PRESENTATIONS - No presentations. n. BUSINESS AGENDA A. Federal 205 Levee Repair Proiects - Easement Acquisition Staff is requesting full Council approval for condemnation authority to obtain property on the western bank of the Duwamish River in order to make repairs to Tukwila's certified levee. Staff distributed a draft condemnation ordinance to Committee members. When the levee was built in 1991, the City entered into a Local Cooperation Agreement with the U.S. Army Corps of Engineers. This agreement obligates the City to make all lands, easements and rights-of-way necessary for the construction, operation, and maintenance of the entire levee available, without cost, to the United States. The terms and conditions of this agreement still apply today. In November 2006, a flood brought the Duwamish River to one ofthe highest levels in recorded history. The levee suffered damage at nine different locations. The City requested the U.S. Army Corps of Engineers inspect the damage areas. As a result, the Corps identified two sites that require immediate repair, or the levee could be decertified. In addition to safety related concerns, levee decertification poses an economic hardship on property owners since all developments would be required to raise property levels to at least one foot above the flood elevation; this would not be required for existing buildings. The Corps considered six different repair alternatives and chose repair options which will, in essence, lay back the riverbank. This will require the City to secure additional property along the river for repairs. Due to the aggressive repair schedule the Corps' has proposed, City staff has already been in contact with affected property owners. It is standard for City staff to request condemnation authority at the beginning of a property acquisition process for public projects. Although it is highly unlikely that any that any parcel of land within this area will require condemnation, establishing the ordinance prepares the City for condemnation proceedings, if required. Mark Segale, one of the affected land owners, expressed his support in working with the City on a needs capacity regarding the levee repair. UNANIMOUS APPROVAL. MISCELLANEOUS In response to a previous information request regarding the City's Overlay Program, staff stated that the City spent 180 hours on asphalt patching in 2006; 437 hours in 2007 (an increase of 143%); and the asphalt patching for 2008 is anticipated to exceed the 2007 hours.
