October 19, 2005 Subject: Resolution Opposing National Legislation This year the Congress IS consIdenng re-wntmg the TelecommunicatIOns bIll that wIll govern telecommumcations in the country for the next several years The first proposals that would be portIOns ofthe larger bIll If passed by both Houses m vVashmgton, D.C. have been introduced m the both the House and the Senate. Fortunately each ofthe two bIlls only has the support of theIr sponsor m the House and the Senate. That often indIcates there IS not strong bIpartIsan support for the bIlls, but that could change m the coming weeks, dependmg on what Congress hears from cItIzens. The effect of the two bills already mtroduced would be to allow one company to serve the entire country (includmg cItIes like TukwIla) wIth cable/vIdeo servIce, and to gIve the authonty for regulatmg CIty nghts of way to the compames who would use them. Jim Haggerton has lobbIed Senators and House members on telecommumcations recently, and he can explam the fight cIties wIll have .battlmg the telecommumcations giants like Venzon and Comcast who have one of the strongest lobbies m D.C. The resolutIOn on the following page attempts to clanfy the CIty'S posItIon on telecommumcations' franchising and the use of our nghts of ways. Sending this to our congressional delegatIOn would send a message that cItIes like TukwIla do care about thIS Issue and want to make a statement. If you approve the resolution, It can be sent to the Regular Meetmg for approval. [IDrn&~tr A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, OPPOSING A NATIONAL FRANCHISING PROCESS, AND OPPOSING LEGISLATION THAT REMOVES THE ABILITY OF INDIVIDUAL CmES TO REGULATE THEIR RIGHTS-OF-WAY. WHEREAS, national legislation has been introduced in HR-3146/SR-1349 to create a national cable/video franchise, thereby bypassing the local franchising process; and WHEREAS, SR-1504, the Broadband Investment and Consumer Choice Act, has been introduced in an attempt to abrogate cities' ability to regulate their rights-of-way; and WHEREAS, Tukwila has consistently processed franchise agreements within 120 days, and usually in less time, which refutes the assertion that national regulation is necessary due to lengthy franchise processing time by individual cities; and WHEREAS, Tukwila encourages open competition for services provided by fiber optic lines in our rights-of-way, and believes that competition and coordination among several providers is beneficial to our citizens, and WHEREAS, these and similar bills would not only eliminate all current cable franchising authority, but would also threaten cities' current use of cable lines for traffic signals and municipal public safety; and WHEREAS, these bills would eliminate any build-out requirements, which could result in bypassing poor neighborhoods when installing future cable services; and WHEREAS, the Tukwila City Council believes that cities should have the ability to provide communications services, including internet, cable and telephone services, for the benefit of local citizenry and economic development purposes without undue interference from the Federal government; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. All federal legislation that limits and abrogates cities' use of its rights-of- way would be detrimental to the City of Tukwila, and should be opposed. Section 2. J~_:"-'" ~'l,-'- October 12', 2005 DATE: SUBJECT: Lease Agreement Neighborhood Resource Center On August 1, the Council approved a new lease agreement for property located at 14661 Tukwila International Boulevard, commonly referred to as the Neighborhood Resource Center (NRC). A new agreement was necessitated by the expIratlOn of the prior lease, which had been amended and extended several times. City Staff spoke with the property owner and sent him a draft copy of the lease agreement for review prior to Committee consideration m July. Other than a $200 per month increase in the lease rate, no other changes were suggested by Mr. O'Brien. Once the agreement was fonnally approved by Council and sIgned by the Mayor, Mr. O'Brien was contacted to obtain his signature. On September 20, we received a facsimile copy of the agreement, with amendments, ITom the property owner. Smce the tenns requested by Mr. O'Brien differ from those approved by Council, we present them for Committee review and recommendation to the full Council. Mr. O'Brien's amendments are in Section 2. Tenn, and Section 12. Tennination. He requests that notice of lease terminatlOn or extension be given by the City 60 days prior to the end of the lease period. In other words, the City must notify him in the 16th month of our intent to extend or tenninate the lease, and once the lease is extended we would not be able to tenninate until the 16th month of the 18th month extenSIOn. A Resolution Regarding Unclaimed PropertY. Annually unclaImed CIty checks are wntten off after the CIty tnes to find check recIpIents to gIve them theIr money Pam C asked that the resolutIOn be changed to dIfferentiate between unredeemed Items that can be wntten off after one year or after two years. MUlllcIpal court checks, gIft certIficates, clamllpayroll checks all make up the unredeemed funds. Resolution with changes recommended to that evening's meeting. 2. Resolution Regarding \Vrite-Off of Uncollected Accounts Receivable Just as the CIty reclaims unredeemed checks, so too does the cIty annually write off checks they believe they have little to no chance of collectmg on. NotIces are sent to those who owe the CIty money, and after second notices are sent, the matter IS then sent to a collection agency. After a tIme those are abandoned when they do not produce results. Recommend resolution writing off returned checks and accounts receivable to that evening's meeting. 3. Resolution Regarding Initiative 900 This mltIatIve would reqUIre performance audits of state, local and educatIOn governments. It would do so through requmng that nme elements applicable to state agencIes be applIed, regardless of whether It was a county or city that was bemg looked at. The cost of audIts would largely be borne by local governments, as the amount of state sales tax allocated to thIS effort IS mmlmal compared to the cost. There IS no appeal for any audit findmgs, and it could be that audIts could be used for polItIcal gam, as there IS no order of who wIll be audIted when or for what reason, Audits of state agencIes were mandated by the LegIslature last SessIOn, As detailed in the ImtIatIve, performance audits are much more subjective than the financIal audIts the CIty has done each year. Recommend resolution opposing Initiative 900 to Council that evening. ..y 4. Lease Agreement Neighborhood Resource Center In August the CouncIl had received a /1" copy of the lease agreement that had also been gIven to the owner of the leased property. After the Council and AdmIlllstration had approved the agreement, It was sent back to the owner. He then decIded a provisIOn related to termmatmg the agreement should be changed, and he lImIted that opportumty to the last two months of an eIghteen- month term. The commIttee dId not agree wIth the change.
