The City Council has allocated $100,000 to TCSC to provide a sustained funding source for continued services. The attached contract for services between the City of Tulrnrila and TCSC \vill provide the legal documentation, the scope of performance services and compensation schedule and amounts. The contract will also outline monthly, quarterly, Bi-yearly and yearly reports and updates to the city. It is the recommendation of the Parks and Recreation Director to authorize the Mayor to sign the contract for services benveen the City of Tukwila and the Tukwila Community Schools Collaboration in the amount of$100,000. Attachments Contract for Services Exhibit A and B Cc Rhonda Berry, City Administrator Shelly Kerslake, City Attorney Evie Boykan, Humans Services Manager Contract No. CONTRACTFORSER'~CES This Agreement is entered into by and benveen the City of Tukwila, Washington, a noncharter optional municipal code city hereinafter referred to as "the City", and Tubvila Community Schools Collaboration (TCSC), hereinafter referred to as "the Contractor", whose principal office is located at 16256 MilitaryRd South, Suite 102, SeaTac, WA 98188. 'VHEREAS, the City has determined the need to have celiain services performed for its citizens but does not have the manpower or expeliise to perform such services; and \VHEREAS, the City desires to have the Contractor perform such services pursuant to certain telms and conditions; nmv, therefore, IN CONSIDERATION OF the mutual benefits and conditions hereinafter contained, the parties hereto agree as follows: 1. Scope and Schedule of Services to be Performed bv Contractor. The Contractor shall perform those services described on Exhibit A attached hereto and incorporated herein by this reference as if fully set fOlih. In performing such services, the Contractor shall at all times comply with all Federal, State, and local statutes, rules and ordinances applicable to the performance of such services and the handling of any funds used in connection therewith. The Contractor shall request and obtain prior written approval from the City if the scope or schedule is to be modified in any way. 2. Compensation and Method of Payment. The City shall pay the Contractor for services rendered according to the rate and method set forth on Exhibit B attached hereto and incorporated herein by this reference. The total amount to be paid shall not exceed 5100,000.00 at a rate of 525,000.00 per qUalier. 3. Contractor Bud2et. The Contractor shall apply the funds received under this Agreement within the maximum limits set forth in this Agreement. The Contractor shall request prior approval from the City whenever the Contractor desires to amend its budget in any way. 4. Duration of A2reement. This Agreement shall be in full force and effect for a period commencing January 1, 2008_and ending December 31, 2008_unless sooner tenninated under the provisions hereinafter specified. 5. Independent Contractor. Contractor and City agree that Contractor is an independent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee benveen the parties hereto. Neither Contractor nor any employee of Contractor shall be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or othenvise deducting federal income tax or social security or contributing to the State Industrial Insurance Program, or otherwise assuming the duties of an employer with respect to the Contractor, or any employee of the Contractor. 6. Indemnification. The Contractor shall indemnify, defend and hold harmless the City, its officers, agents and employees, from and against any and all claims, losses or liability, including attorney's fees, arising from injury or death to persons or damage to propeliy occasioned by any act, omission or failure of the Contractor, its officers, agents and employees, in performing the work required by this Agreement. With respect to the perfOlmance of this Agreement and as to claims against the City, its officers, agents and employees, the Contractor expressly waives its immunity under Title 51 of the Revised Code of Washington, the Industrial Insurance Act, for injuries to its employees, and agrees that the obligation to indemnify, defend and hold harmless provided for in this paragraph extends to any claim brought by or on behalf of any employee of the Contractor. This waiver is mutually negotiated by the parties. This paragraph shall not apply to any damage resulting from the sole negligence of the City, its agents and employees. To the extent any of the damages referenced by this paragraph were caused by or resulted from the concurrent negligence of the City, its agents or