ROLL CALL Christy O'Flaherty, Deputy City Clerk, called the roll of the Council. Present were: Council President Joe Duffie, Councilmembers Joan Hernandez, Dennis Robertson, Verna Griffin, Kathy Hougardy, and De'Sean Quinn. SPECIAL PRESENTATIONS Introduction of New Employee; Stephanee Myers, Police Records Specialist. Rebecca McGregor, Police Records Manager, introduced Stephanee Myers, Records Specialist, to the City Council. Ms. Myers is a graduate of the University of Washington with a degree in Criminal Justice and Sociology. She spent 5 years as a Corrections Officer and also owned her own photography business. The Councilmembers welcomed Ms. Myers to the City. Centennial Media Report; Katherine Kertzman, Tourism Manager Katherine Kertzman, Tourism Manager, provided a summary of Tukwila's Centennial celebration planning and events. A video taken at the January 8, 2008 kickoff event at the Westfield Mall was shown to the Mayor, City Council and audience. Ms. Kertzman explained the planning in the last year involved a mix of advertising, media relations, event planning, and Internet and sales promotion. Focus was placed on the following criteria: Positive press coverage for Tukwila Highlighting the early settlers in south Seattle and Tukwila Clarification that the Museum of Flight is in the Tukwila city limits Assisting the target audience to feel a sense of pride and accomplishment regarding Tukwila The print and broadcast coverage (as far reaching as Germany) for the Tukwila Centennial celebration has an advertising equivalency value of approximately $81,000. Tracy Gallaway, Volunteer and Events Superintendent, referenced the multiple Centennial sanctioned events that will be taking place through June 2009. These events showcase the diversity of Tukwila and involve participation by residents, businesses, and City staff. The City Council thanked Ms. Kertzman and Ms. Gallaway for the outstanding efforts put toward Tukwila's Centennial celebration and ongoing events. Approval of Vouchers #337114 337467 in the amount of $1,516,878.71 MOVED BY DUFFIE, SECONDED BY HERNANDEZ TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED 6 -0. PUBLIC HEARING An amendment to the existing agreement with Starfire Sports to convert the Fort Dent softball fields into soccer fields, making these fields available to the youth and adults on teams from the City and surrounding areas and to sublease the fields to a professional soccer club or organization. 7:25 pm Mayor Haggerton opened the public hearing and called for citizen comments. Bruce Fletcher, Parks and Recreation Director, explained a new Major League Soccer (MLS) club has made a request to locate their home practice schedule at Starfire Sports Complex at Fort Dent Park. Starfire Sports has made a request to amend the City contract to allow new soccer fields to be constructed at the softball complex that would be used by the MLS club and at times by Starfire participants. An amendment was also added to address parking issues and allow free parking for Tukwila residents. Abby Smith, 7716 46th Avenue SW, Seattle, spoke in opposition to the amendment and indicated the softball fields are the best in Puget Sound and this would have a negative impact on the sport. Michael Smith, 7716 46th Avenue SW, Seattle, spoke in opposition to the amendment and supports his daughter who is a softball player and conveyed the rights of softball players should not be infringed upon. Galia Alarcon, 11611 Military Road South, Seattle, spoke in support of the amendment and conveyed that soccer has changed her life. Julie Hoyle -Lowe, 7322 Rainier Avenue South, Seattle, spoke in support of the amendment. She is a soccer player and indicated that Starfire is at capacity and is turning kids away. Chris Barringer, 319 NW Market Street, Seattle, spoke in support of the amendment and conveyed no soccer complex comes close to what Starfire has to offer. Juan Saravia, 15232 NE 7th Place, Bellevue, spoke in support of the amendment. He is a facility manager at Starfire and a soccer player as well as a coach. He conveyed that more fields will mean more kids can play soccer. Pete Fewing, 7746 32nd Avenue NW, Seattle, spoke in support of the amendment. He is the Executive Director of Seattle Scores. A Major League Soccer franchise will allow local kids to see training and be in the company of elite athletes and find positive role models. Jesus Alacon, 11611 Military Road South, Seattle, spoke in support of the amendment and would like to see greater support for the Latin community. Mateo Garibaldi, 16702 SE 11th Street, Bellevue, spoke in support of the amendment as soccer gives kids an opportunity to do something outside of their home life and develop skills for further development. Starfire has allowed kids to play for free and