BACKGROUND The Integrated Roads Transit Plan will combine two plans: The Sound Transit 2 plan, which would extend the region's light rail system to more than 60 miles, create thousands of new Park and Ride slots, and expand bus and commuter rail service; and The RTID's (Regional Transportation Investment District's) "Blueprint for Progress," which proposes investments in state highways, bridges, and local roads in the three county area. The proposed projects will reduce congestion, ease chokepoints, and improve safety. Attachment III.A. At the March 20, 2007, SCATBd (South County Area Transportation Board) meeting, Councilmember Patterson provided SCATBd with a summary of the Integrated Roads Transit Plan, including justification for this package: Highways are severely congested and aging. Project costs keep increasing. Goods must get delivered and people must get to work and home. Population is growing at more than 50,000 per year for the next 20 years. The joint plan provides roads and transit improvements in all major corridors of all three subareas in King County, as well as throughout the three- county district. Tukwila would directly benefit because the plans include improving the I- 405 /SR -167 Interchange, connecting SR -509 with I -5, and upgrading the Sounder Station. More information can be found at www.rtid.org and www.soundtransit.org (ST 2). RECOMMENDATION Formally support the Integrated Roads Transit Plan by passing the attached resolution. attachment (P:alice\TC 042307 Integrated Roads Transit Plan) 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, SUPPORTING THE ADOPTION OF 1'kik, INTEGRATED ROADS TRANSIT PLAN DEVELOPED BY THE REGIONAL TRANSPORTATION INVESTMENT DISTRICT AND SOUND TRANSIT. WHEREAS, Sound Transit is the designated provider of high capacity transit infrastructure and services to meet regional public transportation needs in the Puget Sound area; and WHEREAS, the Regional Transportation Investment District is charged with developing a transportation investment plan for improving significant highways and bridges in the Puget Sound area; and WHEREAS, the City of Tukwila will directly benefit from the proposed improvement of the interchange of SR -167 and I-405 and the proposed improvements to Longacres Station; and WHEREAS, the City of Tukwila feels it is essential that an integrated, regional approach is needed that invests in both highway and transit improvement projects to relieve congested corridors, improve and maintain the region's road system, and provide fast, reliable mass transit that connects the population and employment centers of the region; and WHEREAS, Sound Transit and the Regional Transportation Investment District have worked jointly over the past year to develop the first ever integrated set of highway and transit improvements for the Puget Sound region. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF TUKWILA SUPPORTS THE ROADS TRANSIT INVESTMENTS AND REVENUE SOURCES DEVELOPED BY THE REGIONAL TRANSPORTATION INVESTMENT DISTRICT AND SOUND TRANSIT. Prepare for actions that may be necessary for the City to secure right -of -way and easements for the Tukwila International Boulevard Phases 2 3 Road Improvements project in order to advertise for construction bids in 2007. Final design for Tukwila International Boulevard Phases 2 3 is nearing completion. Right -of -way and easements are needed along the project in order to construct the proposed improvements. Most of the property needs are for temporary construction easements. A few small right -of -way acquisitions are needed. 3 4 Mayor Mullet Page 2 April 18, 2007 It is critical for the project that negotiations are completed in a timely fashion. If negotiations fail, condemnation proceedings will be necessary to obtain the properties needed. Condemnation must be authorized by the Council and can be a lengthy process. ANALYSIS Due to the current schedule's time limitation for property acquisition, it is recommended to begin condemnation proceedings as soon as possible for all properties identified as being a "take" for construction of the project. Condemnation would then be under way for any properties unable to be acquired through the negotiation process. Then, as successful negotiations and acquisitions occur, those properties would be removed from the condemnation process. It is felt that this is the most expedient way to ensure certification of right -of -way given the current schedule. A draft condemnation ordinance has been prepared for the subject properties. The plans exhibit (Exhibit "B is attached and the legal description exhibits (Exhibit "A will be attached to the final version. RECOMMENDATION Take draft document to Committee of the Whole for review and discussion. Forward the condemnation ordinance to the City Council for adoption. attachments i:\pubworks \projects\a- rw rs projects \95rw04 tib3 \information memo condemnation 4- 18- 07.doc DRAFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AUTHORIZING AND PROVIDING FOR THE ACQUISITION OF LAND FOR THE PURPOSE OF CONSTRUCTING THE TUKWILA INTERNATIONAL BOULEVARD PHASES 2 3 ROAD IMPROVEMENTS; PROVIDING FOR CONDEMNATION, APPROPRIATION AND TAKING OF LAND AND PROPERTY RIGHTS NECESSARY THEREFOR; PROVIDING FOR THE COST THEREOF; DIRECTING THE INITIATION OF APPROPRIATE PROCEEDINGS IN THE MANNER PROVIDED BY LAW FOR THE CONDEMNATION; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council, on December 11, 2006 by Ordinance No. 2148, did adopt the year 2007 City budget and did provide therein for a transportation program that included funding for Tukwila International Boulevard Phases 2 3 Road Improvements; and WHEREAS, the Capital Improvement Program provides for the acquisition of land and property for improvement of Tukwila International Boulevard Phases 2 3; and WHEREAS, the City of Tukwila Capital Improvement Program provides for the City's roadway reconstruction and safety improvements, which coordinates road projects with other elements of the larger transportation system, abutting land uses and business, industry, government, and residential processes; and WHEREAS, the City needs to acquire the property and property rights necessary to facilitate reconstruction of the widened road with curb, gutter, sidewalk, and other amenities within the time constraints set forth by outside funding sources; and WHEREAS, the City Council finds that public health, safety, necessity, and convenience demand that Tukwila International Boulevard, be improved within the City of Tukwila, in accordance with the Capital Improvement Program, and that certain properties, property rights, and rights in property be condemned, appropriated, taken, and