HomeMy WebLinkAboutOrd 0781 - LID #22 (Local Improvement District) CITY OF TU KWILA WASHINGTON ORDINANCE NO. 781 AP/ AN ORDINANCE ORDERING THE IMPROVEMENT OF A PART OF THE CITY OF TUKWILA BY CONSTRUCTING STORM DRAINAGE, CURBS, GUTTERS, SIDEWALKS, UTILITY CORRIDORS, CANITARY SEWERS COMPLETE WITII NECESSARY MAINC, MANHOLES, SIDE SEWERS AND APPURTENANCES AND STREET DEVELOPMENT AND SURFACING, ALL IN ACCORDANCE WITH RESOLUTION NO. 346 OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO. 22; PROVIDING THAT PAYMENT FOR SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON PROPERTIES IN SAID DISTRICT PAYABLE BY THE MODE OF "PAYMENT BY BONDS" AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEM- ABLE IN CASH AND LOCAL IMPROVEMENT DISTRICT BONDS. WHEREAS By Resolution No. 346, adopted May 7, 1973, the City Council of the City of Tukwila, Washington, declared its intention to improve the area within the corporate limits of the city of Tukwila by the construction and installation of storm drainage, curbs, gutters, sidewalks, utility corridors, ster4t.e. szwe �onplc4:. with ncccssary mains, manholc3, sidc sewers a- appurtcnancc3 and street development and surfacing on Andover Park West in the City of Tukwila, and to create a local improvement district to assess the cost and expense of carrying out such im- provement against the properties specially benefitted thereby, which said Resolution fixed the 2nd day of July, 1973, at 8:00 P.M., Pacific Daylight Time, in the council chambers in the City Hall, Tukwila, Washington, as the time and place of hearing all matters relating to said proposed improvement and all objections thereto and for determining the method of payment for that im- provement; and WHEREAS, Harstad and Associates, consulting engineers, caused an estimate to be made of the costs and expenses of the proposed improvement and certified said estimate to the City -1- Council, together with all papers and information in its possession touching the proposed improvement, a description of the boundaries of the district, a statement of what portion of the cost and expense of the improvement should be borne by the properties within the proposed district, and a statement in detail of the local improvement assessments outstanding or unpaid against the properties in the proposed district; and WHEREAS, SAID Estimate is accompanied by a diagram of the proposed improvements showing thereon the lots, tracts, parcels of land and other property which will be specially benefitted by the proposed improvement and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property; and WHEREAS, Due notice of the hearing upon said Resolution No. 346 was given in the manner provided by law and said hearing was held by the City Council on July 2, 1973, and all written protests filed with the City Council on or before said date were duly considered by the City Council and overruled and all persons appearing at said hearing were heard; and WHEREAS, The City Council has determined it to be in the best interests of the City that said improvement as hereinafter described be carried out and that a local improvement district be created in connection therewith; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Tukwila, Washington, hereby orders the construction and installation of storm drains, curbs, gutters, sidewalks, utility corridors, sanitary sower= complete with necessary mains, manholoc, s =fie szt.:asro and appurtenances and street development and surfacing along Andover Park West as more particularly described in Exhibit A attached hereto and by this reference made a part hereof. All of the foregoing shall be in accordance with the plans and specifications therefor prepared by Harstad and -2- Associates, Consulting Engineers to the City. Section 2. There is hereby created and established a local improvement district to be known and designated as Local Improvement District No. 22 of the City of Tukwila, Washington, all within the corporate limits of the City of Tukwila, the boundaries of which are more particularly described in Exhibit B attached hereto and by this reference made a part hereof. Section 3. The total estimated cost of such improve- ment is hereby declared to be $325,000.00, all of which cost shall be borne by and be assessed against the properties specially benefitted by such improvements included in the local improvement district herein established, embracing as near as may be all property specially benefitted by such improve- ments. Section 4. In accordance with the provisions of Section 7 of Chapter 258, Laws of Washington, 1968, 1st Ex. Sess. the City may use any method or combination of methods to com- pute assessments which may be deemed to fairly reflect the special benefits to the properties being assessed. Section 5. Local Improvement District warrants shall be issued in payment of the cost and expense of the improvement, such warrants to be payable out of the "Local Improvement Fund, District No. 22" hereinafter created, to bear interest from the date thereof at a rate to be hereafter fixed by ordinance, not to exceed 8% per annum, and to be redeemed in cash, and /or by local improvement district bonds herein authorized to be issued, such interest bearing warrants to be hereafter referred to as "Revenue Warrants." Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not to exceed 8% per annum, shall be payable on or before 12 years from the date of issuance, the life of the improvement ordered being not less than 12 years, and shall be issued in exchange for and in re- demption of any and all revenue warrants issued hereafter and -3- not redeemed in cash within a period of not to exceed 60 days after the first publication by the City Treasurer of notice that the assessment roll for Local Improvement District No. 22 is in her hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied andamsessed upon the property within said district payable in ten equal annual installments with interest at a rate to be hereafter fixed by ordinance not exceeding 8 1/2% per annum under the mode of "Payment by Bonds" as defined by law and the ordinances of the City of Tukwila, Washington. In the case of default in the payment of any assessment when the same shall become due there shall be added interest at a rate to be hereafter fixed by ordinance not to exceed 8 1/2% per annum and a penalty of 5% which shall also be collected. The exact form, amount, date, interest rate and denomination of said warrants and bonds shall be hereafter fixed by ordinance of the City Council. Said warrants and bonds shall be sold in such manner as the City Council shall hereafter determine. Section 6. All the work necessary to be done in connection with the making of said improvements shall be done by and made by contract upon competitive bids and the City shall have and reserves the right to reject any and all bids. The call for bids for work authorized pursuance to this Ordinance shall include a statement that payment for said work will be made in cash warrants drawn upon the Local Improvement Fund District No. 22. Section 7. There is hereby created and established in the office of the City Treasurer of the City of Tukwila for Local Improvement District No. 22 a special fund to be known and designated as "Local Improvement Fund, District No. 22" into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City, and collections pertaining to assessments, and against which fund shall be issued cash warrants to the -4- contractor or contractors in payment for work to be done by them in connection with said improvement, and against which fund cash warrants shall be issued in payment for all other .items of expense in connection with said improvement. Included as part of the improvements between Minkler Boulevard and Strander Boulevard is filling, asphalt paving, curbs and gutters, street monuments, street signing, storm drainage, water lines, valves and fittings, fire hydrants, street lighting, and street painting. Included as part of the improvement between Minkler Boulevard and.a point approximately 1,400 feet north of South 180th Street is paving, curbs and gutter, street lighting, '1 street painting, street signing and completion of the storm drainage. EXHIBIT ZS PROPOSED L.I.D. NO. 22 CITY OF TUKWILA That portion of the NE 1/4 and the SE 1/4 of Section 26, Township 23 North, Range East, W.M., in King County, Washington, described as follows: Commencing at the northeast corner of the SE 1/4 of said Section 26; thence North 88 West along the north line of said SE 1/4 a distance of 1,998.68 feet to the west line of the east 659.34 feet of the NW 1/4 of the SE 1/4 and True Point of Beginning, said point being the northeast corner of land described in deed under Auditor's File No. 5966911; thence continuing North 88 °05'42" West along said north line a distance of 680 feet, more or less, to the center of said Section 26; thence North 01 12'24" East along the northwest line of said NE 1/4, a distance of 1,293.26 feet, more or less, to the south line of 164th Street (60 feet wide) deeded to the Town of Tukwila under Ordinance No. 92849 (City of Seattle); thence South 88 15'33' r East along said south line 1,970 feet, more or less, to an intersection with the westerly margin of the C.M. St. P. and P. and U. P. 27 foot railroad easement, said intersection lies North 88 15'33" West, 28.14 feet from the westerly line of Andover Industrial Park No. 3 according to the plat thereof, recorded in Volume 78 of Plats, pages 6 and 7, records of said County; thence southeasterly along said westerly margin to an intersection with the northerly margin of a 27 foot easement for C. M. St. P. and P. and U. P. R. R., said easement lies northwesterly of Andover Industrial Park No. 5, as per plat recorded in Volume 83 of Plats, pages 22 and 23, records of said County; thence southwesterly on said northerly margin, along a curve having a radius of 437.28- feet to an intersection with the westerly tangent boundary line of said Andover Industrial Park No. 5, produced northerly; thence southerly along said westerly line South 01 47'28" West to the north line of Minkler Boulevard (90 feet wide; thence continuing South O1 °47'28" West along the easterly line of Parcel M as described by deed recorded under Auditor's File No. 7210060146 to an inter- section with the northerly line of a parcel described by deed under Auditor's 2 File No. 6090291 produced easterly; thence North 87 55'02" West, a distance of 1,050 feet, more or less, to the east line of the W 1/2 of the SW 1/4 of the SE 1/4 of said Section 26; thence northerly along said easterly line 1,320 feet, more or less, to the north line of said SW 1/4 of the SE 1/4; thence South 87 55'02" East along said north line 3.61 feet, more or less, to the southeast corner of land conveyed to J. C.