provided shoes, socks, shorts, shirts, and other equipment to make playing the sport of soccer a possibility for those who would not otherwise have the chance. City of Tukwila Page 3 of 8 City Council Regular Meeting Minutes February 19, 2008 William Nuttall, 6102 South 226th, Kent, is the President of Diadora America and spoke in support of the amendment. He works in the sporting goods industry and is a professional soccer player. Starfire is one of the finest facilities around and with the growth of soccer, more fields are needed. Ricardo Alfaso, 17409 159th Avenue SE, Renton, is in support of the amendment. Enrico Comenayes, 1630 South 308th Street, #42, Federal Way, is in support of the amendment and would like to see greater support for the Latin community. Samir Hassan, 8030 34th Avenue South, Seattle, spoke in support of the amendment. He indicated that soccer is a year round sport and is growing in Tukwila. Starfire helps kids who cannot afford to play normally and provides an important community service. Having a Major League Soccer franchise at Starfire will put Tukwila on the map. Andrew Opatkiewicz, 400 Wall Street, #621, Seattle, is general manager of Seattle Wolves Football and spoke in support of the amendment. Soccer is not only recreational, but crosses borders and unifies cultures. Georgina Kerr, 3834 South 116th, Tukwila, relayed that in this time of global warming, it is important that environmental concerns be considered upon any expansion of Starfire Sports. With the facility's proximity to the Duwamish River and a possible increase in activity and parking, it is essential that they be good stewards of the land. She asked that all actions taken regarding increased development be mitigated to produce a positive benefit for all future generations. Ryan Larson, 15335 Sunwood Boulevard, Tukwila, spoke in support of the amendment and relayed that soccer crosses ethnic lines and everyone can play. Julia Sanchez, 23149 128th Place SE, Kent, spoke in support of the amendment and loves to play soccer. Cole Pogcon, 18807 SE 270th St, Kent, spoke in support of the amendment and conveyed there are other fields around for baseball and softball. Adam Chromy, 12400 80th Avenue, Seattle, is an elementary coordinator at the Renton Skyway Boys and Girls Club and spoke in support of the amendment. Starfire Sports has allowed their participants to use the facility for free. Warren Ferrell, 15241 SE 171st Place, Renton, spoke in support of the amendment and indicated that Starfire currently does not have enough soccer fields. His children have to practice late into the evenings on school nights and more fields might solve this problem. Shawn Englin, 145 South 106th, Seattle, spoke in support of the amendment. Stan and Stephanie Tran, 8415 South 119th Street, Seattle, spoke in support of the amendment. They have two sons who play soccer, and they feel it has helped keep them out of trouble. Brian Schmetzen, 812 NE 68th Street, Seattle, spoke in support of the amendment. Leighton O'Brien, 1433 SW 344th Place, Federal Way, spoke in support of the amendment as a benefit for the City. Luis Garcia, 19528 SE 241st, Covington, spoke in support of the amendment and conveyed that if not for Starfire, many Hispanic kids would not be able to play soccer. Jim Donner, 2303 North 194th Street, Shoreline, spoke in support of the amendment that Starfire is one of the best local complexes and there are not plans to construct additional fields in the area. Having a Major League Soccer franchise in the area would allow local kids to have an opportunity to meet elite players. City of Tukwila Page 4 of 8 City Council Reaular Meetina Minutes February 19. 2008 Scott Elston, 30614 2nd Avenue SW, Federal Way, spoke in support of the amendment and conveyed there are more soccer players in the area than softball at a ratio of approximately 4 to 1. Mark Fremmerlid, 16838 234th Way SE, Maple Valley, President of Dosveedanya, a girls premier soccer league spoke in support of the amendment. Starfire hosts hundreds of youth players and even more by way of adults. This brings a great many people to the area who eat, lodge, and shop in Tukwila. Chris Henderson, 1964 4th Avenue South, Seattle, spoke in support of the amendment. The All Nations Cup brings people from all over the world to Tukwila, and this expansion is a major opportunity for the City. Lisa Aweeke, 10030 Aerosmith Avenue South, Seattle, spoke in support of the amendment. She is a soccer player and her children are soccer players. She currently works part time at Starfire assisting children age 3 -4 with learning the fundamentals of the game. Alma Torres, 6537 208th Street SW, #B108, Lynnwood, is in support of the amendment. Ouhr Lara, 312 South 108th Place, Seattle, spoke in support of the amendment and coaches