Mullet called the Tukwila City Council meeting to order at 7:01 pm and led the audience in the Pledge of Allegiance. Christy O'Flaherty, Acting City Clerk, called the roll of the Council. Present were Dennis Robertson, Council President; Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Jim Haggerton, Pam Linder, and Verna Griffin. CITY OFFICIALS Steven M. Mullet, Mayor; Rhonda Berry, City Administrator; Peter Beckwith, Assistant City Attorney; Steve Lancaster, Community Development Director; Jim Morrow, Public Works Director; Mike Villa, Police Patrol Commander; Katherine Kertzman, Tourism Manager; Christy O'Flaherty, Acting City Clerk. SPECIAL PRESENTATIONS Oath of Office administered to Jeff Martineau, Lateral Police Officer and Sanjay Prasad, Entry Level Police Officer. Mike Villa, Police Patrol Commander, introduced Jeff Martineau, Lateral Police Officer. Mr. Martineau graduated from Washington State University with a Bachelor of Arts in Criminal Justice. He was previously employed by the Department of Corrections and as a Police Officer for the City of Orting. Mayor Mullet administered the Oath of Office to Jeff Martineau, Tukwila Police Officer, Badge #169. Mike Villa introduced Sanjay Prasad, Entry Level Police Officer. Mr. Prasad has a Bachelor of Science Degree in Business Administration from City University. He was previously employed as a City of Des Moines Reserve Police Officer. Mayor Mullet administered the Oath of Office to Sanjay Prasad, Tukwila Police Officer, Badge #170. Mr. Villa reminded the audience of the Peace Officers' Memorial Day ceremony at the City Hall flagpole at 10:00 am on May 16, 2006. He invited everyone to attend. PROCLAMATIONS /APPOINTMENTS Proclamation designating Tuesday, May 16, 2006 as Peace Officers' Memorial Day and the period of May 14 May 20, 2006 as National Police Week. Mayor Mullet read, in its entirety, a proclamation designating May 16, 2006 as Peace Officers' Memorial Day and the period May 14 May 20, 2006 as National Police Week in the City of Tukwila. CITIZEN COMMENTS Vanessa Zaputil, 15171 52nd Avenue South, #5, thanked the Parks and Recreation staff for the excellent Easter Egg Hunt held at the Tukwila Community Center. She also commented on the notable improvements at the swimming pool since it was taken over by the City. City of Tukwila City Council Regular Meeting Minutes Ms. Zaputil referenced a letter sent to the City dated May 9, 2006 outlining concerns regarding the PCL noise variance application. She stated there is a great deal of noise, to the surrounding neighbors, due to the Sound Transit development. The contractor has not conformed to the noise ordinance in the past, and it is important the Mayor and City Council be aware of this issue. She also conveyed that traffic convenience should not take priority over the residents' ability to sleep at night. She is asking the City not to approve the PCL noise variance request. Eden Hopkins from the Museum of Flight invited the City Councilmembers, Mayor, and City Administrator to the May 29 Memorial Day luncheon at 11:30 am as well as the ceremony to follow. The honorees this year are the World War 2 Tuskegee Airmen. CONSENT AGENDA Page 2 of 4 May 15. 2006 a. Approval of Minutes: 5/1/06 (Regular) b. Approval of Vouchers #323430 323757 in the amount of $2,004,414.50 c. Final Acceptance of City Hall Council Chamber Remodel for AudioNisual Upgrade with Pro Sound Communications in the amount of $31,466.90; release retainage in the amount of $1,446.09. MOVED BY DUFFIE, SECONDED BY HERNANDEZ TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS a. A resolution adopting a Sewer System Plan update and providing for sanitary sewer policies. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING A SEWER SYSTEM PLAN UPDATE AND PROVIDING FOR SANITARY SEWER SERVICE POLICIES FOR THE CITY. MOVED BY HAGGERTON, SECONDED BY LINDER THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Assistant City Attorney, Peter Beckwith, read the proposed resolution by title only. MOVED BY HAGGERTON, SECONDED BY LINDER THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO APPROVE RESOLUTION NUMBER 1605. b. An ordinance renewing a six -month moratorium on acceptance of applications for certain land divisions and development activities and land uses within the area designated for transit- oriented development. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RENEWING A SIX -MONTH MORATORIUM ON ACCEPTANCE OF APPLICATIONS FOR CERTAIN LAND DIVISIONS AND DEVELOPMENT ACTIVITIES AND LAND USES WITHIN THE AREA DESIGNATED FOR TRANSIT ORIENTED DEVELOPMENT AROUND THE TEMPORARY COMMUTER RAIL/AMTRAK STATION AT LONGACRES; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY MOVED BY HERNANDEZ, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Assistant City Attorney, Peter Beckwith, read the proposed ordinance by title only. MOVED BY HERNANDEZ, SECONDED BY HAGGERTON THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Councilmember Hernandez stated this ordinance would extend the current moratorium through December 31, 2006, with the intent of adopting a Transit Oriented Development plan by that time. City of Tukwila City Council Regular Meetino Minutes Councilmember Carter inquired as to whether there have been any applications submitted that would violate this moratorium. Steve Lancaster, Community Development Director, stated he is not aware of any applications that would violate the moratorium. He indicated minor modifications were made to the moratorium when the Tukwila Station mixed -use development came through in order to accommodate the project. Councilmember Carter indicated it is not the City's desire to continue the moratorium indefinitely and looks forward to it no longer being necessary. *MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2123. c. Authorize the Mayor to sign a contract for consulting services with Commercial Development Solutions relating to the Tukwila Valley South project MOVED BY HERNANDEZ, SECONDED BY ROBERTSON TO AUTHORIZE THE MAYOR TO SIGN A CONTRACT FOR CONSULTING SERVICES WITH COMMERCIAL DEVELOPMENT SOLUTIONS, IN AN AMOUNT NOT TO EXCEED $87,000, RELATING TO THE TUKWILA VALLEY SOUTH PROJECT.