INFORMATION MEMO To: Mayor Mullet From: Public Works Director Date: July 25, 2007 Subject: Allentown Phase II/Foster Point Water and Sewer Improvements Project No. O1 -SW02 Project Completion and Acceptance ISSUE Accept construction contract as complete and authorize release of retainage in the amount of $369,718.37. BACKGROUND The Notice to Proceed for Contract No. 06 -043 with R.L Alia Company Renton, Washington, was issued on May 15, 2006. This project constructed new water and sewer mains in the Allentown Phase II and Foster Point neighborhoods. This contract was completed on July 6, 2007. There were seventy-six change orders in the amount of $330,746.95 and $524,620.72 in net unit price overruns,See attached change order log. Although this project was primarily lump sum, there were several unit bid prices that were substantially overrun. The primary unit price item overruns were eighty-eight additional water services at $3,000 each and forty-five additional sanitary sewer stubs at $5,000 each. Closeout paperwork has been completed and verified, and the project is now ready for final acceptance. The contract cost is summarized as follows: Contract Award Amount $6,539,000.00 Additions (Change Orders and overruns) 855,367.67 Subtotal 7,394,367.67 Sales Tax* 537.842.87 Total Amount Paid (incl. retainage) 7,932,210.54 Sales tax at 8.8% and 8.9% after April 1, 2007 (except no tax on roadway items). ANALYSIS The bid award was $6,539,000 plus tax ($443,432) plus 10% contingency ($653,900), for a total of $7,636,332. The budgeted amount for construction is $7,834,000 and $1,085,000 for construction management. Construction management expenditures will be approximately $400,000 under budget and overall the project has finished under budget. The riverbank was found to be unstable and the pipes required restraints using field lock gaskets. The re (design included valvos on both sides of the bank instab0iy area. 005 Allentown Sewer Allentown Raised SS Profile on 44th Place, S 122nd Street and 51st Place S. Change resulted in a significant reduction in the amount of dewatering needed for th e��( pipe installation along 44th Place, 122nd Street and 50th Avenue South. Test holes dug in the vicinity showed a higher than anticipated groundwater table than stated in th geotechnical report 006 I Foster Point- Storm 'Foster Point Extension of 12" Storm Drain at Sta. 24 +10. City maintenance determined a direct connection to the existing catch basin would provide for a better ton term installation and reduce maintenance costs. The work resulted in the pipe crew working nearly an entire day on this connection. 007 1 Foster Point Sewer (Foster Point Realign Sewer on 56th Avenue. Reduced impact on surrounding utilities and private property The credit is primarily due to restocking of manholes. I 008 Foster Point Water Foster Point Pamela Drive Fire Hydrant Extension. Existing fire hydrant is located in the street. Extension will move it beyond the sidewalk into the City of Tukwila' 1 right of way. 009 I Foster Point Storm Foster Point Hancor Pipe to Ductile Iron Pipe: The section of storm pipe between Catch Basin 22 and Catch Basin 23 on 57th was changed from Hancor Pipe to Due Iron Pipe due to insufficient cover. 010 I Allentown Storm (Allentown Ditch Additional 8' lnserta -Tee on S 122nd Street at Sta. 21 +00: Connection of unknown and unmarked storm pipe. 011 Foster Point Sewer (Foster Point Removal of Trees. Contractor was required to remove additional trees which were not shown on the contract drawings. Trees had to be removed lo( facthtate construction, az they conflicted with proposed trench lines and paving Bmits. rl 012 Allentown Sewer Allentown Cut and plug existing 18' Clay Pipe; During installation of the 8' PVC sewer main, an existing 18' clay pipe was encountered al the intersection of 122nd an 42nd (see plan sheet 25 of 70). The 1B' clay pipe was broken. A 12' HOPE had been sleeved through the clay pipe by others. The profile grade of the new 8' PVC via partially into the clay pipe. The Contractor was directed to seal up any opening made as a result of this pipe crossing. 013 Foster Point Sewer Foster Point Relocate Side Sewer Tee 13048 571h Ave S. The side sewer stub for 13048 57th Avenue was installed at the planned location. Following Installation of the stub. the property owner requested a change in the location. The Contractor relocated the stub location on a time and materials (force account) basis. The original Iocatior was plugged and a new tee was cut into the main. 014 Allentown Storm Additional Quarry Spalls at Dutlall Locations: The storm drain outfalls at Foster Point and Allentown specified 4 cubic yards of Quarry Spells per bcalion. Due to the i steep bank conditions and varying topography of the river bank, additional quarry spalls were needed. The installation at Foster Point required a significant quantity of quarry spalls to achieve an installation acceptable to the Department of Fisheries. The pipe encountered was carrying thirty volts of electricity, which was touching the steel shoring. There was no lost time and no fuse aid was necessary. Cast impact for this issue included one and a half hours of shutdown time to analyze the situation. Justification for Change: Correct a safety hazard the existed in the field 017 I Foster Point Sewer 'Addition of Flow Meters at Lift Stations: City requested two flow meters at both the Allentown and Foster Point Lift Stations, These devices will provide operation andl 561,121.0 10 maintenance control by providing flow iniennation. 