OFFICIALS: Present were Pamela Linder, Council President; and Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Jim Haggerton, Dennis Robertson and David Fenton. ATTENDANCE: Executive session began. Executive session ended. SPECIAL PRESENTATIONS: TUKWILA CITY COUNCIL Council Chambers City Hall December 12, 2005 7:00 P.M. EXECUTIVE SESSION 6:30 P.M. Real Estate Issues 30 minutes Pursuant to RCW 42.30.110(1)(b) COMMITTEE OF WHOLE MEETING MINUTES Steven M. Mullet, Mayor; Rhonda Berry, City Administrator; Lucy Lauterbach, Legislative Analyst; Bruce Fletcher, Director of Parks and Recreation; Kevin Fuhrer, Director of Finance; Jim Morrow, Director of Public Works; David Haynes, Chief of Police; Nick Olivas, Chief of Fire; Kimberly Walden, Municipal Court Judge, Evelyn Boykan, Human Services Program Manager and Stacy Hansen, Human Services Specialist; Jane Cantu, City Clerk; and Bob Baker, Deputy City Clerk. Introduction of Sarah Harris. Administrative Support Coordinator, Parks Recreation Bruce Fletcher, Director, Parks and Recreation, introduced Sarah Harris. A graduate of Central Washington University, Ms. Harris formerly served Tukwila as a temporary employee. Most currently from the City of Kent, Ms. Harris' background is in youth and teens. She grew up in Des Moines, WA, and is pleased to be serving the citizens of Tukwila. CITIZEN COMMENT: None. SPECIAL ISSUES: a. Authorize Mayor to accept a donation of land from the Cascade Land Conservancy for open space (1.34 acres assessed valued at $108,000.00) Bruce Fletcher, Director of Parks and Recreation, distributed parcel number maps depicting the location of the parcels being offered #7661600121 8733000005). Currently "open space land," the parcels serve as a greenbelt buffer between several houses and Interstate 5. City of Tukwila Page 2 of 4 City Council Committee of Whole Meetina Minutes December 12. 2005 The north border is across the street from the Southcenter Baptist Church and the south border is across from the Tukwila Garden Apartments. The land value is assessed at $108,000.00. When members of the Conservancy approached Mr. Fletcher's office about potentially purchasing the property, they were informed the City does not have the money to make such a purchase. Through continued discussions, arrangements were made for the land to be donated. Presented at the November 29 Community Affairs and Parks Committee, it was agreed that City ownership of the property would allow enhanced control of the site. In years past, it has been a place where cars were parked and /or repaired. It took City of Tukwila Code Enforcement action (installation of barriers) to discontinue such practices. For action /consideration, consensus existed to forward consideration of this item to tonight's City Council Special meeting. b. A resolution authorizing the Mavor to enter into a development agreement with WEA Southcenter LLC and Prudential Financial. Inc. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AUTHORIZING ENTRY INTO A DEVELOPMENT AGREEMENT FOR THE REDEVELOPMENT OF WESTFIELD MALL AT SOUTHCENTER Mayor Mullet introduced the proposed resolution. It was at their November 28 Special meeting that the Council authorized the Mayor to sign the Development Agreement regarding redevelopment at the mall formerly known as Southcenter. Subsequent review of the Revised Code of Washington (RCW) showed staff a resolution is required when authorizing the Mayor to sign such an agreement. Thus, the proposed resolution. Ms. Hernandez noted the third whereas clause should be amended to include the words "AND SUBSEQUENT SPECIAL MEETING THE SAME NIGHT" AFTER "...2005," AND BEFORE THE WORD "AND..." If approved, the third whereas clause would read, "WHEREAS, the Tukwila City Council reviewed the agreement at the Committee of the Whole meeting on November 28, 2005, and subsequent Special meeting the same night, and authorized the Mayor to enter into the development agreement; and" Councilmembers briefly discussed the idea. For action /consideration, consensus existed to forward this item to this evening's Special meeting. REPORTS: a. Mavor Mayor Mullet reported the cancellation of all remaining City Council and Council sub committee meetings for 2005. The first Regular meeting of 2006 will be held Tuesday, January 3. Next, the Mayor reported a new developer is "on board" relative to the Tukwila Station Housing Project. Dealings with the original developer "fell through." The new developer would like to do that which was originally proposed with the site and the deal" is expected to be essentially the same as presented by the first developer. Additional information will follow in 2006. Additionally, the Mayor reported receipt of two grants from King County. Both are in the amount of $10,000.00. One is for use in connection with the Farmer's Market for 2006, and the other is for continued service of the Seattle Southside Shuttle. City of Tukwila Page 3 of 4 Citv Council Committee of Whole Meetina Minutes December 12. 2005 Finally, the Mayor informed Council the Tukwila School District is "uncomfortable" in not being a signatory to the agreement entered into (between King County and the City of Tukwila, regarding the swimming pool). Their concern lies in unanswered questions as to what will happen with the pool and property when the agreement reaches "sunset" in 2011. They would like assurances that the City will not vacate the building and leave them to handle demolition and /or other issues relative to any closure of the pool. Mayor Mullet noted his belief and understanding that the City has every intention of extending the agreement at that time. The School District does not seek money, free classes, or any other concessions in this matter, with the exception that should the City decide to close the pool or not extend the agreement, they (the City) will be responsible for costs of demolition and /or closure. Should such decisions be made (to close and /or demolish), Mayor Mullet suggested entering into a separate agreement (with the School District) noting the City would pay for such costs. Brief discussion ensued and Council consensus existed for Mayor Mullet to enter into discussions and create a related agreement. Again, additional information will follow in 2006. b. City Council Councilmember Duffie wished everyone a joyous holiday season. Councilmember Hernandez reported attendance to the Tukwila Government Affairs Committee meeting on December 6. She also attended the December 9 holiday luncheon of the Southwest King County Chamber of Commerce and the subsequent luncheon sponsored by the City of Tukwila's Municipal Court staff. She, too, wished everyone happy holidays. Council President Linder had no report. Councilmember Carter distributed a written report prepared post attendance to last week's National League of Cities Conference in Charlotte, North Carolina. She also distributed copies of a newspaper article from the Charlotte Observer entitled "The hard part... Thank public servants for giving generously of family time." She was pleased to see such an editorial piece in that newspaper on December 9. Councilmember Haggerton attended the National League of Cities Conference in Charlotte last week and reviewed a written report prepared upon his return to Tukwila. Councilmember Robertson reminded Council that at least three others (in addition to himself) must come in to sign vouchers on Friday, December 16, as there will be no Council meeting to approve same on December 19. Councilmember Fenton had no report. c. City staff: Rhonda Berry reported Bruce Fletcher will make a presentation to the Tukwila School Board on December 13 relative to "Youth Activities" in Tukwila. d. City Attorney: Shelley Kerslake was not present. e. Legislative Analyst: Lucy Lauterbach reported the Association of Washington Cities Conference will be held during the last week of January, 2006. The timing of the event differs from that in the past and comes just one week after the Tukwila City Council retreat. Councilmember Robertson reported a City Council Special meeting /work session will be held on Wednesday of that week (January 25) to discuss the Tukwila South project. Councilmember Carter City of Tukwila Page 4 of 4 City Council Committee of Whole Meetina Minutes December 12. 2005 spoke in opposition to the meeting date as she has responsibilities with AWC and must be present at the Conference.
