HomeMy WebLinkAboutOrd 0839 - Reduce Membership of Planning Commission (Repealed by Ord 1112) 11 CITY QF TUK WASHINGTON REPEALED BY ilia ORDINANCE NO. 839 AN ORDINANCE REDUCING THE NUMBER OF MEMBERS OF THE PLANNING COMMISSION FROM 12 MEMBERS TO 9 MEMBERS AND REVISING ORDINANCE NO. 242. WHEREAS The Planning Commission of the City of Tukwila, Washington, has recommended to the City Council that Planning Commission membership be reduced from 12 to 9 members, and WHEREAS, The Planning Commission as now constituted has vacancies in three of the appointive positions, thus making possible a reduction in the Planning Commission member- ship without removing any members from office, and WHEREAS, The City Council of the City of Tukwila con- curs with the Planning Commission Recommendation, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That membership of the City Planning Commission, as established by Ordinance No. 242, enacted on September 3, 1957, pursuant to RCW 35.63, be reduced in mem- bership from 12 to 9 members, who shall be selected as follows: Two City Council members shall be ex- officio members of the Commission during the period of their incumbency in such offices; the other seven members shall be appointed by the Mayor and confirmed by the City Council. Section 2. The incumbent members of the Planning Commission as established pursuant to Ordinance No. 242, and their terms of office, shall be designated as follows: -1- POSITION INCUMBENT TERM OF OFFICE NO. 1 NO. 2 NO. 3 NO. 4 NO. 5 NO. 6 NO. 7 B. Sneva H. Lamb Jack Link Ron Mettler Frank Zepp R. Kersop H. West Section 3. The term of office of the members appointed by the Mayor shall be six years. Vacancies occurring other than through the expiration of terms shall be filled for the unexpired terms. Members may be removed after public hearing by the Mayor with the approval of the City Council for inefficiency, neglect of duty or malfeasance in office. The members shall be selected without respect to political affiliations and they shall serve without compensation. Section 4. The Planning Commission shall have all of the powers and perform each and all of the duties specified by Chapter 7 of the 1965 Session Laws of the State of Washington, which has been codified as RCW 35.63, together with any other duties or authority which may hereafter be conferred upon them by the laws of the State of Washington, the performance of such duties and the exercise of such authority to be subject to each and all limitations expressed in such legislative enactment or enactments. Section 5. The City Council may refer to the Planning Commission for its recommendation and report, any ordinance, resolution or other proposal relating to any of the matters and subjects referred to in Chapter 7 of the 1965 Session Laws, RCW 35.63, and the Commission shall promptly report to the Council thereon, making such recommendations and giving such counsel as it may deem proper in the premises. All plats or plans of subdivisions of land within the City, or proposed additions, as well as dedications of streets and alleys, offered to the City Council for acceptance, shall first be submitted to the Planning Commission for its recommendation and report, which report shall be made to the Council within thirty days after submission, or at such earlier date as the Council shall direct. Section 7. The Planning Commission may designate one of its members to act as secretary without salary, or if requested by the Commission, the Mayor shall designate a member of the paid staff of the City to serve as secretary, who shall serve without additional compensation. Section 8. A majority of the membership of the Planning Commission, not less than three of whom shall be appointed members, shall constitute a quorum for the transact- ion of business. Any action taken by a majority of those present when those present constitute a quorum at any regular or special meeting of the Planning Commission, shall be deemed and taken as the action of the Commission. Section 9. The Planning Commission, at or before its first regular meeting in February of each year, shall make a full report in writing to the City Council of its transactions and expenditures, if any, for the preceding year, with such general recommendations as to matters covered by its prescribed duties and authority as may to it seem proper. Section 10. All provisions of Ordinance No. 242 inconsistent with these provisions, are hereby deemed to have been superseded by this enactment.