employees, this obligation to indemnify, defend and hold harnlless is valid and enforceable only to the extent of the negligence of the Contractor, its officers, agents, and employees. The Contractor shall maintain accounts and records, including personnel, propel1y, financial and programmatic records which sufficiently and properly reflect all direct and indirect costs of any nature expended and services performed in the performance of this Agreement and other such records as may be deemed necessary by the City to ensure the performance of this Agreement. B. These records shall be maintained for a period of seven (7) years after termination hereof unless pelmission to destroy them is granted by the office of the archivist in accordance with RCW Chapter 40.14 and by the City. 8. Audits and Inspections. The records and documents with respect to all matters covered by this Agreement shall be subject at all times to inspection, review or audit by law during the perfonnance of this Agreement. 9. Termination. This Agreement may at any time be ternlinated by the City giving to the Contractor thil1y (30) days written notice of the City's intention to telminate the same. Failure to provide products on schedule may result in contract telmination. If the Contractor's insurance coverage is canceled for any reason, the City shall have the right to terminate this Agreement immediately. 10. Discrimination Prohibited. The Contractor shall not discriminate against any employee, applicant for employment, or any person seeking the services of the Contractor to be provided under this Agreement on the basis of race, color, religion, creed, sex, age, national origin, marital status or presence of any sensOlY, mental or physical handicap. 11. Assi2nment and Subcontract. The Contractor shall not assign or subcontract any pOl1ion of the services contemplated by this Agreement without the written consent of the City. 12. Entire A2reement. This Agreement contains the entire Agreement benveen the pat1ies hereto and no other Agreements, oral or otherwise, regarding the subj ect matter of this Agreement, shall be deemed to exist or bind any of the pat1ies hereto. Either pat1y may request changes in the agreement. Proposed changes which are mutually agreed upon shall be incorporated by written amendments to this Agreement. 13. Notices. Notices to the City of Tukwila shall be sent to the following address: City Clerk, City of Tukwila 6200 Southcenter Blvd. Tukwila, Washington 98188 Notices to the Contractor shall be sent to the address provided by the Contractor upon the signature line belm,v. 14. Applicable Law; Venue; Attorney's Fees. TIllS Agreement shall be governed by and construed in accordance with the laws of the State of\Vashington. In the event any suit, arbitration, or other proceeding is instituted to enforce any term of this Agreement, the parties specifically understand and agree that venue shall be properly laid in King County, \Vashington. The prevailing party in any such action shall be entitled to its attorney's fees and costs of suit. Tukwila} Washington 98188 Jim Haggerton} Mayor To Community & Parks Committee From: Re: Amendment to Contract with Commercial Development Solutions (Lisa Verner) Date: March 6, 2008 Lisa Vemer has been working diligently on our Tukwila South issues since she contracted with the City in 2006. We have amended her contract several times, extending the term of the contract, but have until now not needed to add any dollars. We find now that her contract, currently set to expire 6/31/08, is running out of funds. For this reason, and because we anticipate needing Lisa's expertise past the June 31 sl contract expiration, we are proposing to extend the contract to December 31, 2008 and to add an amount not to exceed $64,000 to the contract. The original contract was for $87,000. Her monthly invoices have ranged from a high of $7,800 to a low of $1,470. As we anticipate her involvement to be at a high level for rest of the year, I used an amount not to exceed $8,000 a month for 8 months - coming up with the amount of $64,000. This will likely drive the need for a budget amendment, as we were not anticipating ongoing negotiations at the time the budget was set. With the committee's concurrence, I recommend forwarding this contract amendment to the April 14th Committee of the Whole meeting, and the April 21 sl Regular meeting for approval. Under Section 4, Duration of Agreement: This Agreement shall be in full force and effect for a period commencing January 1,2008 and ending December 31,2008 unless sooner terminated under the provisions hereinafter specified. Cantu, CMC, City