018 Foster Point Sewer Foster Point Dewatering: The two monitoring wells installed in Foster Point, near the lib station, were converted to production wells. The total cost for two addeddl1 334,572.00 0 dewatering wells in Foster Point was! $45,215.00, minus the cost of the eight monitoring wells (included in the contract) at a cost of 310,643.00. The net increase to th contract is 334,572.00. 019 Foster Point Sewer Foster Point Lift Station Elevation: The Foster Point L91 Station site was raised one loot to provide drainage towards the street. The cost to supply and install a one foot 31,699.23 0 section for the 72' wet well totals 31,015.32, and the cost to supply and install a one foot section for the 48' manhole to match the raised wet well totals $683.91. Cost fa grade ad and related features will be dealt with separately. The City decided to use all pumps from Paco. Due to the length of time to decide on the approved pump, the contractor's quote for the bid pumps expired, resulting in additional costs, During the review process, a number of pump manufacturers were discussed. Quotes were received for providing Cornell pumps for both projects. Based on cost of the Cornell pumps m approximately $10,000 In added costs, the use of Paco pumps was approved, The pumps in Allentown were increased in size from 2 to 3 horsepower, based on further review of the pump performance curves and intended use. The added costs include impacts due to expired quotes, upsizing of pumps from 2 to 3 horsepower, anq extending the power supply cords from 25 to 40 feet, I 022 Allentown Sewer Allentown Conflict with Existing 12" Force Mains on 441h Place South: While installing sanitary sewer in Allentown, the existing twin face mains which are depicted on the plans to parallel the 8" sewer line on 44th Place South, were in conflict with the centerline of the 8" PS for 40% of the length of the run. As a result, portions of the twc force mains had to be removed with the excavation of the 8' PS, causing slow down, extra work and eventual disposal of the removed pipe. The sewer main between MH 5C PL -03 and 50 PL -01 was lowered from 1.0% to 0.4 As a result, the 8" stub out of MH 50 PL -01 was in direct conflict with the two 12" abandoned force mains, which had to be cut out and plugged with concrete. 023 Allentown- Water (Allentown Locating Water on 44th Place and 122nd Street: Pothole to locate existing 8" water main in vicinity of proposed sanitary sewer at 44th Place and 122n1 Street. Based on findings, City directed contractor to install two temporary water services to 12207 51st Place and 4918 122nd Avenue. 024 1 Allentown Water 'Allentown Extension of Water Main on 42nd Avenue: Ten feet of additional 4" line was installed at STA 27 +34 on 42nd Avenue South (Plan Sheet 28 of 70). Thd shackle rod restraint and removal of thrust block is incidental to contract work indicaled on the plan note for the water line. 026 Allentown Water Allentown Fire Hydrant Relocation: Contractor relocated two existing fire hydrants. The Ore hydrant at STA 30+97 LT (Plan Sheet 13 of 70) is In direct conflict with th proposed 8' sanitary sewer, and was extended beyond the limits of the sewer trench. The fire hydrant at STA 28+06 RT (Plan Sheet 28 of 70) is to be moved out of th proposed sidewalk lints. Both locations were reviewed and approved by the City of Tukwila Fire Marshall. 027 I Allentown Storm Allentown Curb and Gutter on 42nd Avenue: Based on field review of existing conditions, additional driveways were added to the contract as well as widths o 'driveways being adjusted to accommodate existing driveway locations. 028 Allentown Water Additional Fire Hydrants: At the request of the City of Tukwila, four additional fire hydrants are to be added to the project at the following locations: Allentown 44th Place South 10 +75 23' RT, Allentown 10 50th Place South 21 +25 20' RT; Foster Point C1.06 Pamela Drive 61 +39 17' RT; Foster Point C1.02 56th Ave S, 20+80 17' RT 029 Allentown Sewer Allentown Relocation of Sewer on 49th Avenue S and 124th: Per field directive dated September 29, 2006, the location of SSMH 4-124-04 (plan sheet 12 o170) at the' intersection of South 124th Street and 49th Avenue South was moved north approximately 7 feet. SSMH 4-124-03 (west of SSMH 4-124-04) was moved 2 feet to the north This moved the sewer line out of the roadway to limit the amount of impact to the truck traffic along 124th and reduced the overall amount of roadway rehabilitation necessary, of approximately 175 LF on 124th Street. 