabey Corporation owns all properties on both sides of South 124th St. Currently South 124th Street is used for access to the Group Health Building, the Swift Trucking site and Intergate East Business Park. The zoning is a combination Manufacturing Industrial Center - Heavy and Light. Sabey Corporation has provided a real property appraisal from a member of the American Institute of Real Estate Appraisers and the appraisal established the value of the property at $430,000. The following public utilities exist and easements will have to be granted or the utilities relocated for; Tukwila storm main, Seattle City Light, Puget Sound Energy, Val Vue Sewer District, Water District #12S, Qwest, Comcast, and private fiber optic conduits. If the petition is granted, the Sabey Corporation will be required to post "Private Street" signs and will be responsible for existing streetlights on South 124th Street and 3Sth Ave South and all roadway maintenance. This vacation would not adversely affect street patterns, circulation, or public need. The City currently does not need this right-of-way and will not need it in the future. RCW 35.79 Street Vacation 8 Council Minutes of August 15, 2005, Meeting Setting Public Hearing Staff Report to the Tukwila City Council August18,2005 FINDINGS VICINITY/SITE INFORMATION Proiect Description The area of South 124th Street from the west margin of East Marginal Way West to its terminus at the Intergate East property located near 35th Avenue South approximately 695 feet would be vacated by the 'City of Tukwila and sold to the Sabey Corporation. The Sabey Corporation owns all the properties on both sides of South 124th Street west of East Marginal Way. The vacated right-of-way for South 124th Street will be incorporated into the Sabey Corporation existing properties abutting South 124th Street. Existinq Development On the south side of South 124th Street are the A and 8 Group Health buildings constructed in 2000 and 2001 by the Sabey Corporation. To the east on the east side of East Marginal Way is the Group Health Administration and parking buildings. To the north of South 124th Street is the former Swift Trucking site and to the west is Intergate East properties. 80th properties are owned by the Sabey Corporation. Surroundinq Land Use To the north and west of South 124th Street the zoning is MIC-Heavy. To the south of South 124th Street and across East Marginal Way the zoning is MIC-Light. Terrain & Veqetation The existing roadway is almost flat. There is existing curb, gutter, and sidewalk on the south side of South 124th Street with a gravel shoulder on the north side of the side street. Ve~etation is mainly landscaping of Group Health buildings on the south side of South 124t Street. Public Facilities Notice of Petition and field reconnaissance have identified the presence of the following utilities: Tukwila public storm main, Seattle City Light for electricity, Puget Sound Energy for gas, Qwest Telecommunications, Val Vue Sewer District for sanitary sewer, Water District #125 for water and fiber optic conduits in the street. BACKGROUND At the present time South 124th Street is used for access to the Group Health building, the Swift Trucking site and Intergate East Business Park. A petition for the vacation of South 124th Street was filed with the City on July 20, 2005, (See Tab #3). At the City Council meeting on August 15, 2005, Resolution No. 1584 was adopted to set the date of September 19, 2005, for a Pubic Hearing to consider the proposed vacation (see Tab #4). Following the adoption of Resolution No.1584, City staff posted the site of the proposed street vacation and notified property owners in the immediate vicinity regarding the Public Hearing and pending petition. A sample notice letter is provided under Tab #6. Notices of Petition for Vacation of Street were also sent to all potentially affected City departments and other non-city utilities. The responses received thus far to these Notices are included under Tab #5. DECISION CRITERIA The procedures for street vacation are set forth in RCW 35.79.010 and reiterated in TMC 11.60 (see Tab #QJ. Except in those cases involving right-of-way adjacent to a body of water, there are no defined criteria for deciding whether or not to grant a street vacation. In the absence of defined criteria, the City Council must consider the public interest relative to the existing and future needs for public facilities such as utilities or roadway improvements on the proposed vacation area. All street vacations granted to private property owners must include compensation to the granting jurisdiction for the vacated property. The compensation is presented as a condition to granting the vacation. The City Council's options in deciding on a proposed street vacation are limited to the following: 1. deny the proposed street vacation, or 2. grant the street vacation with conditions (at the very least, conditions must include compensation to the City for the vacated property). CONCLUSIONS 1. Public utilities exist in the area proposed for vacation. There are two options available: The utilities can remain in place and the applicant may grant access to them by use of an easement, or the utilities can be relocated at the petitioner's expense. 2. The proposed vacation is not adjacent to a body of water. SUMMARY Should council decide in favor of the vacation request, it is recommended that the following condition be included' 1. The existing utilities in the area of proposed vacation should either remain in place with an easement provided to the respective utility or be relocated at the petitioner's expense. 2. Vacation. A. The following property located in the City of Tukwila is hereby vacated. Approximately 47,341 square feet of South 1241h Street, running westerly from East Marginal Way South to previously vacated 35th Avenue South, as shown on Exhibit A attached. B This vacation is conditioned upon satisfaction, by October 1, 2007, of the following: 1. Provision of compensation for $430,000.00. 