Clerk City Attorney Date Approved by City Council FOURTH QUARTER REPORT TO COUNCIL October 1 - December 31, 2007 Prepared for Community & Parks Committee DEPARTMENT OF COMMUNITY DEVELOPMENT 2007 YEAR END SUMMARY StaffinQ ChanQes In 2007, we had a turn over of five staff positions. The filling of these positions and the new electrical inspector position has taken longer then expected, this has resulted in delaying some projects and contracting for some services until the positions are filled. Sound Transit As construction of Light Rail is moving forward, staff has been working to ensure that the conditions of approval for all permits have been met. Over the past year staff was involved with various noise variance requests from the contractor to do night time work. We have also been working with City of SeaTac and Sound Transit regarding the parking issues at the light rail station. The unclassified use permit for the Commuter Rail Station was extended. We have also been involved with the master planning and design of the permanent Commuter Rail Station. Development Activitv Planning Division - A total of 93 land use decisions were issued: 15 SEPA determinations; 25 Short plat and Boundary Line Adjustments; 15 Special Permission Director decisions including parking determinations and deviations from the sign code, landscape and sensitive areas code; 9 Design Review decisions; 3 Conditional Use Permits; 3 Shoreline Permits; 1 Unclassified Use Permit; 3 Variances for lot size; 3 Comprehensive Plan Amendments; 16 Administrative decision including noise variances, zoning and shoreline exemption letters. Construction Activitv The value of new construction permitted in 2007 was over $173 million, an increase of approximately 87% over 2007. The total number of permits issued in 2007 was 1700, up from 852 in 2006. Single family development continues to be active at 45 new houses. Buildinq Division Assumed responsibility from King County for the enforcement and administration of the Uniform Plumbing Code in March of 2006. In 2007, there were 303 plumbing permits issued and approximately 1725 inspections completed. 4th QUARTER SIGNIFICANT ISSUES On December 3, 2007, City Council approved comprehensive plan amendments and zoning code changes including: 1) revise existing policy 13.4.8 to include the area north of Minkler Boulevard in the Tukwila Urban Center as a potential site for a bus transit center; 2) revise comp plan and zoning from Regional Commercial Center to Low Density Residential on .83 acres at 14427 51st Avenue South; 2) revise comp plan and zoning from Manufacturing/Industrial Center-Heavy to Light Industrial on approximately 34 acres immediately south of Boeing Field. BUDGET PROGRAM GOALS Administration 1. Complete Tukwila South Master Plan and Annexation: Awaiting resolution of Development Agreement issues. 2. Complete draft update of Shoreline ManaQement Master Proqram: DCD submitted a staff draft of the Shoreline Master Program to Ecology in compliance with our grant on June 29, 2007. Staff has continued to check with Ecology staff over the past six months on the status of their review of the staff draft document. Comments have still not been received on the document although Ecology staff recently estimated comments would be completed by mid-January. The delay in receiving Ecology staff comments will impact the City's timeline for the review process by the public, Planning Commission and ultimately adoption of an updated Master Program by the City Council. 2007 Fourth QuarterNear End Report Prepared for Community & Parks Committee Page 2 3. Complete Tukwila Urban Center Plan/Planned Action Desiqnation: Met with consultants to review staff comments and initiate developing public review draft of the TUC Plan. Extended contract for services to prepare the environmental review and planned action for the Plan. To ensure that recommendations support draft TUC Plan concepts, coordinated with Parks on the Tukwila Pond master plan and Public Works on the TS&l study for the pedestrian bridge spanning the Green River. 4. Review/update Manufacturinq Industrial Center Planned Action: Due to the high level of development activity and staff vacancy, this project was delayed to next year. 5. Complete draft Bicycle/Pedestrian "Walk and Roll" Plan: Ongoing staff editing on Public Review Draft document. 6. Review Small Lot Residential Development Policies and Standards: No activity this quarter. 