Mullet called the Tukwila City Council meeting to order at 7:01 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, Deputy City Clerk, called the roll of the Council. Present were Verna Griffin, Council President; Councilmembers Joe Duffie, Joan Hernandez, Pam Carter, Jim Haggerton, Pam Linder, and Dennis Robertson. CITIZEN COMMENTS TUKWILA CITY COUNCIL July 16, 2007 7:00 p.m. Council Chambers City Hall Brian Kennedy, 12802 37th Avenue South, noted the Boeing Access Road /East Marginal Way Paving Project has been completed and inquired if signage or markings will be included to designate the lanes more clearly. Mayor Mullet explained the traffic studies done of this area convey the signage and markings to be appropriate for the roadway. Joanne McManus, 5610 South 133rd Street, indicated she recently participated in a trip for seniors at the Tukwila Community Center. The bus was used for this event making the ride much more comfortable and provided easier access when entering and departing the vehicle. She commented the bus is rarely used due to the unavailability of personnel who can drive the vehicle and hoped this could be rectified. Dwight McLean, 13015 38th Avenue South, relayed the importance of moving forward with the Tukwila Village Project. He also indicated the Highway 99 Action Committee will not be having its 11th annual barbecue due to issues regarding food handler permits. Marie Parrish, 4430 South 150th Street, expressed her enjoyment of the 4th of July event and the Tukwila Days Community celebration. CONSENT AGENDA a. Approval of Minutes: 7/2/07 (Regular). b. City of Tukwila Citv Council Reaular Meetina Minutes PUBLIC HEARINGS a. An ordinance raising the threshold for SEPA environmental review to 12,000 square feet and 40 parking stalls for commercial /industrial construction and nine dwelling units for residential construction, and to adopt the Optional Determination of Non Significance (DNS) process under WAC 197 -11 -355. Nora Gierloff, Planning Supervisor, provided an overview of the public hearing topics. With regard to the first public hearing item, the State Environmental Policy Act (SEPA) requires a standard checklist be filled out by a project proponent to identify the environmental impacts of certain actions. The intent is to identify environmental impacts that would otherwise fall through the cracks and provide a mechanism for public review and mitigation. Jurisdictions have flexibility in setting the thresholds that trigger SEPA review up to the maximum level allowed by the State. They may also take advantage of an optional SEPA process that allows them to identify projects where significant adverse environmental impacts are unlikely and combine the comment period on that determination with the notice of application comment period for the underlying permit. The Planning Commission recommendation is to increase the commercial/ industrial threshold to 12,000 square feet and 40 parking spaces (from 4,000 square feet and 20 parking spaces) and institute the Optional Determination of Non Significance (DNS) process to run concurrent comment periods for the project and SEPA. It is also recommended the threshold for single family construction be raised from 4 dwelling units to 9 dwelling units. This will result in smaller projects not being required to fill out a SEPA checklist. 7:12:22 pm Mayor Mullet opened the public hearing and called for citizen comments. Peggy McCarthy, 14227 56th Avenue South, inquired if this makes the process more restrictive or less restrictive for projects and asked if this will have an impact on the environment. Mayor Mullet indicated this will make the SEPA process, which can be quite lengthy, more user friendly for smaller projects. He also relayed it should not result in an environmental impact. 7:14:36 pm Mayor Mullet closed the public hearing. 7:15:57 pm Mayor Mullet opened the public hearing and called for citizen comments. Page 2 of 9 July 16. 2007 b. Zoning Code Amendments that will: 1. Create a process for determining the number of wetland mitigation credits required for off -site mitigation; and 2. Restrict expansion of houses into non conforming setbacks; 3. Allow retaining walls up to four feet high in setbacks, allow retaining walls over four feet high in setbacks, under certain conditions; 4. Provide an administrative lot area variance in the LDR zone and update the permit classification table. 1. Create a process for determining the number of wetland mitigation credits required for off -site mitigation. The proposal is to amend the Sensitive Areas Ordinance (SAO) to allow the Director to establish a mitigation ratio that meets the intent of the SAO for specific wetland mitigation banks. Wetland mitigation banking as a tool for off setting unavoidable impacts to wetlands is becoming more important, and the City is starting to see proposals for off -site mitigation at banks. A wetland mitigation bank is the consolidation of small, fragmented wetland mitigation projects into a large contiguous site where creation, restoration and enhancement is carried out in advance of the impacts. Banks are established under a formal and rigorous permitting process. City of Tukwila City Council Regular Meeting Minutes The City's current ordinance permits off -site mitigation, and even mitigation outside the city limits of Tukwila, as long as the mitigation site is within the same river basin. The mitigation ratios established in the SAO apply to both on -site and off -site mitigation. The SAO does not address transferring mitigation to a mitigation bank, which uses "credits" as opposed to acreage in determining the amount of mitigation needed. Determining if the amount of mitigation bank credits meets the City's mitigation ratios is not straightforward. The proposal would amend the Sensitive Areas Ordinance to permit the DCD Director to establish a ratio of mitigation acreage to wetland bank credit for off -site mitigation. Brian Kennedy, 12802 37th Avenue South, relayed that on South 126th Street and 37th Avenue South, there was a pond that underwent some changes. The neighborhood had enjoyed listening to the frogs, and after the changes to the pond, the frogs were gone. He inquired as to whether changes in wetland areas require maintenance of the wildlife. Nora Gierloff, Planning Supervisor, indicated that mitigation regulations have not changed and involve maintaining plant life and do not include wildlife restoration. 