REGULAR MEETING MINUTES
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Jim Haggerton called the Tukwila City Council meeting to order at 7:03 p.m. and led the audience
in the Pledge of Allegiance.
ROLL CALL
Christy O'Flaherty, Deputy City Clerk, called the roll of the Council. Present were:
Council President Joe Duffie, Councilmembers Joan Hernandez, Pam Linder, Dennis Robertson, Verna
Griffin, Kathy Hougardy.

SPECIAL PRESENTATIONS
Cascade Water Alliance Briefing on Lake Tapps Asset Purchase Agreement: Ed Oberg, Michael
Gagliardo, Mike Ruark, and Joel Gordon Cascade Negotiating Team
Cascade Water Alliance is an association of eight cities (that include Tukwila) and water districts in the
Puget Sound region working together to ensure a clean, safe, and reliable water supply for people, the
environment and a growing economy.
Ed Oberg, Chief Executive Officer for Cascade Water Alliance, introduced the members of the negotiating
team with regard to the acquisition of Lake Tapps by the Cascade Water Alliance: Michael Gagliardo,
Director of Planning; Mike Ruark, General Counsel; and Joel Gordon, Special Real Estate Counsel.
Member of the negotiating team utilized a Powerpoint presentation to delineate the various aspects
associated with the acquisition of Lake Tapps by the Cascade Water Alliance. Key elements of the
presentation included:
Lake Tapps Project Summary:
-The Cascade Board is scheduled to take action on the Asset Purchase Agreement for the acquisition of
Lake Tapps on March 26, 2008. This involves the purchase of approximately 150 real estate parcels.
The closing must occur within 2 years and could be closed as soon as 45 days after execution if all terms
and conditions are satisfied.
Initial Lake operations to maintain recreation and fisheries
Projected water supply project phase 1 to be completed in 2025
Projected water supply project phase 2 to be completed in 2036
Projected full use of available water 2050
Purchase Price:
Minimum Purchase Price $25 million
Contingent Purchase Price $5 million, payable only if the municipal water rights are issued with tribal
settlement flows or modified flows acceptable to both tribes
Adjustments to the purchase price $9 million (estimated). Per 2001 Memorandum of Understanding:
Process Costs, Lake Operating and Management Costs, Printz Basin Improvements
-Total Purchase Price with adjustments $39 million

Conditions to Closing:
Cascade Water Alliance has met all necessary conditions
Puget Sound Energy (PSE) is to obtain Washington Utilities and Transportation Commission (WUTC)
approval and approval of all boundary line adjustment applications
PSE to satisfy water right land transfer requirements of Department of Ecology
Title company will issue the required title policy to Cascade
Covenants by PSE to pursue satisfaction of these conditions so that Cascade's interests are protected
PSE will also pursue the change in use of the hydropower water right and participate in the municipal
water right process, both as directed by Cascade
Rate Projections include:
Ongoing Lake Tapps Operations and Management
Implementation of Tribal Settlement Agreements
Lake Tapps Capital Program
Lake Tapps Water Treatment Plant and Transmission Pipeline
Mayor Haggerton thanked the Cascade Negotiating Team for the excellent presentation and also
referenced the contribution of Pat Brodin, Public Works Maintenance and Operations Manager, for his
ongoing efforts toward this project.
Councilmember Hernandez inquired as to the anticipated revenue source for the needed capital
improvements for this project. Michael Gagliardo explained that all of those costs have been included in
the rate model and have been allocated in a similar manner as all other capital and operating expenses.
Councilmember Linder referenced the portion of the presentation that indicated the closing on this
agreement must occur within 2 years. She asked what would occur if the outstanding conditions are not
met within that time frame. Mike Ruark indicated the agreement could be terminated, renegotiated, or
extensions allowed, where appropriate.
Councilmember Robertson inquired about the various issues associated with the purchase of so many
residential properties (fertilizers, sewers, water level, etc.). Mr. Gagliardo recognized that there are many
issues that will need to be dealt with on an on -going basis, and the hiring of Lake Manager will be an
asset in working through those matters.
Councilmember Robertson asked how much water will be drawn from Lake Tapps for use by the Cascade
Water Alliance. Mr. Gagliardo conveyed that the water right is for 65 million gallons per day. The current
contracts with Seattle and Tacoma, for water at the rate of 26 -27 million gallons a day, are structured to
decline over time. The large water right from Lake Tapps will serve the Cascade Water Alliance well into
the future (year 2050).
Councilmember Robertson inquired as to what happens if this contract does not go through. Mr.
Gagliardo indicated that it would be necessary to find additional water supplies. While there has been
preliminary investigation into contingency plans, the Alliance is confident this project will proceed as
planned.
CITIZEN COMMENTS
Travis Johnson and Stewart Battle, from the Larouche Political Action Committee, 14712 Bothell Way NE,
Lake Forest Park, requested the Council consider passage of a resolution supporting The Homeowners
and Bank Protection Act of 2007. They provided written documentation with an overview of the act, the
petition to Congress, and a sample resolution. Mr. Johnson and Mr. Battle relayed that in similar

circumstances in the 1930's, President Franklin D. Roosevelt (FDR) successfully intervened to protect
banks and homeowners. FDR addressed Congress with a "declaration of national policy," which stated
that the broad interests of the Nation require that special safeguards should be thrown around home
ownership as a guarantee of social and economic stability, and that to protect homeowners from
inequitable enforced liquidation in a time of general distress is a proper concern of the Government."