2. The complete application shall include a completed petition form, a vicinity map, a tax assessor's map showing all properties abutting the vacation, total of assessed land value proposed for vacation, an appraisal per TMC 11 60050, mailing labels for all property owners within 500 feet of the vacation boundaries, and a non-refundable application fee pursuant to TMC 11 60 040 B. A completed petition form shall be one that is signed by owners of more than two-thirds of the properties abutting the street proposed for vacation. C If the assessed value of the land proposed for vacation is greater than $10,000. the complete applica- tion shall include a fair market appraisal. D The petition and application expire two years from date of application, if the vacation conditions have not been met and compensation paid. (Ord. 1995 &1 (part), 2002) 11.60.040 Fees and Charges The Department shall be responsible for review of the petition, inspection and acceptance of all required construction, and vacation plan review. The fee for these services shall be set forth in a fee schedule to be adopted by motion or resolution of the City Council. (Ord. 1995 J 1 (part), 2002) 11.60.050 Valuation and Compensation A The value of the right-of-way proposed for vacation shall be determined utilizing either of two methods. First, based on the assessed value of land abutting the street or. second, on an appraisal which was conducted no more than 3 months prior to the date of the application for vacation Under the first method, the value shall be calculated by multiplying the total square footage of right-of-way by the assessed value per square foot of the abutting land, as set by the County Department of Records and Elections and the County Assessor's office. Under the second method of calculation, a real property appraisal from a member of the American Institute of Real Estate Appraisers will be conducted. B. If the calculated value is less than $10,00000, the calculated value shall be used as the right-of-way value. If the calculated value is $10,000 or more. then the right-of-way value shall be set under the second method above C. Compensation shall be one-half of the valua- tion, except any part of the right-of-way that has been part of a dedicated right-of-way for 25 years or more shall be compensated at the full valuation. D. One-half of the revenue received by the City as compensation must be dedicated to the acquisition, improvement, development and related maintenance of public open space or transportation capital projects within the City (Ord. 1995 &1 (part), 2002) 11.60.060 Property Trade in Lieu of Payment The petitioners may grant or dedicate to the City, for street or other purposes, real property which has a fair market value. set by an appraisal less than three months old. at least equal to the compensation value set in TMC 11 60 050 (Ord. 1995 J 1 (part), 2002) 11.60.070 Waiving Compensation - Other Governmental Agencies For a vacation petitioned by another governmental agency, the City Council may waive compensation required by this code and may waive the filing fee, if the Council determines the waiver is in the public interest. In this case, the petitioner shall record a covenant at King County Records that provides the City compensation by the current fair market value, for future sale or lease by the governmental agency of the vacated property (Ord. 1995 J 1 (part), 2002) 11-38 Printed January 14, 2003 TITLE 11 - RIGHT OF WAY USE 11.60.080 Title to Vacated Street The title to the vacated street shall be granted equally to abutting property owners. (Ord. 1995 31 (part), 2002) 11.60.090 Procedure Once the Department receives a complete application, the Department shall. 1 Propose a resolution to the City Council fIxing a time, pursuant to RCW 35.79010, when the matter will be heard. 2. Forward the petition and resolution to all City departments and all concerned utilities for review and comment. 3. Post on-site notification of the public hearing per RCW 35.79 020. \ 4. Provide notifIcation of the public hearing to all property owners within 500 feet of the right-of-way proposed for vacation. 5. Provide the City Council all relevant information for decision deliberations during the public hearing. (Ord. 1995 31 (part), 2002) 11.60.100 Limitations on Vacation The vacation shall meet limitations on vacations spelled out in RCW 3579030 and RCW 35.79 035, and shall not prevent legal access to public right-of-way for any existing lot. (Ord. 1995 31 (part), 2002) 11.60.110 Approval of Vacation If the City Council approves all or part of a proposed vacation, it shall, by ordinance, vacate the property pursuant to RCW 35 79030. The ordinance shall contain the valuation and compensation amounts, and all conditions that shall be met before the vacation is effective. The said notice shall contain a statement that a petition has been filed to vacate the street or alley described in the notice, together with a statement of the time and place fixed for the hearing of the petition. In all cases where the proceeding is initiated by resolution of the city or town councilor similar legislative authority without a petition having been signed by the owners of more than two-thirds of the property abutting upon the part of the street or alley sought to be vacated, in addition to the notice hereinabove required, there shall be given by mail at least fifteen days before the date fixed for the hearing, a similar notice to the owners or reputed owners of all lots, tracts or parcels of land or other property abutting upon any street or alley or any part thereof sought to be vacated, as shown on the rolls of the county treasurer, directed to the address thereon shown: PROVIDED, That if fifty percent of the abutting property owners file written objection to the proposed vacation with the clerk, prior to the time of hearing, the city shall be prohibited from proceeding with the resolution. (1) A city or town shall not vacate a street or alley if any