2. Restrict expansion of houses into non conforming setbacks. (This item was inadvertently discussed first during the public hearing prior to #1 above) Tukwila Municipal Code 18.70.050 (6) states "single family structures in single or multiple family zone districts, which have legally non conforming building setbacks, shall be allowed to expand along the existing building line(s) if the existing distance from the nearest point of the structure to the property line is not reduced." This provision has been used in ways that significantly increase the area of non conformity and impact upon the neighboring property. The Planning Commission recommendation is to allow the structure to be expanded into the setback along the existing building line on the ground floor so long as the existing distance to the property line is not reduced and the square footage of the expansion into the setback does not exceed 50% of the square footage of the current intrusion. Page 3 of 9 July 16. 2007 3. Allow retaining walls up to four feet high in setbacks, allow retaining walls over four feet high in setbacks, under certain conditions. There are several different standards for whether retaining walls or rockeries can be located in required setbacks, which leads to confusion and in some cases unusable yards. The Building Code allows most rockeries and retaining walls up to 4 feet high without a permit which many people assume is the trigger for meeting setbacks. While the intent may have been to prevent a neighbor from having to look at a tall retaining wall on the property line, it sometimes has the effect of creating a yard that is unmaintained and unusable to the property owner because of the grade separation. Rockeries are rarely allowed to retain more than 4 feet of earth so their height is less of an issue. The Planning Commission recommendation is that retaining walls and rockeries with up to 4 feet of exposed face be allowed in yards to match Building Code requirements. This could be increased in special circumstances if the property in question is on the lower side of the retaining wall; if the wall benefits the lots on both sides of the property line; or if the wall is needed due to right -of -way improvements. The minimum lot size in Low Density Residential, Tukwila's single family zone, is 6,500 square feet. There are areas of the City that were platted prior to current zoning regulations with different lot patterns such as 3,000 square feet. These substandard lots are no longer considered individual building sites since the passage of Ordinance 2097. This means a property owner might have to aggregate five or City of Tukwila City Council Reaular Meeting Minutes more lots totaling 15,000 square feet in order to create two building sites as opposed to the 13,000 square feet required by code. Another situation is where an owner wishes to subdivide a lot over 13,000 square feet but also wants to retain an existing home that is sited near the middle of the lot so that a new lot cannot be created that meets both setbacks from the existing house and the minimum lot size. The Planning Commission recommends creation of an administrative variance to the DCD Director for reductions in lot size of up to 500 square feet per lot for up to two lots to streamline the process for lots that are just under the threshold for subdivision or where there is an existing house that prevents the lots from being divided equally. Requests for greater reductions through a variance would still require a public hearing before the Hearing Examiner. There are also a few decisions called out in the Zoning Code that are not listed in the table at TMC 18.104.101. In addition, the proposed changes above, if adopted, would add a new decision to the code. Chuck Parrish, 4430 South 150th Street, spoke in support of the proposed ordinance. Mr. Parrish is a Tukwila Planning Commissioner and is speaking for himself this evening. He conveyed that the recommendation is to allow exceptions to the 6,500 square foot standard to no less than 6,000 square feet. In his view, there are cases where hardships do exist, and this would not represent a wholesale departure from the City's Comprehensive Plan. He expressed the importance of the Council striving to serve the citizens of Tukwila and that nothing is etched in stone; if decisions are made that do not work, they can be changed. Peggy McCarthy, 14227 56th Avenue South, spoke against the proposed ordinance. Ms. McCarthy indicated she was surprised when the lot sizes were changed in 1995 and does not want to see them lowered any further. She relayed she finds it difficult to understand what would qualify as a hardship. Betty Brooks, 12217 46th Avenue South, spoke in favor of the proposed ordinance. Ms. Brooks has a 12,000 square foot lot in Allentown; her house is on one side and not in the center of the property. She could build another house on the other side of the property, but would need the and divided into 2 lots. City of Tukwila City Council Reaular Meetina Minutes Item #4 on Page 2 of the proposed ordinance reads: 4. When a wall or walls are needed to create a vehicular access road that meets Fire Department slope requirements, and the exposed face either has a decorative /textured treatment or is screened with landscaping. Councilmember Robertson referenced the informational memo from the Department of Community Development Director on Page 16 of the agenda packet. An option presented for consideration by the Council is to "Delete 4 since the situation would already be covered by 1." Item #1 on Page 2 of the proposed ordinance reads: 1. When the applicant's property is on the lower side of the retaining wall and it is not visible from adjacent properties or is screened by landscaping. Councilmember Carter expressed concern regarding the above option as it does not take into account a home that