030 Foster Paint Sewer Foster Point Field Adjustments for Fiber Optic: Conflicts were encountered with the buried fiber optic cable running near the centerline of 56th Avenue South. On 5113106, while setting Manhole 4 in Foster Point, the fiber optic line was found to cross directly in the planned location of SSMH 4. This manhole was moved 2.5' south lc avoid the conflict. On 5131106, while constructing 8" SS pipe towards SSMH 5, the fiber optic line conflicted with the proposed sanitary sewer alignment, requiring slowed production to protect the existing fiber optic facilities. The fiber optic line was not as shown on the bid documents. 031 Allentown Water Allentown Electric Line Entangled in Magnolia Tree: A magnolia tree was in line with the location for a side sewer service at the residence of 12050 441h Place (plan sheet 2 of 70). Due to the proximity, the sewer location remained and the magnolia tree was removed with the property owner's permission. Upon removal of the tree an its rootball, adjacent underground utilities to the house were damaged, as the roots had grown around the underground lines for power, 032 Allentown Storm Allentown Replace 18" Storm Drain Pipe With 18" Ductile Iron Pipe: Per the request of John Howat, City of Tukwila, the following changes are being made to th storm drain system: 1. Plan sheet C3 of C5 and 4 of 70 Replace existing 18" concrete pipe with 45 LF of 18' ductile Iron pipe from CB 5 (Sta. 21 +71.93 -14.14 RT) to th roadside ditch at sta. 21 +72 LT Install a new CB Type II 48' diameter. and install 100 LF of 24' diameter Hancor Hi -Q pipe (HOPE), and construct a rock spillway in th existing roadside ditch. 2. Plan sheet 3 of 70 Delete the proposed 60 LF of 18' ductile iron culvert at Sta. 16+00 LT this location was found to be at a high spot In the ditch profile, rendering the proposed culvert useless. 033 Foster Point Sewer Foster Point Addition of 7 LF of 12" storm drain pipe: Added storm drain pipe on 56th at added catch basin near the pump station. Due to a conflict with an existing( 5220.5C 0 MCI fiber vault, the catch basin was relocated from Sta. 14+95. 12' LT to Sta. 15 +10, 12' LT. The added crossing, catch basin, and connection to the stormcepler manhole! at Sta. 14+95, 12' RT, was addressed by issue 48 and a separate change order. This specific change is for the shilting of the catch basin, and subsequent need for 7 LF of 12" PSD. ISales Tax 8.8% 034 Allentown Water Allentown Water Main Extensions at 124th and 51st: The proposed sanitary profile conflicted with the design grades of the waterline at the intertie on plan sheet 13 of 54,018.91 1 70 Sta. 18+05 (51st Place South), at the intersection of 51st Place South and 124th Avenue. The resolve the conflict, the following additional work was performed: 1 Construct a vertical waterline adjustment, per plan sheet 47 and 48. 2. Replace the thrust block on the waterline, east of the sanitary sewer, as the existing block was disturbed. 3. Encase the new 8' sanitary sewer in 12' ductile iron pipe for a length of 20 feet, centered on the waterline crossing. The sanitary sewer will be above tha waterline. 4. Backfill the affected area with CDF. 035 1 Allentown Sewer 'Allentown Tree Slump Removal at Sta. 14+64 RT: Tree stump encountered at Sta. 14.64 RT, at house 12253 51st Place was not shown on plans. The stump had 10 1 5192.851 0 1 removed to install a 6' side sewer. 036 Allentown Water Allentown Replace 314" Corp with Stainless Steel Repair Band: Abandoned water service at Sta. 13+40 on 501h Place South was struck by Contractor. The service $500.00 0 was unmarked and unknown. The City of Tukwila Water Department directed the Contractor to remove the existing 54' Corp service from the top of the existing water main and install a City provided stainless steel band to patch the hole. This new stub will provide service for future development. 039 Foster Point Roadway Foster Point Toddland Addendum 3: At the intersection of S. 133rd Street and 57th Avenue South (Sta. 42+64). the design show a portion of the roadway extendin beyond the 90 degree lum In the road. This section of road is to act as a fire lane. As directed by the fire marshal, the limits of paving for this area are to be extended 1 feet in width, for a total width of 30 feel, to provide suitable tumaround for the fire department This change will provide for the added pavement and related grading in thi area. 046 Foster Point- Roadway Foster Point Steel Plate Root Barrier: Existing tree roots were cut during installation of sanitary sewer along the north side of street on 57th at Sta. 44+80. A steel plater root barrier was installed to prevent roots from extending into the roadway prism. Reference plan sheet C1.05. An overlay would not provide a suitable roadway section. 