damaged for public use, subject to the making or paying of just compensation to the owners thereof in the manner provided by law; and WHEREAS, the City is authorized by RCW 35A.64.200 and Chapter 8.12 RCW to initiate eminent domain proceedings for the condemnation of the property; Condemnation Ordinance DRAFT 1 6 DRAFT NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City Council has deemed it necessary and in the best interest of the citizens of Tukwila that the lands described in the attached Exhibit "A" and shown in Exhibit `B," and other property rights, and/or rights in property be condemned, appropriated, taken, and damaged for the purpose of extended reconstruction of the widened road. The project will include curb, gutter, sidewalks, retaining walls, landscaping, illumination, drainage, channelization, and related improvements. The project will require significant reconstruction of the roadway as well as relocation/reconstruction of utilities, subject to the making or paying of just compensation to the owners herein in the manner provided by law. Section 2. Compensation shall be made for the land taken and damaged. The costs and expenses for acquiring all interests and rights in said property shall be paid for from the City's Arterial Street 104 Fund. Section 3. Condemnation proceedings are hereby authorized to acquire property and property rights and/or rights in property, together with the right to construct and maintain slopes for cuts and fills on certain abutting properties described in the attached Exhibit "A" and shown in Exhibit `B" for the purpose of the subject road improvements. Section 4. The attorneys for the City of Tukwila are hereby authorized and directed to begin to prosecute the proceedings provided by law to condemn, take, and appropriate the land and other property, and property rights necessary to carry out the provisions of this ordinance. Section 5. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 6. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force and effect five (5) days after passage and publication as provided by law. Evaluate a Local Improvement District to potentially fund a portion of the Tukwila Urban Access Proiect at Klickitat and Southcenter Parkway: Foster Pepper gave a presentation to the City Council on the LID process. 2. Evaluate future grant funding options available and propose a course of action to fund transportation miects: Ongoing. 3. Evaluate the City's Emergency Management Plan using the National Emergency Management Accreditation Program Standard as the guideline: Pending. 4. Implement recurrent technical training and operational safety programs to maintain employee certification levels: The March training was completed on Thursday, March 22. 4. Implementation of maintenance tracking system for facilities and City resources: On hold. Engineering Administration 1. Update standardized contracting procedure for construction and repair proiects: Updated Tukwila General Special Provisions to dovetail with new APWA GSPs, including revised "cost- loaded network system" specifications. 2. Update transportation mitigation fee system: Updated the fee schedule to include current project costs in the CIP and added concurrency fees. Council adopted on March 5, 2007. Development General: 1. Maintain and improve the turn around time for permit review and approval: Ongoing. 2. Work with and support DCD to improve permit processes: Ongoing. Performance: 1. Advertise and award 90% of active Fund 303 Proiects no later than June 1: In the planning /design phase for facility projects. 2. Reduce Facility Maintenance costs by 10% throuah efficiencies: Continuing. 3. Develop and implement a custodial satisfaction survey and performance aoals: Pending. Street Maintenance /General Admin General: 1. Participate in pavement manaaement for the multi -year street overlay proaram: Support as required by Engineering. 2. Participate with the Interconnect Proiect and traffic control uparade by installina cameras at all CBD sianals: Signal crew has been installing traffic cabinets for the project. Performance: 1. Repair city -owned street liahts within 72 hours. For Seattle City Liaht/Puaet Sound Enerav street liahts. report within 24 hours: Goal being met. 2. Potholes shall be repaired within 48 hours of notification: Goal being met. Residential Streets General Engineering 1. Prioritize. budaet. and schedule list of residential street improvement proiects for inclusion into the City's Capital Improvement Proaram: Staff will update the computer program that scores and ranks residential street improvement needs. Data gathering will occur in second quarter. Results will be provided to Council in the third quarter. 2. Annual update of pavement manaaement system: Update of pavement management system is included in the 2007 Overlay contract with KPG. Work will begin after the 2007 Overlay project is advertised for construction, which should be in second quarter with completion by the third quarter. Bridges Streets General Engineering 1. Beain construction of Phase II and III of Tukwila International Blvd. Improvement Proiect: Discussion regarding undergrounding of overhead utilities was resolved by producing two separate plan sets for bidding, one with undergrounding and one without. Design supplement is being processed for additional work. Anticipated advertisement for construction in third quarter. 2. Beain construction of Tukwila Urban Access (Klickitat) proiect: Construction now anticipated to begin in early 2008. 3. Beain construction of Southcenter Parkway Proiect: Negotiation of developer agreement (for roadway only) is ongoing. If agreement is reached soon, advertisement for construction would likely occur in late third quarter or fourth quarter. Project design is currently on hold. 4. Complete construction of Traffic Signal Interconnect Phase I: Construction is 60% complete, completion in second quarter. ACTRA traffic operations software by third quarter. Equipment Rental 1. Use monthly maintenance manaaement trackina reports to recommend a 10 percent reduction in fleet maintenance costs: Currently being done data used to complete closeout of 2006 books. 2007 First Quarter Report to Council Prepared for Transportation Committee Page 3 Performance: 1. Complete 85% of the 2007 budaet capital eauipment purchases by June 30: Nearly completed by March 31, 2007. 2. Return 100% of vehicles for preventive maintenance and checkup within the 30 -day timeframe: Goal being met. 3. Keep 90% of safety vehicles (Police and Fire) available for use: Police goal met, Fire trucks have shown some weakness in all units and safety is being analyzed further. 3