MOVED BY DUFFIE, SECONDED BY HERNANDEZ TO APPROVE THE CONSENT AGENDA AS
SUBMITTED. MOTION CARRIED 6 -0.
Councilmember Hernandez indicated this item was discussed at the Community Affairs and Parks
Committee meeting on February 25, 2008. The committee members were unanimous in recommending
approval. (Due to the cancellation of the March 10, 2008 Committee of the Whole meeting, it was
necessary that this item go directly to the Regular Meeting.)
The proposal is to increase the 18 -hole rates by $1.00 and the 9 -hole rates by $2.00. The junior rates will
not be increased. This modest fee increase is expected to raise the green fee revenue, while maintaining
the fees equal to or below local municipal competitors.

READ BY TITLE ONLY. MOTION CARRIED 6 -0.

MOVED BY HERNANDEZ, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE
ADOPTED AS READ. MOTION CARRIED 6 -0 TO ADOPT RESOLUTION NUMBER 1660.
REPORTS
a. Mayor
Mayor Haggerton attended the National League of Cities (NLC) Conference in Washington DC this past
week. There were multiple meetings with the State Senators where the needs of the City of Tukwila were
conveyed. There was also discussion regarding the relocation of the railroad tracks in the area of the
transit station that resulted in positive feedback.
b. City Council
Councilmember Hernandez attended the March 4, 2008 Tukwila Government Affairs Committee meeting.
Hillman Mitchell, Tukwila's Emergency Management Coordinator, was the guest speaker and was well
received by the committee. She also attended the open house event at the Riverton Terrace facility and
the DARE graduation ceremony on March 5, 2008. Officer Brendan Kerin was honored for 20 years as a
DARE officer.

Council President Duffie also attended the March 5, 2008 DARE graduation event. He asked the
Councilmembers to consider how they would like to deal with the possibility of joint meetings with other
local cities. It was determined this topic would be a discussion item at the next Committee of the Whole
meeting. Mr. Duffie also indicated the Council should begin working on its Standard Operating
Procedures.
Councilmember Robertson suggested the possibility of the City acquiring the equipment necessary to test
children's toys with regard to safety concerns. The equipment costs between $10,000 $20,000, and it
could be available for testing purposes for Tukwila citizens. Mr. Robertson has spoken with staff from the
Fire Department regarding this issue and its potential service to the community. There was consensus
from the Council that this item could be forwarded to a Finance and Safety Committee meeting.
Rhonda Berry, City Administrator, indicated that options could be pursued regarding this issue.
Councilmember Griffin attended the March 6, 2008 Equity and Diversity Commission meeting, as well as
the recent NLC Conference. She is a member of the Council for Youth, Education and Families and
brought back beneficial information from the conference regarding youth and family issues that she will
provide to the full Council. Ms. Griffin shared information from the Utilities Committee meeting regarding
an increase in solid waste rates. An increase of 2.9% is going into effect, and customers have already
been notified. She indicated there will be a Latino Parent Night at Foster High School on March 18, 2008,
as well as a District Choir event that same evening at the high school.
Councilmember Hougardy also attended the NLC Conference in Washington DC this past week. She will
be providing additional information to the Council regarding safe ways to encourage students to walk to
school both to improve health and reduce traffic. While this often involves the need for additional
infrastructure such as sidewalks, she was provided information that indicates money is available for
communities to pursue this issue. Ms. Hougardy attended the Southwest King County Chamber of
Commerce luncheon this past week where Rob McKenna, Attorney General, spoke regarding gang
intervention. She offered a reminder about the upcoming bowl -a -thon on March 29, 2008.
c. Staff
David Haynes, Police Chief, spoke regarding the recent passing of Tukwila Assistant Police Chief Darrell
(DJ) Baskin after a valiant battle with cancer. DJ was a devoted public servant of the Tukwila community.
He loved the citizens and children, in particular, and thought policing was the best job anyone could have.
Chief Haynes offered public thanks for the work and service to the Tukwila community that have been
offered selflessly by DJ Baskin.
The Council will be kept informed regarding the upcoming memorial service.
d. City Attorney
There was no report.
e. Intergovernmental
The Council Analyst was not present.
MISCELLANEOUS
Mayor Haggerton relayed that while at the NLC Conference this past week, he moderated a workshop
regarding the conversion of televisions from analog to digital technology. He explained that effective
February 17, 2009, televisions will need to be converted for continued functionality. While cable
companies will provide this service for their customers, those people who use outside antennas or rabbit
ears will need to acquire converter boxes.