* Councilmember Hernandez noted there had been an Amendment #3 to the original contract that was signed in February, 2006. She asked for clarification as to whether the scope of services to be performed would remain the same as in Amendment #3 as well as the additional services related to long range planning and emergency preparedness. Steve Lancaster, Community Development Director, stated the scope of services would remain the same and is outlined in Section 1 of the proposed contract. *MOTION CARRIED 7 -0. NEW BUSINESS REPORTS a. Mayor Page 3 of 4 May 15, 2006 Authorize the Mayor to initiate a lawsuit to recover the City's clean -up costs for contamination in the right -of -way at 14004 Tukwila International Boulevard. MOVED BY ROBERTSON, SECONDED BY GRIFFIN TO AUTHORIZE THE MAYOR TO INITIATE A LAWSUIT TO RECOVER THE CITY'S CLEAN -UP COSTS FOR CONTAMINATION IN THE RIGHT -OF- WAY AT 14004 TUKWILA INTERNATIONAL BOULEVARD. MOTION CARRIED 7 -0. Mayor Mullet reported that the Tukwila Community Schools Collaboration (TCSC) was awarded a check for $10,000 by Westfield at their groundbreaking ceremony on May 11, 2006. The Mayor indicated there will be several groups of school children visiting City Hall in the next few weeks to learn about governmental functions. Mayor Mullet and Derek Speck, Economic Development Administrator, will be out of town on May 22 -23, 2006 at a Retailer's Convention in Las Vegas. b. City Council Councilmember Hernandez attended the May 9, 2006 Lodging Tax Advisory Committee brainstorming session on the use of their reserve fund balance. She also attended the South King County Cultural Coalition meeting on May 10, 2006 where marketing ideas were discussed. Ms. Hernandez also attended the Westfield groundbreaking ceremony as well as the Multi Cultural Action Committee meeting on May 11, 2006. On May 12, 2006 she attended the Chamber of Commerce event at the Renton Events Center. Ms. Hernandez indicated Councilmember Duffie has agreed to chair the Community Affairs and Parks Committee meeting while she is in Germany. City of Tukwila City Council Reaular Meetina Minutes Page 4 of 4 Mav 15. 2006 Councilmember Carter attended the Transportation Policy Board meeting and Destination 2030 meeting on May 11, 2006. An issue of discussion at the Transportation Policy Board meeting was with regard to passenger -only ferries. The State has indicated it is getting out of the passenger -only ferry service, and the Board is considering looking at this issue from a regional perspective. The Puget Sound Regional Council (PSRC) has indicated that a study on this issue could cost up to $250,000. On May 12, 2006, Ms. Carter attended the Chamber of Commerce luncheon at the Renton Events Center. She also attended the Backyard Wildlife Habitat Festival on May 13, 2006 and felt it was very well done. Councilmember Haggerton reported that he attended a May 9, 2006 meeting of the Cascade Water Alliance where the final papers were signed regarding the bond issue. He also attended the May 11, 2006 Westfield groundbreaking event. The American Legion Post #235 had its final meeting for the year today and will not be meeting again until September. Mr. Haggerton said members of the American Legion will be distributing poppies and will accept contributions to be put toward the Veteran's Hospital. Councilmember Linder attended the Backyard Wildlife Habitat Festival on May 13, 2006, and she felt the City's involvement was an improvement to the event. Many people come to Tukwila for the wildlife festival who typically would not have occasion to visit the City. Councilmember Griffin indicated she will be leaving for Washington D.C. on May 21, 2006 for the National League of Cities (NLC) Youth Education and Families Committee meeting. She has learned that the attendees at this event will be meeting with senior White House staff members and Laura Bush to discuss the First Lady's initiatives regarding youth. The Equity and Diversity Committee meeting date has been changed to June 8, 2006. c. Staff Rhonda Berry, City Administrator, reported that spring clean -up dump passes are currently being distributed to citizens at City Hall. The Special Recycling event will be held on May 20, 2006 at the corner of South 144 Street and 41 Avenue South. The Mayfair event will also be held on May 20, 2006 at the Tukwila Community Center from 11:00 -3:00 pm. This is a free event. The Tukwila International Farmers' Market will begin on May 17, 2006 at 3:00 pm with the ribbon cutting at 5:30 pm. Ms. Berry distributed "Farmers' Market" shopping bags to the Councilmembers and Mayor. She also indicated Tukwila Farmers' Market will be featured in an advertisement through "Puget Sound Fresh." d. City Attorney The City Attorney had no report. MISCELLANEOUS Councilmember Duffie distributed photos of the Vietnam Veteran's Memorial in Washington D.C. ADJOURNMENT 7:52 m.