for the Tukwila Community Schools Collaboration. He sees a very positive impact in the children he coaches as a result of playing soccer. Kathy Chromy, 11445 163rd Avenue SE, Renton, spoke in support of the amendment. She conveyed that involvement in sports does a great deal to prevent kids from turning to drugs and alcohol. It also embraces diversity and gives every child an opportunity to play. Felipe Maqueod, 6402 33rd Avenue South, Seattle, spoke in support of the amendment. He is the director of a non profit organization that serves 120 kids from low- income families. Giving kids a healthy outlet and dreams can be life altering. Lynn Peterson, 15185 62nd Avenue South, Tukwila, referenced the following: the need to be mindful that the expansion meets the spirit of the contract; that careful attention be made to the parking requirements; the hope that other activities like a parade or the July 4 celebration will be continued; and the possibility that alcohol sales be eliminated. Kay Germiate, 14620 20th Avenue SW, Burien, spoke in support of the amendment. She is a soccer mom and involved with premier soccer clubs. Bringing a Major League Soccer franchise to Starfire would allow the elite players to interact with the kids, which is a great privilege for young players. Shawn Sneider, 1730 22nd Avenue, #W321, Seattle, spoke in support of the amendment. He is an adult competitive player, and it is very difficult for adult teams to find playing fields. They often have to play as late as 11:00 pm just to get a field. Starfire has worked to accommodate their needs and expanding the facility will enhance the ability for more field time for players. Anna Bernhard, 14241 59th Avenue South, Tukwila, conveyed excitement at hearing how enthusiastic the soccer players are about their sport. Travis Tran, 8415 South 119th Street, Seattle, spoke in support of the amendment and wants to "grow up" playing soccer at Starfire. Enrique Aerrara, 1650 South 308th Street, #514, Federal Way, turned in a comment sheet indicating support for the amendment and the Latin community. Lolita O'Donnell, 812 SW 174th Street, Normandy Park, turned in a comment sheet indicating support for the amendment. 8:57 pm Mayor Haggerton closed the public hearing. 8:57 pm Mayor Haggerton declared a brief recess. 9:06 pm Mayor Haggerton called the meeting back to order. Interlocal Agreements for the Recycling Program: 1) Authorize the Mayor to sign an interlocal agreement with the King County Solid Waste Division for the use of grant funds in the amount of $78,645 for Tukwila's Recycling Program. MOVED BY GRIFFIN, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO SIGN AN INTERLOCAL AGREEMENT WITH THE KING COUNTY SOLID WASTE DIVISION FOR THE USE OF GRANT FUNDS IN THE AMOUNT OF $78,645 FOR TUKWILA'S RECYCLING PROGRAM. MOTION CARRIED 6 -0. 2) Authorize the Mayor to sign an interlocal agreement with the Washington State Department of Ecology for the use of grant funds in the amount of $22,276 for Tukwila's Recycling Program. MOTION CARRIED 6 -0. b. A resolution relating to a Growth and Transportation Efficiency Center (GTEC) plan and authorizing the City to adopt a local GTEC designation for the Tukwila Urban Center. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO A GROWTH AND TRANSPORTATION EFFICIENCY CENTER PLAN; AND AUTHORIZING THE PROPER OFFICIALS OF THE CITY TO ADOPT A LOCAL GTEC DESIGNATION FOR THE TUKWILA URBAN CENTER. Alia Company for the Southcenter Boulevard Water Main Replacement Project, in the amount of $73,000 and approve use of the Ending Water Fund balance to pay for a project shortfall of $49,035. Authorize the Mayor to sign Amendment #1 to Contract #03 -058 with Starfire Sports regarding use of Fort Dent Park. (A presentation will be provided by representatives of Starfire Sports.) Chris Slatt, CEO of Starfire Sports utilized a Powerpoint presentation to provide an overview of the history, programs, events, and community outreach involving Starfire Sports. He conveyed that partnering with a Major League Soccer (MLS) franchise will offer opportunities to create state -of- the -art fields, school and camp player mentoring, and it will also promote the City. Tukwila would become one of only 13 cities in the United States with a direct tie to the highest level of play in the United States in the most popular sport in the world. Mr. Slatt explained there would also be positive environmental impacts by way of a 50% reduction in energy usage per hour toward lighting; reduced water usage by 50 and reduced fertilizer use by 50 Bruce Fletcher, Parks and Recreation Director, indicated a review was undertaken to determine the number of residents engaged in soccer activities and those involved in the sport of softball. The results conveyed that 200 Tukwila residents are