042 Foster Pont- Roadway Foster Point Extension of Overlay on 130th: Change Order 1 extended and re- aligned the storm drain on S. 130th Street to the east side of the roadway, and also( 59,061.W 0 06.82 5286,130,12 extended the stone drain north to Sta. 84 +37, in Foster PoinL Following installation of the stone drain, it was determined that the subgrade conditions were saturated, and not suitable for a 2' asphalt overlay from Sta. 82+70 to Sta. 81+60. Additional shoulder preparation was performed, and the adddion of a 2' g1t of asphalt was constructed k provide a weather proof base, and improve the roadway section strength. Secondly, the limits of the overlay were extended from Sta. 84 +30 to Sta. 82+90 on S. 1308 Street, to Improve the roadway following the instanation of the storm drain an the west side of the roadway. This resulted In an additional 44 Tons of asphalt and relate preparation, striping, and other work. 043 Foster Point Roadway Foster Point Revised Grades at 57th and 133rd: The planned elevations for the asphalt overlay at STA. 41 +92 (corner o15701 Ave S. and S. 130th SL) were too low for $7,110.52' 1 56,832,240.64 $293,240.64 residential driveway transitions. This move was made to provide a more protected location for the hydrant. This change required additional fittings to vertically deflect the hydrant service line tc provide adequate clearance under the existing road side ditch. This will permit improved turning movements on the roadway. The typical section specified a width of 18' on plan sheet 52 of 70. This change provides payment for the added 8 tons of ACP necessary to accomplish this widening to a 20' width. 056 I Foster Point Sewer (Foster Point Lift Station No. 8 Gate Modifications •The fence gate at Litt Station No. 8 in Foster Point was designed to open into the street. Due to the proximity of the 5429.601 0 gate to the street, the fence was redesigned to slide. This required additional hardware and fence modifications. I I 057 Allentown Roadway VMS Signs for 50th Place Paving: Upon review of the traffic control plan for 50th Place South paving, it was decided that Variable Message Signs (VMS) signs should be $1,201.5C 0 utilized. Justification for Change: 50th Place South is a main thoroughfare for traffic from Interurban to SR900 through Allentown. The paving activities would require! shutting 50th Place South down, thus VMS signs were used in advanced to warn traffic to use alternate routes, therefore lessening the impact to the community. 058 Allentown Roadway Pavement Section Change on 50th Place: The pavement section on plan sheet 52 of 70 varied from the conditions found in the field. The existing pavement depth varied! 530,041.7f 1 from over 12' of ACP to 2' of ACP. To provide a consistent pavement section from Sta. 11+47 to Sta. 23+86, and to provide a stronger cross section for the truck traffic or this roadway, the following pavement section was agreed to, as outlined in DMJM Harris' letter of October 16, 2006. The design section had shown a 2" layer of ACP Class B over 2' of CSTC. The paving was revised to the following: Sta. 11+47 to 18 +75: 4" ACP Class B over 12' of ground existing roadway Sta. 18 +75 to 23+86: 2' ACP Class B overlay. The change resulted in an increase of 310.E tons of ACP Class 8, a reduction of 278 feet of pavement grinding, and a reduction of 370.18 tons of crushed surfacing top course (CSTC). Justification tar Change: Creates better quality product for the amount of traffic using the road. 059 Allentown Sewer Potholing: During construction there were various locations the Contractor was directed to pothole for possible revisions to the contract documents. Near 116th Street it was particularly close and DMJM Harris directed Contractor to place approximately 250 feel of guardrail from Sta 33+00 to Sta. 36+00 Justification for Change: Safety concerns for traffic on 42nd Avenue. 066 Allentown Water Allentown Installation of 8" Water Line to Connect to 4" Line: Alter installing the 8' water line to connect to the existing 4' line at 42nd Avenue and 124th, the" Contractor was directed to make the connection further back to eliminate all of the old 4'. In doing so, the new line was approximately 2 W higher than the new connection point. In order to make the connection, the City of Tukwila required al pipe to be restrained to an "H" beam assembly encased in concrete. Sta. 27 +34, 2' LT. Justification for Change: The location on the drawings for the connection was not true to the actual location in the field. In some cases, steps were formed and placed as well as extending aprons to meet existing concrete driveways. Justification for Change: Severity of transitions on 42nd Avenue on various sidewalks and driveways were such that the Contractor incurred additional costs for concrete and labor. 