7. Review/update Siqn Code: Organized a joint meeting of the Planning Commission and City Council on October 25. City Attorney presented information on "content neutral" regulations and DCD staff discussed sign regulatory issues and the proposed sign code committee. Code Enforcement 1. Develop proposal for Rental Housinq Licensinq Proqram: Continuing to work with the City Attorney's office to provide talking points for consideration at the Council Retreat in February 2008 as a first step to development of a draft ordinance. Have developed a tentative timeline with the goal of adopting an ordinance by fourth quarter 2008, implementing the program first quarter 2009. 2. Develop proposal for Vacant Structure Proqram: Complete. Permit Coordination and Building 1. Assume responsibility for Electrical Code permittinq and inspections: Complete - In April of 2007 Building Division assumed responsibility from the Department of labor & Industries for the enforcement and administration of National Electrical Code. In 2007 there have been 757 electrical permits issued and approximately 1620 inspections completed. The plan reviews and inspections have been provided by SeaTac staff through an interlocal agreement. The advertisement for the position of Senior Electrical Inspector for Tukwila remains open. 2. Adopt 2006 State Buildinq Code: Completed 3rd quarter. 3. Provide necessary traininq related to the State Electrical Code and 2006 State Buildinq Code: Due to the delay in hiring an electrical inspector, no activity this quarter. 4. Develop Information bulletins for Buildinq, Mechanical. Plumbinq, Electrical and Fuel Gas Codes: Existing bulletins have been updated, new bulletins remain in development. 5. Develop Combination Buildinq Permit for sinqle family residential construction: No action due to high volume of permit activity. Planning Commission 1. Review Siqn Code update: Participated on October 25 in a joint session with the City Council, City Attorney and Planning Staff on expected regulatory issues and proposed sign code committee. 2. Review Shoreline Manaqement Master Proqram update: No activity this quarter. 3. Review Tukwila Urban Center plan: No activity this quarter. 4. Review Small Lot Residential Development Policies and Standards: No activity this quarter. PARKS AND RECREATION DEPARTMENT 2007 YEAR END SUMMARY The Parks and Recreation Department continued to offer a variety of recreational and leisure opportunities to residents and visitors throughout 2008. The department hosted many citywide special events including the annual Tukwila Days event at the Community Center, the Family Forth Event at Fort Dent Park, and summer concert series to name a few. The free summer playground program at Cascade View Park included a number of children from diverse backgrounds. The Tukwila Community Center 2007 Fourth QuarterlYear End Report Prepared for Community & Parks Committee Page 3 continued to be a focal meeting point for local residents, business, and regional meetings as we celebrated our 10 year birthday. The parks division completed the Cascade View Community Park Phase II and the Macadam Winter Garden is now officially open. Foster Golf Links continues to show improvement in both the condition of the course and increased number of rounds played. The Volunteer Program is back with the spirit of partnership between local citizens, businesses, and city government. Additionally, partnership with the All Nations Cup continued to grow strong as tournaments were held at the Starfire Sports Complex at Fort Dent Park. 4th QUARTER SIGNIFICANT ISSUES The Parks and Recreation Department completed a busy year with a successful Holiday Adopt-A-Family program. Over 30 Tukwila families were assisted with holiday gifts to over 100 children. Other holiday events included a popular Breakfast with Santa sponsored by the Tukwila Rotary. The entire senior program participated in the annual Thanksgiving Celebration, which served over 200 seniors. The year ended with an official ribbon cutting for the new Macadam Winter Garden Park. BUDGET PROGRAM GOALS Administration 1. Oversee and monitor all revenue qeneratinq proqrams in recreation, qolf and aquatics: Ongoing. 2. Develop a new Parks, Recreation and Golf Open Space 6-Year Plan for Council approval: 75% complete, plan to be completed by February 2008. 3. Complete the new Macadam Winter Garden Park for public use: Complete. 4. Manaqe Phase I development of Duwamish Riverbend Hill Park: Master Plan complete, Phase I deferred to 2008. Recreation 1. Implement Facility Bookinq software for rental reservations of TCC and park facilities: Complete for TCC rentals. Due to the complexity to accomplish the TCC portion of the project, implementation for park facilities has been deferred to 2008. 