involved in soccer activities, and 29 adults are utilizing softball fields at Fort Dent Park. The little league baseball teams are using other area fields, and the girls fast pitch teams are using the Tukwila Community Center. The impact of converting the fields to soccer would have a minimal impact to Tukwila residents. While the men's softball team could no longer be accommodated in Tukwila, the City of Seatac has written to Starfire Sports offering use of their fields for softball activities. (The letter was submitted into the record.) Mr. Fletcher also relayed that the annual 4th of July celebration held at Fort Dent Park would not be discontinued if this contract amendment is approved. He recommended approval of the proposed contract amendment with Starfire Sports. MOVED BY HERNANDEZ, SECONDED BY GRIFFIN TO AUTHORIZE THE MAYOR TO SIGN AMENDMENT #1 TO CONTRACT #03 -058 WITH STARFIRE SPORTS REGARDING USE OF FORT DENT PARK.* The Councilmembers exchanged comments regarding this issue to include the desire not to "pit one sport against the other" and the value of both softball and soccer in the community; the need for working City of Tukwila Page 7 of 8 City Council Reaular Meeting Minutes February 19. 2008 together to relocate softball participants displaced by this action; a commitment to act in the best interests of Tukwila citizens; the need to assure that Starfire proceeds forward as good stewards of the land as the development changes; and the possibility of a program that educates children about environmental concerns regarding projects similar to this. MOVED BY ROBERTSON, SECONDED BY GRIFFIN TO AMEND CONTRACT AMENDMENT #1 TO MOVE #4 TO #5 AND ADD A NEW #4 CLAUSE AS FOLLOWS: STARFIRE AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE CITY, ITS ELECTED OFFICIALS, STAFF, OFFICERS, AGENTS, AND EMPLOYEES FROM ANY CLAIMS OR ACTIONS, SUITS, LOSS, COSTS, EXPENSES AND DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING COSTS AND ATTORNEYS FEES IN DEFENSE AND COSTS ON APPEAL THEREOF THAT ARISE OUT OF THE TERMS OF THE BARGAIN AND SALE DEED BETWEEN KING COUNTY AND THE CITY OF TUKWILA FOUND AT EXHIBIT D TO THIS AGREEMENT THAT ARE RELATED TO MAJOR LEAGUE SOCCER USE OF THE FACILITY. Councilmember Robertson referenced the contract between the City and King County that deeded Fort Dent Park to Tukwila. There were conditions associated with that contract that indicate Tukwila must honor the requirements of the 40 -year old Forward Thrust Bond Initiative that purchased the property initially. There are 2 clauses of concern: (1) Fort Dent must be utilized for recreational use; (2) All of the facilities must be available for all King County citizens to use. There is no definition on what "recreational use" means, nor elaboration on what "being available" to all King County citizens denotes. Councilmember Robertson has concern that sometime in the future it could be considered a violation of the deed to allow Major League Soccer at the facility. The City Attorney has drafted this indemnification clause that would take Tukwila out of the middle of this issue. This clause would leave Starfire Sports and King County to work through any future issues relative to this matter. Chris Slatt, CEO of Starfire Sports indicated that previous versions of this amendment had been negotiated over time with City staff, and this represents an unforeseen surprise. He asked for clarification from the City Attorney regarding the exposure and risk on this issue and the expiration date of the Forward Thrust Bonds. Shelley Kerslake, City Attorney, indicated the bonds expire at the end of this year, and the risk is somewhat limited. The risk is to provide equivalent land, and there would be no reversion of the Starfire property or monetary penalty. 10:02 pm 10:10 pm Mayor Haggerton declared a brief recess. Mayor Haggerton called the meeting back to order. Mr. Slatt conveyed this is a difficult decision to make in a short time frame. Councilmember Robertson indicated he had received the wording on this amendment late this afternoon and apologized for the short notice. Mr. Slatt indicated that in keeping with the spirit of the original goal between Starfire and Tukwila, of commitment to kids, the amendment would be accepted by Starfire Sports. *MOTION CARRIED 6 -0 ON THE AMENDMENT TO THE ORIGINAL MOTION. *MOTION CARRIED 6 -0 ON MAIN MOTION. REPORTS Rhonda Berry, City Administrator, reported on repair of the damaged South 178th Street overpass that will necessitate overnight lane closures for two weekends from Saturday 11:30 pm to Sunday 7:30 am on both February 23 -24 and March 1 -2. This affects all 1 -5 southbound lanes from the 1 -405 interchange to South 188th Street. MOVED BY HERNANDEZ, SECONDED BY DUFFIE TO DISPENSE WITH REPORTS DUE TO THE LATENESS OF THE HOUR.