069 Allentown Roadway Allentown 1 Foster Point- Additional Asphalt and Re- Grading: Alter the streets were paved throughout Foster Paint and Allentown, the City Engineer and DMJM Ham reviewed the site and identified driveways that should have had asphalt aprons to accommodate driveway transitions. Also Included in this change is the asphah around th flow -meter at Foster Point. The asphalt was needed around the lbw -meter because of the location at bridge. Recently, it was observed by the City of Tukwila that th landscape strip behind the Foster Point Litt Station was not desired for maintenance purposes. BACKGROUND The City of Tukwila has completed the water, sanitary sewer, and surface water improvements in the Allentown Phase II and Foster Point neighborhoods. The entire costs have been determined and we are now able to set water and sewer connection fees. The sewer connection fee was capped at $15,000 by the City Council at the April 24, 2006, Committee of the Whole Meeting. The City has recovered a portion of the construction cost on the Allentown Phase I, Ryan Hill, and Duwamish neighborhood improvement projects through connection fees for new connections to the water and sewer systems. RCW 35.92.025 allows the City to charge for the installation of water and sewer systems such that the property owners bear their equitable share. This also includes interest charges for a period not to exceed ten years at a rate that commensurate with the rate that of interest applicable to the City. ANALYSIS The sanitary sewer costs for Allentown Phase II and Foster Point totaled $4,917,229.68 with an estimated total of 250 possible connections to the sanitary sewer system. The connection fee based on 250 connections is $19,668.92, however the City Council capped the sewer connection fee at $15,000 on April 24, 2006. The water costs for Allentown Phase II and Foster Point totaled $2,061,782.25 with an estimated total of 250 possible connections to the water system. Dividing the $2,061,782.25 by 250 connections is $8,247.13 for the start amount of the water connection fees. The water and sewer connection fees will go up each year. The rate will be 4% on the first year and will increase by that same dollar amount every year for 10 years. The monthly payment with an annual interest rate of 4% will be calculated for a 5 10 or 15 -year term. Only existing individual single family applicants are eligible for the payment plans. 3. New homes constructed after September 1, 2007 are required to make full sewer connection fee payment before issuance of the City of Tukwila's building permit. New homes are also required to pay in full the current fee set for the King County Sewer capacity charge and bring proof of payment to the City's Permit Center prior to the Public Work's final inspection approval. 4. Change of ownership requires payment in full of the sewer connection fees. Remodeling construction is required to pay sewer connection fees prior to issuance of building permit unless home is on the payment plan, which may be continued. 5. Monthly payments may be started prior to obtaining a sewer connection permit. 11 1�- 6. Monthly payments may be initiated as a payment method until December 31, 2017 for Allentown Phase II and Foster Point. After December 31, 2017, the sewer connection fee must be paid in full. D. The sewage treatment capacity charge is a charge in addition to sewer service billed to those customers who connected to the sani- tary sewage system on or after Feb. 1, 1990. WHY DO WE HAVE A CAPACITY CHARGE? To protect public health and the environment, King County's C wwastewater treatment system must keep pace with growth in our region. That means building more pipes, pump stations, and treatment plants. BACKGROUND The Notice to Proceed for Contract No. 07 -063 with Construct Co. of Sumner, WA was issued on May 14, 2007. This project repaired the sanitary sewer line on the north side of Westfield Mall. A section of the City-owned sanitary sewer line near Macy's had settled which caused a low spot in the sewer line. The Developer's Agreement required that the City repair the sanitary sewer before the sewer could be turned back to the Mall for ownership and maintenance This 20- calendar day contract was supposed to be substantially completed on June 3, however, due to massive utility conflicts the substantial completion was not achieved until July 3, 2007. Change Order Number 1 has been negotiated at $120,000.00 to cover the resolution of considerable utility conflicts and will be paid as Force Account (time and materials). The entire week of night work between Sunday May 20 and Monday May 28 was spent potholing and analyzing the extensive concrete encased power conduits found to be placed over the existing sanitary sewer. The power conduits were found to be