2. Increase participation in the Senior Deli proqram by 10%: Complete. Increases are seasonal and based on concurrent programs. We are working to develop additional programs to maintain the increase in participation. 3. Increase the number of new participants in the Senior proqrams by 5% throuqh community outreach efforts: Complete. Overall participation in Senior programs has increased, particularly with our more active population. 4. Provide increased staff support to new City-wide special events includinq the Car Show, Tukwila Centennial Celebration, and TCC Birthday Party: Complete. We have provided staff support for the Car Show and TCC Birthday Party. Additionally, staff plays a key role in the Centennial Celebration. 5. Develop proqrammed teen activities for the Skate park: Deferred to 2008. Events and camps are being coordinated for 2008 at the Skate Park. 6. Add 10 more fitness opportunities for adults: Complete. We have added at least 10 fitness opportunities for adults. 7. Develop and increase preschool aqe proqrams and activities: Complete. A new 2-year old pre- school class was implemented as well as pre-school aged activities and events. 8. Expand relationships with the School District to offer co-sponsored youth sports camps and clinics: Complete. We have worked with the Tukwila School District to offer Basketball Camps and Clinics, and tennis instruction. Aquatics 1. Increase Aquatic Proqram Fee revenue by 10% of the 2006 total: Aquatic Program Fee revenue ended up down 11 % from 2006. An Instructor shortage throughout much of the year was the main factor. 2. Siqnificantly improve the facility's look and feel by replacinq the pool liner and tile, and by upqradinq the pool's HVAC controls and capabilities: On hold. The Tukwila School District has not yet 2007 Fourth Quarter/Year End Report Prepared for Community & Parks Committee Page 4 chosen to make a decision about an extension of the pool's lease that ends September 15, 2011. Major CIP projects are on hold until we have assurance that the lease will be extended at least twenty years under reasonable terms. 3. Replace startinq blocks with corporate sponsored Quikblox: On hold. These starting blocks will have to be modified to fit our deck, which would change, with new tile. 4. Reqrout tile and replace broken tile in both the men's and women's locker rooms: Complete. Rave reviews on the regrouting and the replacement of tile. 5. Offer CPR classes to the community and City of Tukwila personnel at least once per quarter: Ongoing. Certifications and re-certifications have taken place through out the year. No classes are currently scheduled. 6. Offer after school proqrams for Tukwila School District students in the sprinq: Complete. The first year Tukwila Turtles Special Olympics swim team practiced for twelve weeks after school on Fridays leading up to the State Championships June 2, 2007 where team athletes brought home three gold and three silver medals. 7. Continue to work with the Tukwila Community Center in marketinq and makinq pool time available to TCC's special events and camps: Complete. Tukwila Community Center Camp Tukwilly swimming lessons used the pool and pool staff for eight one-week sessions over the summer. Parks Maintenance 1. Assimilate new parks into the Parks Division (Codiqa Farm Park. Macadam Winter Garden, Cascade View Community Park Phase II) and develop maintenance plans for each: Ongoing. 2. Continue with flower basket proqram: Ongoing. Baskets taken down in October. 3. Add plavqround equipment for pre-school aqe users at the Tukwila Community Center: Completed. June 2007, with the help of UPS employees. 4. Provide assistance to the Recreation Division for City-wide special events includinq the Backvard Wildlife Fair and the Tukwila International Farmer's Market: Ongoing. 5. Provide additional handicap parkinq at Tukwila Community Center parkinq lot: Completed. 6. Oversee all volunteer park enhancement proiects annuallv: Working with REI, Girl Scouts, UPS, Macy Logistics and other groups in completing projects including planting, litter and garbage removal and playground installation. Maintain and improve communication between the two libraries within Tukwila city limits. the Tukwila Library Advisory Board. the Tukwila City Council. the Kino County Library System. the two "Friends of the Library" oroanizations. and the Tukwila oeneral public: Have been meeting with the Friends group regularly. 3. Provide support to literacy in Tukwila and at the Parks and Recreation as well as Kino County Library System special events: Had booth at Dr. Seuss Birthday Party on March 1, 2007 and a special table at Tukwila Days Festival.