portion of the street or alley abuts a body of fresh or salt water unless: (a) The vacation is sought to enable the city or town to acquire the property for port purposes, beach or water access purposes, boat moorage or launching sites, park, public view, recreation, or educational purposes, or other public uses; (b) The city or town, by resolution of its legislative authority, declares that the street or alley is not presently being used as a street or alley and that the street or alley is not suitable for any of the following purposes: Port, beach or water access, boat moorage, launching sites, park, public view, recreation, or education; or (c) The vacation is sought to enable a city or town to implement a plan, adopted by resolution or ordinance, that provides comparable or improved public access to the same shoreline area to which the streets or alleys sought to be vacated abut, had the properties included in the plan not been vacated. (2) Before adopting a resolution vacating a street or alley under subsection (1 )(b) of this section, the city or town shall: (a) Compile an inventory of all rights of way within the city or town that abut the same body of water that is abutted by the street or alley sought to be vacated; (b) Conduct a study to determine if the street or alley to be vacated is suitable for use by the city or town for any of the following purposes: Port, boat moorage, launching sites, beach or water access, park, public view, recreation, or education, (c) Hold a public hearing on the proposed vacation in the manner required by this chapter, where in addition to the normal requirements for publishing notice, notice of the public hearing is posted conspicuously on the street or alley sought to be vacated, which posted notice indicates that the area is public access, it is proposed to be vacated, and that anyone objecting to the proposed vacation should attend the public hearing or send a letter to a particular official indicating his or her objection; and (d) Make a finding that the street or alley sought to be vacated is not suitable for any of the purposes listed under (b) of this subsection, and that the vacation is in the public interest. (3) No vacation shall be effective until the fair market value has been paid for the street or alley that is vacated. Moneys received from the vacation may be used by the city or town only for acquiring additional beach or water access, acquiring additional public view sites to a body of water, or acquiring additional moorage or launching sites. A potential opportunity has corne up to acquire additional property adjoining the eastern park boarder on South 11Sth Street across from the Duwamish River. From an appraisal standpoint, the properties highest and best use is for development with industrial use The owner has been into the DCD permit center for a pre-application meeting regarding the development of a small warehouse construction project on the site. The Parks & Recreation Department would lIke to make an offer to purchase this property to expand the current Duwamlsh RlVerbend Park and to keep the area green along the Duwamish River. Proposed Real Estate Purchase The City now owns Grandmother's Hill. The 8.7 acre property is not a perfect square. There is a property in the southeast portion that is a separate parcel. It is the flat green space from which the toe of the slope begins. That property, which has Light Industrial zoning, has recently been asked about for use as a small warehouse. Cascade Land Conservancy has had discussions with the ovvner. There are still funds left in the lAC grant from last year, and those funds can orly be used for acquisition. The Committee recommended pursuing the purchase. Recommend purchase reQuest to Regular Meeting. 2. Macadam Winter Garden Bid Result When no bids were submitted for the Macadam Winter Garden, staff approached five consultants and asked them to submit bids. Only two followed up, and only one bid was received. That bid was $325,555, when the budget is $235,000. Staff will pursue other ways to get the park built. Recommend resolution rejecting bid to COW. 3. Housing Options Program This issue was introduced at Council and Committee, then sent to the Planning Commission which held a public hearing. The purpose of the draft proposal is to allow flexibility in housing options in Tukwila by allowing cottages, compact houses, and duplexes on a trial basis. The Committee went through the draft ordinance carefully and discussed some issues that were raised by the Planning Commission. In the end they recommended keeping the ten neighborhoods, but limiting the number of demonstration projects to three. They thought those three projects should be in process within three years of the ordinance adoption. Parking garages are not part of the square footage allowances. In housing types, they agreed that 1,500 feet was an adequate size for compact single- family homes, rather than 1,750 feet. To resolve this question they estimated how much space 1,500 feet was, deciding it was generally one floor size ofa single-family home built before the 1990's. The Committee was hesitant to allow triplexes, and decided against allowing them. Dennis raised the fear that these projects would be built in the middle of single-family residences, and Moira suggested language that would ensure this would not happen. Raising the issue oftumover of housing that increased renters rather than home owners, the Committee hoped there was a way to make certain the homes would be occupied by home owners, at least for some time after they were built. The Committee removed an option to allow 50% of the parking to be on-street, as too many cars now crowd many streets. They also added the minimum size of cottages to be 800 feet. After discussing the community building requirements that would be useful in smaller home developments, they thought common space should be required in the larger developments, such as for projects of compact houses or duplexes over 20 units.