secondary power, which was not located by PSE. Westfield was not aware of the location and did not know they were responsible to locate the power conduits. The sanitary sewer alignment had to be re- designed away from the power conduits. See Exhibit A (as -bid design) and Exhibit B (re- design). After potholing again for utility conflicts on the re- designed alignment on May 31, work began on the new alignment on Friday night, June 1 and the manholes and pipes were successfully installed June 7. The following week was spent re- connecting the side sewers to the mall, grouting manholes and cleaning up. ANALYSIS While this change order amount is very high, the amount of re -work and extra work was extraordinary. The change order includes additional compensation for: standby time waiting for the new design (the average daily standby rate for this amount of labor and equipment was $3,000); extended bypass pumping at over $4,100, the additional asphalt patching was almost $9,000; and the seven nights of potholing averaged $8,000 for each night. The Developer's Agreement with Westfield does not require Westfield to locate utilities for the City's repair work. However, the Agreement requires that Tukwila repair the sewer in order to accept all of the water and sewer system. This turnover will eliminate several days of maintenance per year. The contract award amount was $100,559.62 plus 10% contingency for a total of $110,615.58. The budgeted amount is $150,000. The final total contract amount is expected to be around $221,000.00 and the contract will be closed out after final payment. The $71,000 budget shortfall will be taken out of the ending fund balance for the sewer fund (402.02). ISSUE Approve Supplemental Agreement No. 2 with Abacus Engineered Systems for final design of Year 1 Standby Power upgrades for City Hall, Fire Stations 52, 53, and 54. BACKGROUND Abacus has completed a Standby Power Upgrade study and preliminary design for nine City facilities. These include City Hall, the 6300 Building, and Fire Stations 51 through 54, George Long Shops, Minkler Shops, and the Community Center. ANALYSIS The original contract and Supplement 1 work (added the shops and Community Center) has been completed. Supplement 2 provides final design and construction observation services for Year 1 Standby Power upgrades for City Hall, Fire Stations 52, 53, and 54. This Supplemental Agreement No. 2 in the amount of $101,364.00 is fair and reasonable and within the current budgeted amount for the 303 fund. The City desires to supplement the agreement entered into with the Consultant and executed on, July 31, 2006, and identified as Agreement No. 06 -074. All provisions in the basic agreement remain in effect except as expressly modified by this supplement. The changes to the agreement are described as follows: 1. Please consider this letter and the attached documents as our proposal for the design and construction phase of this project. Scope of Work General This proposal identifies the scope of work, proposed deliverables and engineering services fee for the design of new standby power generators and electrical distribution system upgrades to four buildings for the City of Tukwila: City Hall, Fire Station 52, 53 and 54. The design and construction documents will be develop based on the concepts outlined in the pre- design report provided previously. The scope also includes design of electronic reader boards at Fire Station 52, 53 and 54. Scope of Work and Deliverables Basic Services The scope of work includes the following: 1. Design Phase Services: a. Construction documents based on one bid package complete and ready for public bid. Construction documents will include full plans and specifications. Plans will be produced in AutoCAD and specifications will be prepared using the current Abacus master specifications and the city of Tukwila's boilerplate proposal forms. b. Progress submittals will be provided for customer review at 50% and 95 c. Final documents will be provided to the customer for reproduction and distribution to prospective bidders. One reproducible hard copy and one electronic copy will be provided. 2. Construction Phase Services: a. b. c. d. e. f. Attendance at a pre -bid walk through and response to pre -bid RFI's. Attendance at one pre- construction meeting. Submittal reviews and response to RFI's during construction. Four on site construction meetings.. One substantial completion inspection site visit and report. Sales Tax: Should Abacus be liable for any additional tax, duty or tariff, related to the subject matter of this agreement, Owner is obligated for the same. Therefore, Abacus should be equitably reimbursed for any additional tax, duty or tariff assessed in addition to those currently in effect or for any tax, duty or tariff retroactively determined to be due on services rendered, or on products delivered by Abacus to the Owner.