is on the upper side of a retaining wall or the variables involved with different slopes or access points. She is also in favor of allowing the decorative /textured treatment option as landscaping is oftentimes left in an unmaintained condition. *MOTION CARRIED 6 -1 WITH COUNCILMEMBER CARTER VOTING NO. *MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2176 AS AMENDED. MOVED BY LINDER, SECONDED BY CARTER THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* The Councilmembers discussed this issue at length and expressed key points regarding the proposed ordinance as follows: difficulties involved with determining the definition of a hardship; the possible detrimental affect to existing neighborhoods resulting from lowering lot sizes; acknowledgement of past citizen comments against lowering lot sizes; recognition that some areas of the City (such as Allentown) already have homes on 3,000 sq. ft. lots and allowing additional subdivisions in this area would not be out of place; an awareness that more owner occupied homes equates to more citizens taking a stake in the community; the suggestion that this issue should be part of the Comprehensive Plan Amendment process; concern for property owners who purchased lots prior to annexation to Tukwila who thought they had buildable lots; and the need to allow flexibility in special circumstances to Tukwila citizens. *ROLL CALL VOTE TO ADOPT THE PROPOSED ORDINANCE: DUFFIE NO HERNANDEZ NO CARTER YES HAGGERTON NO LINDER YES ROBERTSON NO GRIFFIN NO MOTION FAILED 2 -5. City of Tukwila City Council Reaular Meeting Minutes Jack Pace, Acting Community Development Director, explained the staff will be reviewing residential standards later this year, and this issue could be re- visited at that time. Council consensus existed to review this matter at that time. 8:25:58 Mayor Mullet declared a five minute break from the meeting. 8:37:02 Mayor Mullet re- convened the Regular Meeting e. Tukwila Village Review. Derek Speck, Economic Development Administrator, utilized a Powerpoint presentation to provide a synopsis of the Tukwila Village project to include the original project vision; steps to date and milestones; expenditures and remaining budget; previous concepts; and examples of redevelopment projects in other cities. Mr. Speck is seeking confirmation that the following project vision statement from the 2001 Request for Proposals still meets the Council's intent with regard to the project. The City strongly desires a project that will result in a city center...Through the installation of a public plaza or similar feature, it is the City's intent to create a sense that you have arrived at a special place. This community space must be fronted with retail shop space...to create a community gathering place...The City both supports and encourages proposals that integrate housing throughout the project." 1. A community focal point and gathering place Page 8 of 9 July 16. 2007 The Councilmembers asked questions of Mr. Speck regarding the presentation and exchanged comments to include: support for the concept recently presented by Metrovation; the need for a quality neighborhood center and cleaning up the highway; lack of endorsement by some Councilmembers for putting apartments in the development; a willingness to consider apartments if, after analysis, it turns out to be the most practical choice; support for the library as an anchor tenant; the need for a police presence and the Neighborhood Resource Center in the development; the desire to get started on the project; and consensus support for the vision statement. Mr. Speck indicated further discussions on this issue will be undertaken in the next couple of months. It was expressed that the Councilmembers receive information to be discussed at the meetings in the agenda packets. It was also requested the Council President be apprised of scheduled meeting dates as soon as they are available. Dwight McLean, 13015 38th Avenue South, indicated he had been on the original task force to provide design ideas for development of the highway. He would like to see the Tukwila Village project move forward. Chuck Parrish, 4430 South 150th Street, conveyed that while he is in favor of owner occupied housing, the City should remain open to the concept that market conditions may favor apartment housing. He indicated that apartments could be converted to condominiums in the future if necessary. Brian Kennedy, 12802 37th Avenue South, relayed that it is necessary to pull people out of the neighborhoods, and that in addition to the library, there should be quality restaurants and attractions. Janis Taylor from Secret Garden Statuary on Pacific Highway South suggested the project could contain a combination of both apartments and condominiums. It has been her experience that senior citizens are being advised to move into apartments as opposed to condos. She also indicated the City should "think young" when making decisions regarding the development as it is important to attract young people to the area. City of Tukwila City Council Peculiar Meeting Minutes Page 9 of 9 July 16, 2007 Gary Vanderhoff, Pastor, Neighborhood Life Center, suggested that possibly the partnership with the library could involve acquisition of their property. Marie Parrish, 4430 South 150th Street, indicated the City does need a gathering place for citizens that includes a bakery and a coffee shop. The library, Neighborhood Resource Center, and small retail shops would be a great addition to the City. REPORTS The Mayor and Councilmembers discussed concern about the upcoming candidate night and budget review meeting both scheduled for August 2, 2007. Council consensus existed to re- schedule the budget review meeting to another date. Councilmember Haggerton distributed a memorandum from Darrell Baskin, Assistant Police Chief, regarding the Edward Byrne Justice Assistance Grant Program for 2007. The City has been granted $29,453.00 that will be used for (1) Crime scene mapping and incident response preparation; (2) Utilization of existing technology to monitor pawned property; (3) Enhanced utilization of Emergency Operations Center (EOC) operations.
